Just spoke to Telstra and because my order was sent back they tried to cancel the offer saying it was invite only and because I didn't yet receive they handset they were going to cancel it. He said the offer was leaked and given to others who weren't supposed to get it.

I basically told him that I was sent a welcome email with pricing and confirmation and that initially my order was shipped out but due to an address error was sent back (I actually believe they tried shipping them all back anyway), I said they would have to honour it and that I would take the matter further.

After placing me on hold and talking to his manager, they agreed to re-dispatch my order and honor it, but may take a few days as they are awaiting new handset stock to arrive over the weekend (Samsung galaxy s5).

He also mentioned initially the plan will reflect $70/m until they can update the system with the new $45 Go Mobile Plan

        • My story is pretty similar to this. They said they'll be sending it back out soon (unconfirmed when).

        • A scenario: Someone has an access key to a facility - a privilege bestowed upon them. They share that access key without authorisation.

The person who received the unauthorised key then uses that key to enter the facility. The unauthorised entrant is initially not identified as unauthorised and is able to partake of services provided by that facility.

When eventually identified the unauthorised entrant claims they should be allowed to partake of the services because they had a valid access key (as opposed to an authorised key). I am not sure how that defence would stand up in court.

        • +1

@hatsallround: a contract is a contract. The unauthorized user was added to the company's payroll and given induction. User is fired
For no reason other than the company's incompetence. User claims unfair dismissal.
That would definitely stand up in court.

        • -1

@imnotarobot: A contract isn't a contract if obtained via unauthorised means. That's like me stealing a contract for a house, signing it then returning it to the real estate while their unaware and expect them just to honour it, you lot have such one sided views.

          @andiw: welcome back!

        • @andiw:

Welcome back matey! We've missed you!

        • @imnotarobot:
I doubt it would stand up in court because the employment was obtained by deception.

        • +1

@hatsallround: not sure how else I can say it was a contract. Agreed to by both parties (I had a phone delivered so obviously passed all their checks).
Contracts are fairly binding. They don't have to like it, but they need to honour it.
I really don't know how else to explain it. Perhaps go and read the section on contracts on the consumer protection website.

        • -2

          @imnotarobot:
Since when are contracts obtained through deception legally binding?

        • +1

@hatsallround: who was deceived? I gave them everything they asked. I passed all their checks.
Like I said, go have a read of that website.

          @hatsallround:
          What deception?
A mate of a mate could have told him about this deal with no mention of invitations or otherwise. The offer page made no mention of invitaions. It does now but it didn't then. Also, there were facilities made available for people to port in.
Using your analogy above, Telstra left the door to the facility wide open. No sign above it saying no entry or entry by authorised personnel only. Anyone walking past could have walked in without the key or any knowledge that a key existed. They should have locked the door!! Very simple, really.
Telstra f'd up. They know it and they've admitted it.
The deal was offered, accepted by both parties and goods were sent. Done deal.

If you've missed out, bad luck. Get over it!

        • @MickeyG:
I got invited to a party but I missed out on a seat because of the gatecrashers. This forum appears to be dominated by opportunistic gate crashers who believe if they can get in then it is their right to be allowed to stay in. I don't understand that attitude, that they deserve a right they did not earn; it goes against all the teachings of good citizenship.

        • @hatsallround: I understand where you're coming from but it's Telstra, the people that organised the party, that allowed the gatecrashers in. There was no security at the door turning people away.
We are all here to get a deal. Heaps of times there were deals posted with known pricing errors. Did that stop people from trying? .. No.

        • +2

@hatsallround: Also, Galaxy S5 now available for purchase according to the deal site.
Go grab one and join the party. It's awesome.

        • @hatsallround:

Finders keepers - we found the link , we get to keep the deal.

          You sleep you lose.

        • @imnotarobot: Still no unique code or similar required.

        • @MickeyG: But there is the front banner stating 'invite only' now. So they're covered now in that regard.
They've put a latch on the gate, but it's still open.

        • @imnotarobot:
          Andrew is in the house!!
He better not F. it up this time.
          What happened to Emma?

        • @MickeyG: Andrews baaaack! Thank god. I like Andrew. Maybe they sent him to a work camp for a while? For 'rehabilitation' ?

        • ignore

        • @Ipiok:

I just noticed you changed your username from andiw haha

        • @Fck: I've gone into remission

        • @Ipiok:

Our "community" will support you! :-)

        • @Fck: Does time really heal all wounds?

