    So if you don't return the phone are you only charged the trade-on value or the bonus ($500) as well? Might be worthwhile holding on to my perfect condition S8 as a backup phone rather than getting $70 for it…

      Not sure if anyone has been charged here yet for non return. But there is hope that the charge will be limited to trade in value based on some of the good folks here who contacted samsung for clarifications.

    Had a chat with Samsung rep and got it confirmed we will not be charged for the $500 trade in bonus if the device is not returned.

    I also got a ticket ID for reference and sent an email to [email protected] requesting for the chat transcript which was emailed the next day.

      If this exercise has taught me anything, it's not to trust their very loose support chat centre… The number of personal conversations & chatlogs I referenced with where they just tell me the info is wrong or ignore It altogether lol. Best of luck anyway

        I don't think it's legally binding. I wouldn't trust the support chat either.

          Samsung/Asurion didn't also create any legally binding contract to enable them charge promotional bonus (which is different to trade in discount).

          • @SV22: I'm no lawyer, but in the unlikely event this went to court, I think you would find it very difficult to argue that you didn't commit to sending your old device in. You very clearly have to agree to it in the purchase process.

What I've agreed in the purchase process is either to send my phone and if not, pay the trade up value provided for my phone, and I have only allowed my card to be charged for the trade up value. In case the matter goes to court, I think there are enough written confirmations from Samsung/Asurion which confirmed they won't charge back. If there is a smart lawyer, Samsung might have to also pay compensation for all this confusion caused and employing Asurion for managing this process who are pathetic.

                Device Non-Return Fee means a fee which is equal to the amount of the discount You received when
                Your unique Trade ID was applied at the point of sale when You purchased Your New Samsung Device
                Online in accordance with clause 5.2 of these Terms and Conditions.

                Not suggesting that it's conclusive one way or another, or offering an opinion on what I think will or should happen should one not return their trade up device. But when the trade up code was entered, the immediate discount applied included the $500 bonus. So from the T&C's "the discount You received when Your unique Trade ID was applied at the point of sale" could easily be interpreted as being inclusive of the $500 bonus.

                • @tbone74: I've now been 20 days since sending in a phone which 'failed' the Asurion inspection. I was only charged the $15 trade in fee and no further fees or communication from them (or Samsung). Based on the comments above, doubt anything else will happen and it doesn't appear either company would have the competence to organise such a charge back even if they wanted to.

                    @dcs29: I emailed Ausrion as I was concerned that the scratch on the screen that I only noticed once I did the tradeup, would make my phone ineligible for the $75 tradeup and wanted to know if I would get the phone back if it turned out to be worthless. They said if I didnt sent it back I would only be charged the $75 tradeup fee and all other promotions would remain

                  • @dcs29: According to the T&C's, the In-eligible Device Fee is exactly the same as Device Non-Return Fee. If yours failed the inspection, it would be considered an In-eligible Device because of point b "is not a Good Working Order Device or an Acceptable Damaged Device". So if they're not charging the $500 for an In-eligible Device Fee, one would assume the same would apply to the Device Non-Return Fee.

                    I agree (even before reading your comment) that the most likely outcome of not returning the trade up device would be the $500 doesn't get charged.

                    Was just making the point that it's hard to claim definitively that people didn't agree to return the trade in device or otherwise be charged the $500 bonus, when the T&C's could be interpreted to indicate that's what will happen.

                    • @tbone74: I agree it is not 'black and white' and that is the reason they can't charge. Just to let you know Clause 5.2 you referred above states as follows:

                      "Once the Samsung Trade-Up App confirms that Your Existing Device Qualifies for the Program,
                      You will be:
                      (a) advised of the discount that You will receive off the Purchase Price of a New Samsung
                      Device if You purchase Your New Samsung Device Online and trade-in Your Existing
                      Device to Us; and
                      (b) provided with a unique Trade ID that You can use to apply that discount at the point of
                      sale when purchasing Your New Samsung Device Online from Samsung."

                      It only refers the discount advised in the trade-up app. There is no mention of promotion/trade-in bonus. Invoice refers to trade in discount plus trade in bonus, hence there is a clear argument that trade in bonus is not covered by the trade up agreement.

                        @SV22: I really think you, and many others, are interpreting this for your benefit. Any reasonable person would believe that you are only entitled to the trade in bonus if you actually trade something in. The T&Cs quite clearly state that it's the amount of discount you receive at the checkout when you enter that trade ID that you are liable for. And that amount is quite clearly your trade in value +$500. People keep referring to clause 5.2. It doesn't mention the bonus, because it has nothing to do with the bonus. I can't see any confirmation in 5.2 that the $500 shouldn't/won't be charged.

