Received an email from Secure parking for their active August campaign. If you book a bay between the 16th and 30th of August they will send you a code for a $50 New Balance Voucher for use on the new balance website on full priced items.

Link on their website has the following terms and conditions:

Applies to all online parking bookings with Secure-a-Spot:All customers who book parking online with Secure-a-Spot between 16/08/17 and 31/08/17, will get a $50 off New Balance promotion code for use when shopping online with New Balance. Your promotion code will be sent via your registered Club Secure email address with 5 days of your booking.

Terms:

New Balance promotion code expires 31/12/17.
FREE shipping included.
For use with full priced products, excludes Digital Sports (Watches).

Offer available to both Australian customers only.

Looks like there is no min spend with the voucher

      you should ask New Balance where specifically it mentions those terms. Or ask them to just forward you the full terms and conditions as you don't remember seeing them.

      how does your email look like? my previous one from them had a paragraph "To order a replacement item, please contact customer care on 1800-580-363. We will place a new order for any item as a seperate transaction. We will honour any discounts applicable to this item.".
      
      I rang them and took a t-shirt. They honoured the AUD 50 discount and free delivery.

      i was referring to out-of-stock post. in my case the shoes i had chosen were out of stock, I rang them and taken t-shirt instead. As a good will gesture I got 50 aud discount and free delivery.

right now they are cancelling every single order of mine with vouchers - "Unfortunately, we are unable to process your recent order with New Balance. Your credit card has been declined.". My card is charged, bank says everything is fine at its end, NB just cancels it. They are a joke and cant handle the mess they created.

I think this behaviour is under 'Unconscionable conduct',
"terms that are so extremely unjust, or overwhelmingly one-sided in favor of the party who has the superior bargaining power, that they are contrary to good conscience"

Ordered the sandals and received the below email. They have changed the terms and conditions AGAIN

Seriously, if these people were a bank they'd claim that they could return 5 cents on the dollar due to T&C which were changed and never consented to. T&C are for small definition g matters. The offer was spelled out very clearly in the beginning. Full priced, non digital merchandise.

The amount of bad faith here is breath taking.

I received a response from ACCC, they recommended writing to them and sending to their postage address, if that isn't successful then contacting your state consumer protection if still no response.

Managed to find the original terms and conditions, Secure Parking will refer to the current T&C which has been updated to merge the general Secure Parking T&C and promotional T&C.

The promotional T&C was never attached to the New Balance T&C.

I had a relatively productive discussion with Secure Parking after I sent in a letter, still haven't come to a resolution yet.

Secure Parking are in a sticky situation, New Balance have changed their T&C with Secure Parking, and Secure Parking is trying to pass these changes onto us. Doesn't work that way.

Time for state consumer protection.

  @thydzik It is great you have actually someone that replays. In my case (and I think in most of the cases) they (Secure Parking) just ignored my complaint. They lie, they chang T&C, just to avoid saying “sorry, we made mistake”. Mistakes happen, but the way the company handles the situation is unacceptable and unprofessional. Secure Parking advertised it on their own webpage. Secure Parking sent me an email inviting me to be the part of campaign. I confess I made quite few bookings. Once at the beginning of the campaign I wanted to make few booking on the same date at the same location. It was rejected by the system allowing me to make maximum two (2) in one day at one location. And then two or three days before the end (or more as I have not checked it) they remove the limit and increased rates. I made several bookings just to find out two days later (the last day of campaign) the vouchers I was getting, were worthless - every week New Balance releases free codes (right now it is MFCSALE40 giving 40% off) giving you more discount than our 50 AUD vouchers (as full price shoes start from 120-130 AUD, only few adult ones are cheaper). They probably knew they would change the conditions and decided to recoup the cost somehow. Now they are blaming us - customers that we used their services, New Balance for changing the conditions etc. They accepted my unreasonable bookings, charging me the booking fees and now calling me abuser.
  
  As an update, Fair Trading called me and said that because campaign was advertised by OzBargain there were a lot of abuse and they changed the conditions, but according to some Secure Parking executive , they were able to do it as per T&C. As T&C are not available on the web, FT asked for it.
  
  Could anyone upload the old correct version of T&C? I am going to provide it to FT.

    Regardless if the original T&C was in place during the promo ( it wasn't), they can't put it up in bold print that you will get x if you buy y and not comply. Just like cruises booked by Australian travel agencies have to include gratuities, because they are expected and have been billed in the past onboard, these companies can not advertise in a bold manner that you will receive $50 in credit on NB website and then hide a get out clause far far away. Consumers are getting more and more protection, take warranties for an example. The stated warranty period no longer necessarily applies, regardless of what is in the written contract and T&C.