    • I got the same SMS though I haven't received anything other than the original email. I've called once at night but they couldn't confirm. I'm on Boost $20 so I can't just keep calling 20 mins at a time!

I'd recommend calling during business hours as the Australian call centre is active and you can escalate issues to staffed managers.

Hoping this comes through for me.

    • Receive the same sms..I ordered last Friday before 6pm.
      Will see how this goes.

  • It seems they've come to their senses about honouring the contracts.
    Good work Telstra.

My parcel was delivered last week, all excited when I received it this morning.
But instead of a sim card n phone, I got an empty envelope to return my purchase.

Good work Telstra, sending me a return envelope before sending me the phone.

Should I put glitter in there n return to them?

    • Oh now that would be hilarious. I dare you.

    • i would hold off for now. on what basis do they want you to return the phone ?

      • I didnt even get the phone!
Only thing I got was the return envelope

P/S above post should say dispatched instead of delivered last week

  • Hi Guys I know this is my first post but I have been reading this with great interest.
I received the email last Thursday and placed ny order for the Galaxy S5 and am yet to receive it.

What I would like to ask is has anyone who received the email and placed their order received it yet?
And also if Telstra sends through the order confirmation isn't that sort of like a contract?

I may be wrong but hey it don't hurt to ask. Thanks

    • Their offer without exclusions, your acceptance via agreeing to their terms, which coincides with your promise to fulfil that agreement for a fixed term equals a valid contract in my mind.

  • I'm on the line with 2 consultants at the same time and they're both trying to get my account changed to the $45 casual plan. Initially, the consultant told me she can't put me on a casual plan and give me a free handset and said i had to pay an extra $35 monthly handset repayment fee. I refused this and said i'm not going to pay any more than what I've signed up for. She then eventually got the second consultant on the line to speak to me at the same time and after I explained the situation to the second consultant, she found this offer in their system and told the first consultant that it's a valid campaign and that I'm entitled the the contract i signed up for. I've been on the line for an hour with them already. Hopefully this gets sorted soon before I run out of credit.

    • Well, It's now 1 1/2 hours later and they still can't resolve this because they can't get in touch with the department they need to speak to so they've recharged my prepaid service and promised that this will be resolved tomorrow. We'll see…

Just out of interest did anyone who tried porting from non-telstra carrier have any luck with this deal?

I.managed to sign up but have heard nothing since? Apart from the Sms today that a few others have received.

  • I got my phone ported from TPG from a post paid plan with documentation it's on he $45 casual plan and have a no problems with phone it's all working great. Do not understand why others are having dramas.

    • Cheers, yet to receive phone, will believe it when I see the thing!!

  • I signed up on Friday around 5pm..I am with Live Connected currently. I received the phone on Tuesday but havent opened it or activated the sim. But I received the sms this morning that everyone else is receiving.

I know this offer was not meant for me. I am worried that if i try to activate the sim, they will put me on $70 plan and I won't be able to fight them other than just returning the phone.

What do you guys suggest? Shud I wait till Telstra sorts it shit out or go ahead and activate the sim and hope for the best? I dont want to be stuck on the phone fighting them.

    • If i were you, I'd wait. I'm struggling and I'm one of their customers. :/

    • just activate and use it, you signed the contract NOT stated INVITATION ONLY, whatever it was, a term of contract signed at that moment cannot be changed without your agreement

Galaxy S5 apparently back in stock as buy now button is active again
    https://www.telstra.com.au/latest-offers/pre-paid_offer?

Edit: I just placed an order, so we shall see what happens. They still show the option to port from another provider. You'd think they'd fix that if they were trying to limit it to existing Telstra pre-paid customers (as I am).

    • Noticed it too - I've decided against the plan. Simple reason is that, I was going to sell the phone to reduce the cost of the plan to basically $24/month.

However, I will need to change to a new plan 24 months from now if I sign up, as I will continue to be slugged with 45/month on the plan thereafter. I'll have to join Vaya or something.

I might as well join Vaya now and instead of having to spend the effort selling the htc/galaxys5, and then finding another plan after 2 years…

      • Sell the phone for $500, take the plan over 48 months and it's less than $35/month. Still pretty good.

      • Vaya rates are very competitive especially now they have changed to KB billing and have $10/GB auto data add-on.

Having left Vaya a few months ago, I am in no hurry to return until I am sure they have cleaned up their billing system.

If you've not yet done so, you should check the Whirlpool thread so you know what you are getting into to.

