  • LOL, and now they're releasing "piggy keyrings" for 6k and 7k… they've obviously noticed the decreasing sign ups as the 31st May deadline approaches and they're offering incentives so that they can show the powers that be that they made their numbers. I'm guessing that means their plan was to spend $20k to get around 7.5k Facebook fans. Now if people start "unliking" them after the promo finishes… will be interesting to see whether they'll count it as a successful campaign or not.

    So their ad says "$500,000 to be given away", but if they only get 6000 people @ $20 each then that's only $120,000. Does it make their ad misleading if they don't give away the remaining $380,000?

    • From my understanding it goes like this: just say it finishes off with 6000 fans by the deadline. Only the first 2000 people get the $20 voucher and the other 4000 get nothing. Hope i am wrong on this though. Also theres been no reply from SS on how the reward gets distributed

        Nope, you've got it right. They'll only be forking over $40k worth of "value" - which is to say that not all of it will be pure loss for them so in real terms their "cost" will be < $40k despite their ads loudly proclaiming the possibility of $500k. I have to hand it to them, it is a very good marketing concept. I'd love to steal it (long enough down the track so that people have forgotten about this, obviously), but the company I work for would never allow something like this to fly.

        If you read it word for word it could mean that they only have to give away money if they get exactly 1000, 2000 or 10,000 fans, and there's clearly a fat chance of that.

        The whole thing seems quite ambiguous as their initial statement promises $500K as does the graphic. I think the lack of terms and conditions generally confirms that no solicitors were involved here. If your interpretation is right, I'd hate to see what happens after the 4,000 people who miss out start making some noise and complaining to the authorities. Having disappointed people could see this end up like the UBank PR disaster we saw here on OzB not too long ago… or worse. Imagine them trying to argue their liability in court on the basis of the ambiguous ad.

        If they said "up to $500K" that would be different.

    So I guess my initial instincts were right! $500,000 give away? more like zilch! Those coupons would have costed them barely anything!

    Looks like they probably didn't have to spend anything given the voucher would just reduce their gross profit.

    This is very very dodgy from Shopping Square. Looks like thousands and thousands of free advertising for them with ozbargain as the side portal! I am sure they attracted thousands of hits on their website from this promotion and generated many sales from new customers who found the site via facebook "likes".

    Is there a way to "dislike" them on facebook? If not, people not happy with this should update there status to "avoid shopping square" or something similar so friends/family don't think you are promoting their business/service since you have said you "like" shopping square.

    SPREAD THE WORD! Don't let them take advantage of us!

    Also I think ozbargain is partially to blame for not stopping this "bargain" or at least enforcing the poster to obtain more details about the deals before reposting, not just that the deal was "active".
    I questioned this deal but no mod responded.

    If we let this slide it will open the floodgates for other advertises posting while not providing all details of the actual deal (in this case, $20 "worth" turns out to be $5x2 & $10x1 with min spend).

    People need to know what they are voting for, that was my point.

    The $5 vouchers are pretty useless, and the $10 vouchers only covers shipping. So its pretty much just free shipping. I would give a negative vote too but I can't because my account is less than 30 days old, lol…

    But anyway, you won't see me buying anything from shoppingsquare… this is a bs marketing scheme.

    Mod please consider to PERMANENTLY BAN Shopping Square for any future deal. Shopping Square lure so many people into this facebook scam. We can't tolerate such a irresponsible business using OzBargain for their pure advertising activities.

    Ah, and again we see a company try to pull off a viral marketing ploy, only to move the goalposts have it backfire with negative publicity. I shall draft a complaint that we can mass submit to the ACCC, if nothing else then just to make Shopping Square and other retailers more accountable for their actions.

  • did my share, having my voted revoked. i've bought from them before, and had a problem with one of the items, but i thought i'd try and stick them out. after this though, i'm done. i'm taking myself off their e-mail list, through with their shenanigans.

    As promised I’ve drafted the following which can be pasted in the ACCC online complaint form in about 30 seconds and conforms to the 1500 char limit. Sorry if you don’t like how I’ve worded it or whatever, but feel free to change it up etc…

    Product description: Shopping Square $500,000 Promotion
    Product provider: ShoppingSquare.COM.AU - Apus Corporation Pty Ltd (ABN 11 109 351 877)
    Complaint description:

    On 25 May 2010, Shopping Square announced “We'll give away $500,000 dollars if you click like and become a member on our facebook (sic) page.” I clicked in the belief that “There’s nothing to lose and free money for everybody” and that “these vouchers can be used on absolutely anything you want in Shopping Square!”

    Online forums speculated the ambiguity in the announcement, including that 6000 ‘likes’ equates to only $120,000 worth of vouchers. It was noted that there were no terms and conditions nor any other details to clarify their promotion, aside from the initial announcement.

    It was only on the last day of the promotion (some five days later), that Shopping Square revealed their “T&Cs”. Suddenly it was uncovered that the 5000+ individuals who were led to click ‘like’, would not be getting “free money” and nor would they receive “vouchers which can be used on absolutely anything you want in Shopping Square”. Instead they will get 3 separate vouchers which cannot be used in the same order, nor for “promotional items” and neither for postage costs. Therefore the vouchers cannot be used without spending some money. Their famously high postage will also help them to unfairly capitalize on the promotion.

    I strongly feel that Shopping Square has committed a dishonest and blatant bait and switch in breach of trade practices law. I trust that the ACCC will take all appropriate action against them and work to discourage other businesses from such conduct in future.