                        Will Samsung/Asurion charge the $500 back? I have no idea. But there's no doubt in my mind that they could, and I highly doubt a court would rule against them in that situation. Obviously it's unlikely to ever get that far, though.

                        People seem to be trawling through the T&Cs looking for ways to screw a few more dollars from this deal and looking for clauses to justify that, and I'm not sure why, because the deal was already amazing in it's original form.

                        FWIW I don't think any sort of confirmation from any of the live chats, either way, means anything at all.

                        • @wombat81: The discount in question is by the T&Cs "in accordance with Section 5.2". And, as you state Section 5.2 does not mention the $500 bonus AND it does explicitly exclude the bonus by defining the discount as that received when you ran the Tradeup App.

                          The $500 bonus is clearly NOT in accordance with Section 5.2.

                          The promotion according to the official T&Cs is the Samsung TradeUp promotion not the Samsung TradeIn promotion. It is possible to trade up by trading in. It is not necessary to trade in to trade up.

                            @rifter: Yep. It's in ACCORDANCE with 5.2. The bonus is defined separately. It still quite clearly states that you are liable for the amount of discount you received when you entered the trade id at the checkout, and we're all well aware of the discount that was applied when we entered that ID.

                                @U30004: No, the point being made is that the $500 bonus discount is applied when the Trade ID is entered. That single code being applied at the point of sale provided a discount of the trade in value plus $500. The additional vouchers required separate additional steps to apply those discounts.

                                    @U30004: And then when you applied it, you got the extra discount too. But it's all irrelevant. At the end of the day, no one who participated in the purchase can tell me that they should be entitled to that discount if they don't trade in a device.

One could argue "the discount you received" includes the following page, because you don't actually receive a discount until you're paying for it. It's honestly too ambiguous to try to prove conclusively.

                                    I agree with previous comment that the intention is that it should include the $500, because it's a trade in bonus so how can it logically apply if there was no trade in? However if it was going to court, the intention probably isn't always as relevant as the actual wording and the ambiguity in the T&C's could likely be used as a loophole.

                          • @rifter: Trade up is just another term for trade in. How do you trade up without trading in?? You have to trade the device whether it's up or in. Same thing, just trade up is like marketing speak for trade what you have for something better.

                            • @reactor-au: If I sell my S7 on ebay and purchase new S21 from Samsung I have traded up. If I sell my S7 to Asurion and purchase from Samsung I have traded up (as per Samsung T&Cs). If I go to a Samsung kiosk to purchase a new S21 I am given the opportunity to trade in my S7 there.

                              In a 3 party trade I have separate contracts with two separate parties. The contract between Samsung and Asurion is for them to sort out and be responsible for not me.

                          @wombat81: People are NOT seeming to be trawling through the T&Cs looking for ways to screw a few more dollars. People are complying with the Ts&Cs they signed up as they interpret it. Everyone has a right to interpret them as they understand, it is up to courts to decide whose interpretation is correct. No one in this forum has a right to judge others and determine what is the 'right thing to do'. People have a choice to determine what is 'right thing' for them based on their individual circumstances, experiences and of course, it has to be well within applicables laws, contracts etc. So long as people do this, there is no right for others to judge what is the right thing!

                          You also need to understand there are some practical challenges for people who actually want to return the phone (I fall into this category). Here are some scenarios:

                          1. Samsung trade up app is useless and it only works for certain phones. If you are having a A21s phone which is eligible for trade up program, trade up fails the phone asking for a light sensor test where as the phone itself has no light sensor. Asurion won't help people impacted by this. How stupid this is and why to run promotion claiming A21s is eligible for trade in though people can't practically trade in. There are some Apple devices like it too.

                          2. There could be instances where people may lose phones after trade in or phones could be damaged after completing trade in.

                          3. Completely ridiculous standards applied by Asurion in assessing phones which are 4 to 5 years old. Do they expect phones to be in new condition after 4 to 5 years of use?

                          4. No response from Asurion for any questions raised, the worst part is standard response for any question you ask.

                          So I would request all people lecturing about 'right thing' to please stop. I've decided not to return my phone and I am very sure I will not be charged except trade in value of the phone. And Samsung/Asurion have no right to charge me (even if they want to) based on contract I signed

                            @SV22: I'm not judging anyone. I couldn't care less what you do or don't do.

