    Well my order with TheHut.com is showing as awaiting stock pickup. No emails to say it's been cancelled. Plus they had already emailed me a 10% discount coupon, so I applied it to this and got the 10 Blu Rays for only 9.76 pounds!

        I always saw a sale transaction as a contract between a seller and a buyer. For the buyer's money, the seller has an obligation to provide the goods paid for, otherwise, they are breaking the contract. Lucky for zavvi, a term of sale is that they don't take your money unless they can give you the goods. If not for that policy, they would be sensationally boned :)

    With the likelihood being that it's an honest, obvious pricing error, who thinks they're actually going to honour all the orders? There were forums spamming this offer all over the net all day, so the volume of orders received is likely to be in the thousands. Even if they're only losing £50 a pop (conservative) per bundle, this equates to a vast and possibly untenable loss. Historically, businesses have tended to enact T&C clauses that give them an out rather than cop a huge loss like this.

    Honouring price mistake are a grey area, even in Australia. Just saying you will buy something doesn't mean there is a contract. There is offer, consideration, acceptance etc etc. Happens all the time. If they find it's a price mistake, warn everyone quickly enough and don't take money it's unlikely to be an issue. They could conceivably get done for false advertising, but it is by no means a shoe in and if the company is in the UK you would have to take it up with consumer affairs in the UK.

    • Well put. Given Zavvi's terms, they don't charge you until they are ready to ship the order which in turn means there's no enforceable contract until this point.

      • Just because they haven't taken your money yet doesn't mean it isn't an enforceable contract. An agreement to exchange goods for payment at a later date is perfectly valid and enforceable. That said, please don't try to take the hardline to enforce this contract anyone, it would be a huge waste of time because you know it was an innocent price mistake.

          Further to above, here are the steps just in case people are confused:

          1) Zavvi advertises the products they are selling = Invitation To Treat.
          2) People go to the checkout and 'offer to purchase' the items in their basket = Offer.
          3) Zavvi accepts this offer by sending written confirmation of order being fulfilled = Acceptance.

          No one is obligated until step 3.

          You handing over money to Zavvi doesnt obligate them. They still need to accept your offer. Likewise if you go into order history, you can cancel your order prior to receiving their acceptance. No one is obligated to complete until acceptance has been received.

          The above is 100% UK Law. That's where Zavvi is based.

          A price list or catelogue is not an 'offer' in contract law, its an 'invitation to treat'. You being happy with the price and offering cash for the product doesnt obligate the seller to sell you that item. Otherwise you could go into any retailer and wave about a catelogue demanding the 100 items are sold to you. Not so. Ok some major retailers have 'consumer friendly' policies, but these shouldnt be confused with the law. An advertisement is most certainly not an offer. An offer needs specifics (quantities, payment method, availability of item etc), and then the retailer can decide on whether they wish to accept.

        • You have offered them money, they haven't taken it. The contract is not complete. They are not obliged to sell you something just because you want it or even because they have advertised it.