    As vote often has said below they didn't limit the number of vouchers you could redeem. Provide them with your voucher to show they even encourage you to share extra codes with friends.

Here is a template for local consumer protection: adjust as required;
Secure Parking address is Level 13, 100 Miller Street North Sydney 2060 NSW Australia, ABN/ACN 31669236037

On 10th August 2017, Secure Parking Pty Ltd (Secure Parking) ran a promotion were if a customer booked a car bay between
the dates 16/08/17 and 31/08/17, each customer will receive per booking a "$50 off New Balance promotion code for use when
shopping online with New Balance".
The Terms and Conditions of this promotion only stated the following points (note there is no mention of the terms being
subject to change):
"*New Balance promotion code expires 31/12/17.
*FREE shipping included.
*For use with full priced products, excludes Digital Sports (Watches).
*Offer only available online through www.newbalance.com.au"
After receiving the New Balance code, Secure Parking have changed the Terms and Conditions to include "Footwear only." I
have not agreed with this change to the T&C, yet they have proceeded to limit the voucher with this change. This heavily
restricts the usage of the voucher.
Secure Parking constantly mention that the 'offer is very good ie $50 off NB', but one of the original T&C stated on full priced
products only.
As an example, about 40% of items are on sale and excluded from the coupon (as was always the case), but due to the
recent addition of 'footwear only' this reduced the number from 60% to a little over 20% of items that the coupon can be used
on.
Secure Parking should not be allowed to change the T&Cs however they feel, especially as there was no T&C of the terms
being subject to change. This is extremely unfair to the consumer, who have no negotiating power with these large companies
to resolve this.
On speaking to Secure Parking, they keep on insisting that the T&C included promotions being subject to change and showing
their recently updated T&C on their new website. This was never the case at the time when I purchased the Secure-a-spot
booking. It was literally the 5 bullet points on the promotions page. I have plenty of screenshots showing terms and changes to
terms, etc.
I feel that changing T&C that two parties have already agreed on just because the other party doesn't have any power is
unconscionable conduct.
Assistance is appreciated, I am happy to provide any correspondence you may require.

Out of the blue email from Department of Mines, Industry Regulation and Safety (WA):

TLDR: Consumer Protection advised both Secure Parking and New Balance of your complaint and took the opportunity to remind Secure Parking, who you contracted with, of its obligations with respect to the ACL (Australian Consumer Law)

COMPLAINT AGAINST SECURE PARKING
The Department of Mines, Industry Regulation and Safety - Consumer Protection Division (Consumer Protection) is the statutory authority responsible for the administration and enforcement of the Fair Trading Act 2010 and the Australian Consumer Law (WA) (the ACL).

Complaint
I refer to your complaint concerning a promotional offer advertised by Secure Parking between 16 August 20017 and 31 August 2017. The promotion was open to Club Secure members and entitled the member to receive a $50 New Balance promotion code.
The offer was set out in an email from Secure Parking to members, which identified the following terms and conditions:
* “Available when booking parking between the 16/08/17 and 31/08/17.
* New Balance promo code is single use only, not for use with any offer.
* $50 promotion code applies to full priced products only, excludes Digital Sports (Watches).
* Offer only available online at www.newbalance.com.au.
* Promotion code valid until 31/12/17. Includes FREE SHIPPING.”
However, when attempting to redeem the discount using the code, you were advised the terms and conditions provided at the outset of the promotion had been altered and further limitations not originally disclosed were now applicable.

Relevant Legislation
The Australian Consumer Law (WA) (the ACL) prohibits businesses from making false or misleading statements concerning goods and services including misrepresentations relating to price and the existence of terms and conditions.
When consumers enter into an agreement, they rely upon the information provided at the time of entering into the contract. Failure to provide key information, or changing relevant conditions after the agreement has been entered into, could potentially mislead a consumer.
Furthermore, as a supplier, you are obliged to ensure that standard form consumer contracts comply with national unfair contract term laws. If a contract term is deemed unfair, the term is void and cannot be relied upon by the business.
These protect consumers against contract terms that:
* Would cause a significant imbalance in the parties’ rights and obligations under a contract;
* Are not reasonably necessary to protect the business; or
* Would cause detriment (financial or otherwise) to a consumer.

Conclusion
Consumer Protection advised both Secure Parking and New Balance of your complaint and took the opportunity to remind Secure Parking, who you contracted with, of its obligations with respect to the ACL, particularly when considering promotions of this nature in the future.
Consumer Protection also notified New Balance of the issues identified to ensure that they were aware of the ACL and its requirements that may impact upon them should similar promotions be considered in the future.
Please note that all complaints received by Consumer Protection are maintained and may be referred to should issues of this nature arise in the future.