        • which is why i'm hesistant to switch over to Vaya yet.

I'm currently on a TPG $19.99 plan with 1gb, which replaced the grandfathered $15 1.5gb plan.

i'm kinda holding out until some good deal pops up.

Bear in mind, this telstra deal is mighty amazing, and realistically, I'd probably be changing to a new provider after 2 or 4 years later.

However, after 2 years, and selling the phone (-$500), it'll be ~$35/month, which is too much in my mind. Given I'm paying $20.

I'm looking for something around $20-25, which offers 1.5gb - and I know that's hard to find a good provider offering that. And yes it's being tight, that's why I'm an ozbargainer.

        • @chillipaste: Don't understand where you get the $35/mth from?

I plan to sell the phone immediately and expect I will get $400 after eBay fees have been taken out - perhaps that is conservative. So, cost to me should be:
          45 x 24 - 400 = 680, which is about $28/mth.

That works out a little more than the Vaya $24 plan, but does include unlimited calls which I would not need. But I think the Telstra network is worth the extra few dollars.

In two years time, I will shift to another plan whatever is best at the time.

        • @spockter:

was a bit unclear - what I actually meant was, if I held it for three years (48 months) - selling the phone for $500, equates to just less than $35/month as imnotarobot said above.

    • I'd imagine the 'invite only for existing telstra prepaid customers' banner on the face page is their get-out-of-jail-free-card. Pity (for them) it wasn't there last week.

The deal is on again for Samsung galaxy S5. I just got mine ordered. Cheers

    • Thanks, I just ordered been waiting all week.

  • I'm curious according to https://www.telstra.com.au/help/download/document/personal-c… it states Minimum term

    Month-to-month.
You can cancel your Plan at any time but if you cancel you will
also need to pay any charges up to the point of cancellation.

It mentions nothing regarding a 24 month contract or minimum cost…?

p.s I've recovered from my mental break down.

    • It's covered in the critical info summary.
      http://www.telstra.com.au/content/dam/tcom/personal/help/pdf…

Offer page also mentions 24mths as does the order confirmation.

    • It mentions nothing regarding a 24 month contract or minimum cost…?

Yeah, that casual plan is a standalone plan that doesn't include a handset. When you sign up on this offer, the handset is included and the minimum cost is $1080 when you stay connected for 24 months.

p.s I've recovered from my mental break down.

Nice to hear. Welcome back. New name??

  • So does this mean they will honor the orders that were made by the targeted folk?
We shall have to wait and see. I still have not heard anything regarding my order.

    • you haven't heard anything as in you didn't get an email order confirmation? or you got the order confirmation but didn't get anything else?

  • Just ordered an S5, existing prepaid customer, thanks for the deal!

  • I received the offer email placed my order got an order confirmation and nothing but excuses since then.

  • A family member ordered online this morning. Email confirmation received.

  • +1

So the S5 is back up and available!

Andrew must be back from annual leave

  • ugh.. now it's back I'm not sure I want it anymore :) Will 2gb be enough in 2 years time…?

    • For me it's plenty. I'm a heavy podcast user.. I pre-load all the videos and talk shows and my entertainment is set using wifi.

For general browsing even music streaming it should be good unless your doing it all day

      • -1

        thx…

  • Hi could anyone please confirm that the S5 that comes with this plan is unlocked?

    • Yes unlocked, I have used with a Vaya/Optus sim

      • Mine wasn't. I couldn't use it with my optus sim.

  • Can people let us know when Telstra sort their stuff out. I have the phone and sim but once I activate I would to like to see my plan as $45 in the Telstra app not anything else. Saves calling and going through all the drama with the Reps that don't have much of an idea.

    • You should have received an email with the plan cost and handset cost. Mine said $45/month and $0 for the handset.

      • Yeah, but the problem is Telstra is having issues putting people on a casual plan with a free handset. If you speak to a consultant, they'll tell you that you can't get a free handset on a casual plan and then go on tell you that you've got to pay a $25/month handset repayment fee. The regular overseas consultants don't seem to know about this deal. When i got into a group chat yesterday with a regular consultant and an Aussie one, the Aussie one explained to the other one that this is a valid campaign they're running and where to find it in their system. I was listening to their whole conversation. In the end, they couldn't convert me from Encore to this plan because they couldn't contact the relevant department so i'm waiting for a callback today.

I'll let you know what happens Dealgood99.

