I'm not a lawyer but I think you may have a valid claim if you take it to the ACCC.

It says Hot Apple Pi, so i'd recommend a heatsink and possibly a cheap fan.

I'm not sure if it's nation-wide, but they also now have "custard pies" which are quite good. As the name implies, it's basically the same concept as an apple pie except with custard in the middle.
