Fined by a 'speed' Camera for Running a Red Light

Received a fine in the mail today for running a red arrow at an intersection.

The street signs at these lights indicate it's a 'speed' camera, not a red light camera or a red light speed camera. Do I have a case as the sign is misleading?

Are all cameras able to do both red light and speed, regardless of what the signage says?

  • Most Gatsometer Cameras, if not all, are red light and speed camera. You really need to look at the Camera physically to see if it is just red light or both red light and speed camera.

    You can only be charged by the murder police for murder. No worries.

    • Technically that is normally how it works. Its a bit morbid to send the Coroner over to a burglary if everyone is alive.

      It should be noted that it would be similar to left turn on red here, but we usually have slip lanes, which are better anyway…. and thank goodness no 4 way stop signs

  • That's totally inappropriate. It's lewd, lascivious, salacious, outrageous. I am shocked and chagrined, mortified and stupefied. This fine is outrageous!

    Fixed speed cameras have signage in a lot of jurisdictions. It helps with the argument that it's about safety and not revenue raising when you're warned and given the opportunity to slow down. There's no such requirement for red light cameras though. Presumably that's because the crimson glow that usually emanates from several prominent signals is already a fairly obvious indication as to what the correct course of action is. My admittedly naive understanding is that the requirement to stop in that scenario may even apply when there isn't a camera (I'm as shocked as you are). So it may be hard to argue that you were misled as to the course of action required in the circumstances.

    Now if it had said "Speed camera only. Stopping on red optional" you could definitely argue you were misled. ACA would be all over that and you'd probably get the fine withdrawn, an apology and a Christmas hamper. Two hampers if you're a true blue Aussie battler.

  • I recently received (Vic) a large fine for allegedly entering a red light intersection 0.50 seconds after it turned red! Yes, zero point five seconds. Half of one second!

    I looked up on Google, that seeing a red light, they processing that in one's thoughts, making a decision to stop, and then lifting one's foot from tha accellerator pedal, and then applying a brake - all takes between 1.75 seconds and 3.00 seconds.

    So, how can they legitimately charge me with an offense or entering the intersection after only 00.50 of one second?

    I appealed the "infringement", and requested a warning / leaniency, and got nowhere.

      You're actually meant to stop at a yellow if it is safe to do so (so if it's just gone yellow then maybe you wouldn't to avoid being rear ended).

      What you've done is floored it through a late yellow/early red rather than slow down to a stop.

      • Back in 1966 when I started driving, yellow lights had the status of "proceed with caution".

          A yellow (amber) light means you must stop. You can only go through a yellow light if you cannot stop safely before the ‘Stop’ line.
          You should not stop suddenly, and you should not speed up to get through a yellow light.

          As Lockieasy as said, you would have floored through the yellow light to try to beat it. Even with the alleged rule of "proceed with caution", you did not proceed with caution if you tried to beat the red light

        • Proceed with caution is now more applicable to green lights because of all the red light runners

    It's not misleading as the speed at a red light is 0, any speed in excess of this is also classed as speeding. I learnt this during the academy.

    Sigh, If you run a red light it means you didn't obey the yellow light. Running a yellow light is actually an offence too.
    Don't ignore the yellow if there's a cop behind you!

    Increasing numbers of motorists are being caught running yellow lights at intersections across South Australia, latest police figures show.

    Last year police pulled over 535 drivers for failing to stop when approaching a yellow light, resulting in 363 cautions and 172 fines.

    This was more than double the number of yellow light offences recorded in 2012, when 161 cautions and 105 fines were issued.

    As a result, the total value of fines for running yellow lights has also increased, from $48,070 in 2012 to $87,658 last year, police records revealed.

    RAA spokesman Graeme O’Dea said many motorists weren’t aware that the Australian Road Rules require them to stop when approaching a yellow traffic light, if it is safe to do so.

    Yellow light offences are only detected by police and not fixed safety cameras.

  • Gosh I just shot someone and there was no sign saying I didn't have to murder them.. HOPEFULLY I HAVE A CASE.

    Best solution for your mind and stress levels, don't get stuck on how can I get out of it, just pay it and move on with your life.

  • My understanding is that in NSW, you can only plead not guilty if either there was a malfunction with the measuring equipment, or that it was another car that was picked up and not you. That means OP will need to plead guilty, with an explanation asking for leniency. In this case, not knowing that there was a camera is no excuse

  • It detected you were speeding. A red light means that your speed should be zero. Your speed wasn't zero. Ergo, you were speeding.

    Are you arguing that because you thought the intersection was not monitored for red light then the lights dont apply?