    • Hey thanks for the effort of putting this together, but I worry that it is not an accurate description of the situation.

      I did not receive the original email, but in the description of this deal, by kumak, it does say that "if 1000 people click like, those 1000 people will receive $10 worth of Shopping Square Vouchers." Bad English, yes, but it is assumed that it is a first come, first served offer. If that is the case, it is also assumed that those "5000+ individuals" who clicked after the 2000th click do not get anything until the 10 000th click is registered.

      I agree whole-heartedly that it was bad form for the SS to withhold T&Cs until the last day, and should be reported for misleading the public. Since we have passed 2000 "likes," the picture on their website specifically says "$20 vouchers," but there is no $20 voucher, only vouchers adding up to $20. However, the $500,000 to be given away, in context of the web page before the addition of the T&Cs, is contingent on 10,000 "likes." In all seriousness, the page also reads "If 2000 people click like, those 2000 people will receive $20 worth of Shopping Square Vouchers." Deliberately misinterpreting that sentence, it could well mean that there is $20 worth of vouchers to be split between those 2000 people.

      Hence I do agree that it is bait and switch, and while they do renege on their "absolutely anything" statement, I worry about the accuracy of your second paragraph and the beginning of the third. Hope you'll take it into consideration. Cheers

        2nd Switch:
        - They removed the minimum spend… I think they saw our complaints here and got scared, but it shows how they are making things up as they go.

          Agree with most of your points. The 1000/2000, however was not my suggestion, but rather in the first half of the OP. My point is that the "everybody" in "nothing to lose and free money for everybody!" is used very loosely, if read in context of the 1000/2000/10000 parameters. I am not condoning this inconsistency though.

          The number of contradictions present at the beginning of the deal, however, is unacceptable even if we do not consider the switches. If you look at the ss web page the deal is on, and the poor fomatting/grammar, it almost seems like they are using poor English as a front for the ambiguity and poor business practices. I hope this is not the case.

          I had the same question as you did about the 1 claim per household. When I posted it on their facebook, I received an equally ambiguous reply that shed light on nothing. I haven't seen a debacle like this in a while, and they do need to be held accountable lol. Next time, it should just go straight to the ACCC.

      Actually, can you also report them for an issue with the $20. If the two $5 and one $10 voucher can't be used in conjunction with each other, and each household can only make ONE claim, then noone is actually getting their $20 voucher. You can only use either $5 or $10 or your "voucher" that isn't really "a" voucher. lol

      Thanks for putting this together. For the record, I used my own version:

      "Last week, shoppingsquare.com.au promoted a “$500,000” giveaway, with vouchers of reportedly $10, $20 and $50 value as an incentive for signing up with their Facebook page. Their banner referred to these as "free money" and specifically stated that “these vouchers can be used on absolutely anything you want in Shopping Square!” The language was clear and unambiguous, in both the amounts offered, and the lack of conditions placed upon their use by successful claimants.

      Several days after the launch of the promotion, they released the Terms and Conditions of the offer, which painted a substantially different picture to those that appeared in the promotional materials. Given the way events unfolded on Facebook, I believe that the promotion was deliberately designed to mislead: that shoppingsquare.com.au had never intended to give away anywhere near the $500,000 claimed, and deliberately withheld important details in relation to the particulars of the promotion in order to drive increased Facebook sign-ups and participation.

      While I suffered no direct financial loss, recommending this promotion to my friends, colleagues and peers has harmed my reputation. As a marketing professional in an IT organisation, maintaining a good Social Media standing is of no small importance. Therefore I strongly urge that the ACCC take punitive action towards shoppingsquare.com.au, to prevent them and other similar businesses in future from harming others in the same way that they have harmed me."

    2. The T&C about promo items has been removed

    I guess you can always unlike them after using the voucher if you feel compelled to do so lol

    If that means we have to buy something in 48 hrs after 12pm, I'm going to be pretty pissed I got tricked into this. They better mean claim as in claiming the voucher for later use.

    K, so SS has about 30 mins to make good on their promise to put up the codes to the vouchers at 12pm. Considering that their page is still down, it looks like they're going to be reneging on even that part of the deal.

        I find it all a bit dodgy considering you monitored this deal from the start but never replied to clarify details about this "bargain" when asked numerous times. You guys intentionally played your words to your advantage to deceive new customers by not clarifying the terms of the deal when asked and now that you know what has hit the fan you are trying to clean up the mess.

        I'm not sure about other people but Shopping Square had their chance, I'm not going to accept this anyhow considering shipping prices are ridiculous and prices aren;t great. Also based on principle.

  • I clicked the 2x$5 and 1x$10, not knowing what conditions were on the $20 (wasn't posted up at the time). Not really expecting much at this point of the twisted tale anyway. Looks like a last minute effort to hold on to some of their customers.

    How likely do you guys think they'll actually deliver on this? I've never seen a business mess up like this before

    • I think they will give your those vouchers but there are many other variables terms and conditions that DO NOT make this a bargain.

      Expiry date of vouchers danilochan? I would add this to your new terms and conditions to make you guys seem ah less dodgy.

    They've also added yet another new clause "one of the fans on the Shoppingsquare.com.au Facebook Page who clicked like [and maintain 'like'] before the closing of the promotion at 12am 1/6/2010 AEST. That was never in the T&C or the original scam.

    You better give me my voucher or I'm reporting you too.
