This morning you would be free on your own exploration of Chengdu. Or you may choose to join the optional tour to Chengdu Research Base of Giant Panda Breeding.
Chengdu Research Base of Giant Panda Breeding: Chengdu has been the ancestral homeland to giant pandas since ancient times. In order to rescue and protect the endangered giant panda species, the Chengdu Research Base of Giant Panda Breeding was established in March 1987. Now giant pandas, lesser pandas, black-necked cranes, white storks as well as over 20 species of rare animals are fed and bred there. However visitors are always most delighted to see lovely giant pandas. Some of them love it so much that they pay as much as CNY2000 to hold an 8-to-10-month-old panda and take photos with him / her for one or two minutes. (FYI sometimes if the pandas are not in good condition, the holding and photo-taking is not allowed no matter how much the visitors would like to pay.)
This afternoon, the tour guide and the driver will pick you up and you will start your guided Chengdu sightseeing. Chengdu is dubbed as Land of Abundance. People here live a very leisure life. Jinli Street is a representative of this life style. Stores of old-time features line along the street. No matter how many people on the street you would find relaxing and peaceful ambience in the stores. You could find most of the local products here, such as baldachin, Shu Embroidery, lacquer products, folk handicrafts, antiques, or calligraphies and paintings of celebrities. Not far away from Jinli Street locates the largest Buddhist temple of Chengdu- Wenshu Temple. It was originally built some 2000 years ago and was renovated times and times.         I must admit that I did not read the entire T&C of this deal before voting. I did not pick up on the $150 penalty and was not aware that it was a shopping tour. I completely agree with you that this should have been disclosed prominently and all extras (eg the tipping) should have been included in the headline price. I cannot edit/take back my earlier vote or comments so hopefully this makes my present position clear.

        The owner of TravelFactory is a local friend of ours, hence the links to each others sites. We do not share inventory/marketing etc.

        The owner of TravelFactory and I have spoken and he is truly sorry for how this has turned out, and I am guessing this experience will lead to more transparent deals posted in future.

        That is a scam. China does not have tipping. You can be sure the money goes to the tour company, and not the low-paid staff.

          Because it is a captive shopping tour where the tour company expects to make money based on kick backs from the stores you visit.

          Cheap China tours spend most of the time taking you to tourist traps which sell overpriced souvenirs and food.
          The company gets generous kickbacks from these businesses - just look at the itinerary!

          You'd have to be paid a lot more than $999 to consider this trip. They are supposed to be banned, but as they say in China, the mountains are high, and the emperor is far away.

      But I'll defend the 798 Art Zone. It's a great place, so they probably rush you through it…

        I second this. 798 Art Zone is awesome. I believe it was a rundown and unused district; their warehouses were being sold on the cheap and over the decades its turned into a booming art scene for indie/up and coming artists.

        But this one has the number of suckers in the tour group, not just the single traveller from the Youtube videos. So 10 people in this tour group x $100pp tea house scam. That's almost like organised crime and on a grander scale than the Thailand cheap TukTuk shopping scam. I'm actually glad i've checked this out now so when i do go i wont get conned by it.

    Extra charges for not following the tour that you've already paid for. $150 p-day! Something smells rotten! And Check your travel insurance very very carefully, you might not be covered for something like that.

    This sounds like a lot of those $99 China tours where you have to buy the air fare separately. The tour organisers get their money back as commissions from those local Chinese business. I guess they are still OK for people who want to try out those local Chinese business's product and service. But if you only want to spend your time visiting famous tourist sites, then these tours are not for you.

    • If your time is not valuable then the tours are okay, especially if you can extend for a week or two on your own. I also know of people who string multiple $99 tours together to save on the airfare (not relevant in this case).

    They will take u to the shitty places where u must buy there over priced items. Money goes to the sales people with the tour guide getting a cut. When touring they make you spend longer times at the one location if no one buys items as well.

    This is very dodgy. Here's why.

    Hiding the real cost

    The tour company needs to be upfront about the minimum amount the customer needs to pay for the tour. They've hidden the compulsory "tipping fee of $80 per person" from the headline and you don't see it until you scroll to the bottom.

    This is illegal under section 48 of the Australian Consumer Law, which says you need to display the single total price of the service, at least as prominently as you display a component price.

    Charging $150 per day for leaving early

    One way or another, they're doing the wrong thing.

    They're probably getting secret kickbacks, which user manic explains is banned in China. And in the case that they're not, requiring travellers to pay the $150 is probably against Australian law.

    Under Australian law, penalty clauses in a contract are void and unenforceable (see this article for more). Assuming no kickbacks, we would expect that a tour company doesn't lose out if you decide to leave a tour early, since you've already prepaid for the tour. So forcing travellers to pay an extra $150 a day seems to bear no relation at all to any loss suffered by the tour company, and smells more like contractual penalty.

    As many people will already know, engaging in misleading or deceptive conduct is unlawful under section 18 of the Australian Consumer Law. Telling customers they are bound to pay this penalty, when under the law they actually aren't, is probably misleading/deceptive.

    Anyways, it didn't take the OzB community long to get the measure of this 'deal'. I'm impressed. In fact, this is where OzB really comes into its own I reckon. Whoever has the time/knowledge reads the fine-print/knows what to look out for, and quickly educates the community/ posts a few pertinent passages copied directly from the "dealers" website.     To the Oz bargain community

    First thing I want to say is I’m Sorry for the slow response to your comments.

    I’ve been a bit shell shocked with the post and how bad it’s all gone. There was never any intention to deceive or mislead anyone in anyway

    I’ve been on Oz bargains for over one year now and have posted as much as im allowed to depending on how my previous posts have performed. To date I have Posted 31 deals and had mixed responses some good and some bad.

    In all honesty Oz bargains is a tough gig any post less than exceptional gets hammered I’ve found it’s a good barometer for how the wider community will view my offers.

    I visited China with my wife and did this exact tour and yes there were shopping stops but never did I feel pressured into buying anything I didn’t want so I felt completely comfortable in promoting the offer.

    In regards to the penalty I didn’t think much about it and what it implies. I just went on my own experience of the tour, we had a great time and a really cheap holiday.

    In closing I realise I have most likely done my dash on ozbargains but I hope not.

      You haven't addressed any of the concerns raised as to the legality of your deal. You've only attempted a sob story and a "trust me, it's really good, look at my reputation"

      What about the compulsory fee not included in the headline price?
      I think that would be the first thing you'd address. As has been pointed out numerous times in this thread, Australian consumer law requires full price disclosure in the headline price. It appears as though this deal is illegal based on this point alone.

      What about the outrageous $150p/day charge for not following the agreed itiniary
      Even though these are already prepaid, there is an additional charge for not doing things? This makes no sense. OP, is this legal? Because to me, it seems very illegal to charge a penalty.

      What about the shopping events?
      Are there any kickbacks? You haven't said anything about this despite all the chatter above. I've got no evidence for this one, other than the extra charge above if they aren't attended, you can see why people are drawing this conclusion. They are 100% illegal in China. It doesn't matter how much fun you had.
