      Anyone with life insurance, superannuation, and/or property needs a clear directive for the distribution of such when they are gone.
      Most people need a will, unless you are under 18.

        If you don't have a will, it goes to your spouse or your direct decedents.

        Any will can be challenged and costs you nothing to do so…

        Title the beneficiaries with your insurance and super providers, can generally name what % you want to goto whom.

      JV, It's really depends how close you are with the deceased. It's hard to challenge if you are a distant cousin for example.

      The law around who can make a challenge to a will has been changed recently to make it harder

      Also, a will is not just about money/assets. What if the unfortunate happened and both you and your partner died (car accident for example) and have dependents under 18 years of age - who is going to look after them? If you don't have this in your will the State will need to work this out. Just this alone is why you should have a will.

      In Victoria (not sure about other states) you can leave your will in the State Trustees Will Bank free of charge this way your family knows where your most up to date will is

    Fantastic, process was simple enough. Would have been nice to indicate what proportions of estate are given to beneficiaries but it will have to do.

    Yes, many people can challenge it but I hope my loved ones respect a clear direction of my wishes.

  • Question. Can this kit handle a situation where the most preferred legal guardian resides and has citizenship in another country (i.e. the US)? I'd assume we'd need a US based will as well (the Australian will would let the new guardians come into the country and leave with our American/Australian children, the US will would recognize them as guardians in the US).

    On a related note, how impossible would it be to have a guardian come live in Australia to take care of our Australian/American children? Is there a special visa that would make such a thing possible, at least until the youngest is 18?

    • Hi, if I understand your question correctly, you are asking about guardians for children?

      If that's the case, you can certainly name a foreign citizen as the guardian for your children using the kit.

      However the immigration visa question is something I am not able to answer, sorry.

    I am a succession lawyer. Whilst this may be a good “deal” remember that your Will can only deal with assets you own personally. This means wealth held in family trusts may not be appropriately dealt with by a simple Will kit. Assets owned in joint names fall to the survivor on death and aren’t dealt with in your Will. Additionally, most people don’t realise that superannuation doesn’t automatically form part of your estate.

    Before you run off making a binding nomination for your super to your estate you need to weigh up the pros and cons of doing so. One key issue is that forcing your super to your estate opens up those funds up to an “estate challenge”. I’ve also seen some people nominate their grandchildren as beneficiaries to their super. Unless there is a dependency relationship of some sort the grandchild is not an eligible beneficiary under SIS. If you wanted to achieve this you would have to force your super into your estate and then provide in your will to distribute your death benefit to your grandchildren.

    If you have limited wealth then I can understand this kit may be appropriate (I haven’t seen the contents to make an assessment) however if you do have significant wealth, scattered over various structures and types of assets it really is worthwhile seeing a lawyer. They’ll be able to develop a full estate plan which isn’t just limited to your Will.

    Think of it as an insurance policy. $29 spent on untailored documents without any advice to protect your wealth of $200k for example seems a little underdone.

      You're 100% correct.

      We definitely don't recommend our kit if you have complex family trust or company arrangements.

      Our goal is make sure that people who would otherwise not have a will have an easy to use kit to make one for themselves.

      The kit guides you through the decision making process to make sure that you consider all of your options. We think that this makes for a much better product, and a more enforceable will, than a paper kit.