        • Thanks MickeyG. Yeah the paperwork can say whatever (mine said $45 / $0 handset) but it's the system that really matters especially when it's not a standard deal

        • Okay.. I just got off the phone with them and first the guy congratulated me for being approved for this offer ( I never received an invitation) then went on to tell me that they are still in the process of updating their system to remove the handset repayment for this promo. He said there is no timeframe he could give and advised me that i'll receive an SMS or email confirming that i've been changed over to the new plan and to continue using the prepaid service. So basically, he said wait.

        • Let us know if you get that email/SMS.

  • I just got my first bill…$72 plus some church money. Not the upfront $45 plus 2 days for last period…someone commented up above that this was expected as Telstra is trying to sort out their billing system…!!!…or Not!

  • Got my bill $70 :S

Waiting for the PDF to be generated so I can hit them up to remove the handset repayment.

Sigh in a way Telstra created quite a debacle

  • looks like lot of people who have received the handsets can get them for FREE unless Telstra can honor what they agreed on contract?

  • Anyone know IF I was to successfully sign up to this with a newly acquired Telstra pre paid SIM, could I change to my regular number (currently with another provider) after it had been activated?

    Thanks

    • Or you could just port your regular number to the new Telstra prepaid sim when you activate it?
And then convert to the $45 plan.

      • Wouldn't that mean applying with a different number (temp pre paid number)?

  • Htc One M8 now available again

  • yo,
did anyone get hit up for $150 or $300 up front fee(given back after 3- 6months).
I have been on the phone with the customer service for Telstra and they are saying its "due to credit rating"
and all customers with non plan/ contracts have to do this.

    is this true?
they did my head in for almost 3 hours.

they already got my credit card details Wtf?
Correction its debit card straight from my bank acct.

I recieved confirmation order email this morning as well.

    they dosed me.

  • I'm starting to wonder if these phones are refurbished? Can anyone comment who has received one of the handsets..

  • after few days of complaining to their Level 3 (highest escalated level), they finally honoured my service with $45 casual plan as I signed for, checked by logging in my Telstra account too and it states 2GB of data, unlimited call and txt, number changed from Prepaid to Postpaid. Keep on complaining them guys and hopefully you will have it activated too

    • Just prepare yourself because your first bill might be $70 like others have received if they haven't fixed their computer system to take off the handset repayments.

      • if that is the case i will keep the phone and ask them to up themselves :)

    • Glad it worked for you, I'm going to wait until Monday. Then I'm going to call them. Were you porting from someone or with telstra?

      • porting from a prepaid Telstra number

        • have you received your first bill? I am a prepaid to post Telstra client. My first bill included $25 device repayment…what a pain…have to spend more time on this…

        • @jjjjjj: haven't received any bill yet but if it happens to me like your case, I will ask them to not just give me the phone for free but also compensate to my time and effort

        • @webtherapist: you better get a bill before the promotion expired! it took me 30mins to prove that my plan covers the device. the online chat said the promotion page didn't say that the device is free. I asked him to apply one himself. then the summary page proved my words. There is no records that linked to my order reference number and my account number indicated that the device is free of charge.
Good luck. They may fix the system by the time they issue you a bill. I am sure they will receive a lot of bill inquiries!

        • +1

          @jjjjjj:

Didn't the order confirmation state upfront = 0 and monthly = 0 for the device section. And only the plan section shows $45 pm

I ordered yesterday night and got the order on its way and i should get the phone on mon.

        • @jjjjjj: your initial order confirmation email also has zero handset cost…that's what i copied into my chat about half hour ago…they need to see my bill which hasn't pdf'd yet to confirm handset charge…then they'll ring me back on Monday…

Oops, you bet me to it bluebird

        • @thehulk1969: yes I have them the copy but it can't prove anything from their end. it just some words you put into the chat. Your bill says you should pay for the handset. It isn't helping. The rep I dealt with finally agreed that the plan includes a handset was by getting through the applying process himself.

        • @bluebird77: the problem is that you can't provide the original version of the order to a chat rep. the order reference number associated record didn't say that the handset is free!

    • did you have to pay an upfront fee?

  • Has anyone placed an order since last night? i placed my order and received the confirmation email but have not heard anything else. Just wondering how long it takes to get the 'on its way' email.

  • I just called after on hold for some time and the rep said the deal would be honoured for original email applicants but that it would be processed within 5-7 business days. I asked if that was from the date of purchase and he didn't know.

If you're coming to this deal new, I would recommend porting to Telstra prepaid first before applying.
