Fined by a 'speed' Camera for Running a Red Light

Received a fine in the mail today for running a red arrow at an intersection.

The street signs at these lights indicate it's a 'speed' camera, not a red light camera or a red light speed camera. Do I have a case as the sign is misleading?

Are all cameras able to do both red light and speed, regardless of what the signage says?

    Give us the street view on Google maps, my bet is that it says Safety Camera or something.

    Anyway, I'm glad you got fined! Running red lights is super dangerous.

          Unfortunately, probably yes.

          Same reason why people complain about notice/signs on speed cameras. They want to have notice so they can slow down, go past the camera, and speed back up again.

          Too many people are more than happy to break traffic laws if they think they're not going to get caught, and even if they do the punishment isn't impactful. Maybe we should introduce a small amount of jail time (on top of the fine) - may make drives rethink offending…

          • @Chandler: I think we should be fining people based on their income to make it more impactful. To some people blatantly traveling 15 - 20km over the limit everywhere they go is "worth it" to them because they know they will either rarely get caught, and if they do, the fine is insignificant. I wander how many bogans earning good money would change their driving behaviour if they get fined based on how much they earn.

        They don't always do both. You stuffed up but just be glad it's a fine.

        There was a really nasty crash last week where someone ran a red light and collided with a motorcyclist.

          You say “run a red” like driving through an intersection Iike it isn’t there. No one’s suggesting that’s a good idea, but what about after stopping? Decades ago we introduced “Left turn on red after stopping”. Why only left turn?

        Heard that reasoning before but they dont see the pedestrian in their quick glance that were behind a power pole.

        My mate after 2 years and 5 surgeries is finally able to walk a few steps at a time hit by a driver who didnt obey the red arrow.

        Only 35 with a young family he will never be able to kick the footy etc with his kids. Just because a driver couldnt wait a few seconds.

      • Don't know how it is in NSW, but in WA red arrows in those situations become unlit after the pedestrian crossing timer is finished (where applicable).
        Unlit turns are treated as give ways.

          It reads like one of those obviously wrong answers in the driving test.

          You are approaching a red light, you are going the speed limit and you see a sign that says speed camera ahead.

          Do you:
          * Post on OzBargain
          * Slow down and stop at the red light
          * Keep going your speed and go through the red light because it's a speed camera not a red light camera.

    • I’m not supporting his behaviour but considering that the mobile units were recently forced to put signage there, he may be able to contest it. Honestly though, is it worth getting a lawyer for it though?

    You should totally get a lawyer and fight this all the way. Don't spare any expense, get the best lawyer you can afford. Don't listen to anyone who says otherwise. Speeding is a totally different thing to running a red light.

    OP next minute: I hit and ran and got charged for it. Can I appeal as there was no sign saying I couldn’t hit and run?

      If you didn’t exceed the speed limit while running, you certainly can appeal it because you can argue you weren’t technically running but just jogging, therefore legally it wasn’t a hit and run.

  • OP deserves to be fined as no mention of it being dangerous to stop, but instead speed camera should not have got me running a red light camera on purpose to cause an accident if I was too slowwwww.

    If they have photographic evidence, I don't see why they wouldn't issue a fine.

  • Red light cameras were initially just red light cameras. It was well publicised that they were upgraded to also be speed cameras.

    Fixed speed cameras initially used two sensors, and speed was calculated on a distance/time basis. I understand that the upgrade of red light cameras to also measure speed was done in software. A signal processor looks at the shape of the signal coming from the sensor and mathematically derives a speed from it.

    Definitely have a case for misleading. Pursue it all the way to the high court. Let us know how you go as I want to pursue Smith’s snack foods for misleading me on burger rings.

    Leaning into the ridiculousness of this discussion:

    Well you were speeding, because at a red light your speed should be Zero. So by running a red light, you exceeded the extremely-localised direction-based speed limit. Next time, reverse through the red light, so that your speed is technically a negative number.

    Then if they challenge you on it, you can send the council a speeding ticket because the entire locality was - in a relative sense - speeding compared to you.

    End of the day you broke a pretty serious road law that other people have done and killed people in the past

    Instead of trying to get out on a gotcha technicality which doesn't exist, pay the fine, learn from it and don't do it again

        not sure but govt introduced those changes, it cost nothing to try. I guess it depends if OP got busted for speeding or running the red light. minor speeding you can get off for sure.

        • There are certain infringements that are flat-out denied no matter how good your driving record is. I know failing to Stop at a crossing fine is one of them and so is a Red light fine.

    yes, you can appeal it because when you entered the intersection and saw the red light camera marked as a red light camera then that was the same as entering into a contract of use with NSW roads for using that intersection.

    by entering that unwritten contract (by accepting/consenting the conditions printed on the "red light camera" sign) then NSW roads have broken the terms of that contract.

    in fact you could stab someone in front of that red light camera and can not be charged as it is just a "red light camera" and not a "red light and no stabbing camera".

    I feel that a sarcam tag is now required /s

    They don't put 'speed' cameras at intersections. They are either 'red light' cameras or 'safety' cameras.
    Safety cameras monitor both red light runners and speeders throught he (usually) amber light.
    Speed cameras are mostly at random places between lights/intersections.
    You went through a saftety camera and got nabbed, pay the fine and learn the lesson.