                            All of your scenarios are irrelevant. Of course Asurion can make up their own trade in standards and rules for their own trade in program. Of course they can expect perfect condition devices. If that makes your device ineligible, that's unfortunate for you, but you certainly shouldn't be entitled to a trade in bonus if you don't actually have a device to trade in or are prepared to trade in. At the end of the day, if you don't like their trade in process/rules/standards then don't participate. But don't try to screw the system to get a discount you aren't entitled to and then use it as an excuse. If you don't agree with the program, don't participate in the program.

                            I'm not sure why you're so worried about people giving their opinions of what the right thing to do is. If you're confident you've done the right thing, why does it bother you?

                              @wombat81: Of course scenarios are not relevant to you because you are not facing them. And of course, I am entitled to participate in the program and entitled not to return the device, and just pay the trade in value of the phone. That is how the program is designed by Samsung/Asurion. Noone in this forum is designing Samsung's marketing strategy or aware of profits Samsung makes even after promotional bonus.

                              I am very confident I've done the right thing and just supporting other members here who may feel belittled by some of the comments around 'right thing'.

                                @SV22: The issue is that you're carrying on like it's 100% definite that you won't be charged the $500. You don't know that. You think you've got backup in the T&Cs, chat scripts etc, but there's absolutely no guarantee of that. I think it's pretty irresponsible to encourage other ozbargainers to do the same thing when you realistically have absolutely no idea as to whether you'll be charged or not.

                                If you're prepared to take the risk, go your hardest, but don't carry on like you're a lawyer and you know exactly what will happen.

                                  @wombat81: One more time you are not clear on what I said above. What I said above is everyone has a right to decide what is best for them based on the information they have. And my decision based on the information I have and the way I interpreted the ts&cs is not to return the phone. Other people have right to reach to that conclusion if they think that is correct for them. It is equally irresponsible to dismiss samsung's chat scripts and emails from Asurion are worthless, and influence their judgements.

Again, as I stated above what I signed up in trade up agreement is either to send my phone and if I don't send it, paying the value of phone assigned in trade up app. As such sending in device is not only the default action and paying the value of phone (if you are not sending) is also another default one. If Samsung wants only sending in phone is the default, they need to work on their wording in trade up agreement, and more importantly they need to educate their CSR and Asurion about that change.

                                      @wombat81: I am not sure if I can agree with you on this, while I completely in support of sending the device but 2 of my friends sent their perfectly conditioned phones (S10 and S9 PLUS) and they still got the trade in amount charged. Now they are not even getting their phones back. Their old phones only and only had normal wear and tear from day to day use, how do you justify Asurion turning away good phones and in some cases I heard that some phones with scratches were still accepted by Asurion.

                                      If Asurion's management is not capable of handling this then let this be a lesson for them and for Samsung too and let them make a better system to deal with this. We all can tolerate a thing or two but there are nothing but countless mistakes from Asurion, beside they clearly mentioned that if you don't send your device then you will charged, why would they even say that if their terms and conditions are rock solid?

                                      Last but not the least, rejecting perfectly conditioned phones and not even sending them back is absolutely wrong. I bet we all can keep S10 or S9 or even S8 as a spare if something goes wrong with our current phone as Samsung hardly offers a same replacement while they honor the warranty rather I am the witness they offer S3 or S4 which half the time gets issues. I used S3 for 3 weeks and it was horrible.

If they had wear and tear, they're not in perfect condition. From memory, the trade up app was pretty clear when asking about the condition of the device. It explicitly asked if there were scratches or damage to the device. So if those people weren't honest about the condition, it's no surprise that they were charged. The good thing for them, though, is that they had an eligible device with which to obtain the trade in bonus.

I think you've hit the crux of the issue here. Lots of people seem to believe that their device should be eligible. But to actually be eligible, lots of criteria need to be met. So only a small percentage of devices are actually eligible. Just because I own an S10 doesn't mean that I'm automatically entitled to the trade in. It also needs to be in absolutely perfect condition. If people were 100% honest about the condition of their device, they would have been well aware that it was or wasn't eligible before they completed the deal. I really believe lots of people told porky pies in the trade up just to get the $500 bonus, which they probably weren't actually entitled to.

                                        If they are rejecting perfect devices, that is obviously a concern, and if it was me I'd be arguing the point with them vigorously. But I suspect that isn't the case, more so that people's devices aren't in the condition they say they are.

                                          Sorry I should have been clearer, they used screen protectors and cases all the time but still any phone ~3 years old looked after nicely still can have very normal almost non recognisable to naked eye scratches, such as refurbished ones if you will. But still got rejected by Asurion. So here aren't Asurion deceiving people? Because they have been charged and now they don't even get back their almost new conditioned phones? They sent their phones that passed the test and have no "visible" scratches on screen or body. That's what written in their app. So Asurion should honor what they mentioned in their app and should not charge anything.

                                          But, theoretically, if they sent your device back you'd no longer have an eligible trade in device and you wouldn't be entitled to the trade in bonus.nd T&Cs.

                                          Wow, with no visible scratches we all send our phones to get nothing in return? Then why bother running such a campaign as almost all the phones are ineligible no matter what. Simple ask to submit the your old phone with no trade in value, why to confuse people ?

        Visit either the George Street Sydney City or Highpoint Maribyrnong Melbourne Samsung stores and receive a credit for your eligible old device which can be used to purchase your new eligible Samsung device.

        • Online store and Samsung stores are separate business. If you used trade up ID ordering from Online store than must send phone back by return label to them or use trade up ID at Samsung store and hand over the old phone to them.

  • Last Wednesday got email updated from Samsung said my Navy S21 ultra is customizing.
    Haven’t receive any email update since.
    Just check my Samsung account. It is now change to Preparing Dispatch.
    Ordered on 29/3.

      My S21 Ultra navy 128GB ordered on 28/03/21, received on 19/04.
      When I called Samsung last Thursday (the status was "preparing for dispatch") they confirmed that it is coming on Monday 19/04.

    I emailed Asurion that I am not going to send the device as my kids threw it in the river :). I just followed this up by asking innocently how can I pay you the trade value back.
    I got this response back -

    Thanks for your query. If you wish to not return your old device, you will only be charged the amount that you were offered for your old device($130 In your case) and it will no longer be a requirement to return the old device to us. Any promotion offer will still remain as it is. Hope that information was helpful.

    I never asked about how much money I will be charged so I think they are just sending this canned response.

      I got the same reply too. Looks like they have outsourced it to some team to simply cut-copy-paste this reply to any query related to returning the device.

        I also got the same email reply from Akshit via the Samsung Trade Up Team, but then I specifically emailed them back to clarify about the trade in bonus:

        "Hi
        Thank you for your reply. I’m just clarifying, will Samsung charge for the $500 trade in bonus if I don’t return my old device? "

        Today (after 20 days) I got this reply from the Samsung Trade Up Team:

        "Hi,
        The $500 will remain as it is,
        Regards,
        Samsung trade-up team"

  • I returned my trade up phone and AusPost tracking shows it's delivered on 21st April but today again got email from Asurion-

    • Email them and send them your auspost receipt and tracking number and tell them that they have already received it.

  • I dropped off my phone at LPO and got scan and receipt of lodgement. Was wrapped in bubble wrap and the guy just said hand it over and scanned my bar code and that was it. Tracking number still shows same scan as the day I lodged on 15.4.21. Did anyone who sent their phone back get updated scan tracking info? I'm worried the post office just kept the phone and will report it missing in which case I might be charged full amount. Lucky I took photos of the phone and with it in wrap and sent it to Akshit along with receipt after I sent it so at least it is all recorded.

  • Before sending trade-up phone, you all remove the glass/plastic screen protector from the phone or keep it?

    • I removed the plastic screen protector (both front and back) from mine before I sent it back. The front screen protector had a few scratches so I didn't want a careless staff member to think the screen is damaged and charge me. Removing the screen protector made my older phone look like brand new.

    Asurion deemed my phone to not be in eligible condition, and told me that I'd be charged the full trade in amount. I asked them to return my phone in that case, and they were happy to. They even confirmed that I wouldn't be charged the $500. Received the phone back yesterday! If your phone also was deemed not fit-for-purpose, you can ask for it back!

    • I emailed them sometime ago with the photo of the phone and I asked them again a few days ago. They finally replied back with a photo of the phone and showed me where on the screen is not eligible. They really expected a perfect phone back and they didn't mention if they will return the phone back even I asked in the email.

      • Was it a scratch on the screen or a crack? Or perhaps burn in? Mine has some decent scratches on the screen but nowhere do they list scratches as an example of damage. They only mention cracked screen, rust damage, non-genuine parts, screen burn in, functionality.

          A small crack on the top left corner of my S7 but nothing display on that part of the S7 not like today phone full screen display.

    So… i have had my s21 for a couple weeks now.. never got return instructions and so i still have my s21 FE 5G… looks like i slipped through the cracks altogether.. At this point I paid $199 for an S21!

      I'm the same. I think there are many of us in limbo. Will standby for a few months to see if anything happens, then sell my tradeup phones privately if not.

    • Yeah it's been a month for me and I've heard nothing from them
