  • Reply from ebay customer service

"Due to the popularity of the 15% site wide promotion there were concerns around the stock levels leading to customer experience. As eBay always strives to offer the best customer experience for its buyers, a decision has been made to end the sale early at 1pm on the 30th December."

    • +14

You'd need a huge percentage of your brain missing to believe that crap….

    • +5

Yes because a customer would rather not have the opportunity to buy something, perhaps after hours of research so they can make an informed decision instead of an impulse buy.

    • for those people who purchased at full price and contacted them for a discount, customer service says that refund will be issued in 15-20 days by paypal

    • +1

So they were concerned about stock levels they have no control over? That's some 'special" kind of reasoning.

  • I really hope my cashback goes through since something weird is going on with my mac. For some odd reason I can only get onto cashrewards when connected to a vpn. My IP address hasn't been banned or something like that since I can access the site on my phone. How long does it usually take for the tracking receipt email to come though? I made my purchase late last night.

  • +1

No need to feel missing out. How many times and how frequent we had in 2015 10-20 % off all and selected retailers. Ebay is more desperate to get sales going than you think.

    • +2

Selected retailers was fairly frequent….I don't believe all retailers was particularly common however.

  • This may sound like a stupid question, but can they legally do this without consequence?

What they have done is quite disrespectful to customers.

    • +1

Umm yeah they can. Did you have a contract with them to deliver goods or services to you at a particular price?

Pretty clumsy by eBay but the sense of entitlement of some ozbargainers amazes me…

Edit: There may be some grounds for false advertising but you can bet anything there will be legalese buried somewhere to let them do this.

    • +1

If you read (and have the time) their T&Cs, there's always a clause that goes like, "eBay (or any other corporation for that matter) has the right to review, change or remove these terms any time with no advance notice" or something along that line. Of course very few people, if any, bother to read those T&Cs, agreements or any other fine prints but they're there so that these big guys can protect their back sides if sh!t hits the fan.

      • Yes, but is this condition legal?

        • +1

I am not sure about its legality as my knowledge of things law-related are almost zero, but if we go by the terms and conditions on their site, I think they know what they're doing.

Here is a line that concerns what we're talking about from the link in the OP:

          18. eBay reserves the right to vary the terms and conditions of the offer at its reasonable discretion by publishing revised terms on ebay.com.au.

          http://pages2.ebay.com.au/Buyer_coupons/celebrate2015

Of course as a consumer it sucks if you were planning to buy something at a later time, thinking that a certain offer would go up to such and such period as previously announced, to only find out that it has already been revised and the offer has expired. Well, there's always another time. I myself bought something in a rush when the first revision talk surfaced early today and I don't think I would have bought what I bought if I had enough time to think and plan. Maybe for many people this early expiry saved them from impulse-buying.

        • Yes. Why wouldn't it be?

        • +1

          @AussieDaddy:

I have lodged a complain with the government that is deceitful behaviour.

        • +1

          @nexus4:
Because they advertised by email and the email stated "…. Ends 31 Dec. Other T&Cs apply."

That implies to a reasonable person that the end date was fixed. There was no link to the T&C. There has been no retraction via the advertised medium (email). People made bidding decisions based on the date in the advertisement.

I would say people have a very good case to claim misleading & deceptive conduct & even bait advertising. If you placed a winning bid on an auction under the belief that you'd get 15% off, you've suffered a financial loss as a result of their decision to change the end date & time without clearly stating this was a possibility in their advertisement.

      • they can put that clause in all they like, if the masses feel cheated we can always fight it.

in any case if we all make a complaint whether or not they get away with it the trouble and pressure they'll experience from consumer affairs will give them enough trouble to deal with and not try something like this again

  • Damn you Ebay. I was planning on buying stuff tomorrow in the comfort of my own home. Why would you do this and terminate a sale early.

  • Can they change the T&Cs like that? Shouldn't by offering the deal to 31st the have to stick to that
I feel like ACCC or someone should be able to fine them

  • +2

I suspect they didn't expect such a large volume of sales & would have been losing money on each sale.
They couldn't really give people much notice or it would have resulted everyone buying large volumes quickly. Extending past the time they said was a reasonable gesture (even if accidental).
Either way, they should have put a clause in the conditions - something like "may end sooner if total discount exceeds $xxxxxx."
Unfortunately I was going to work out what to buy tonight too, so guess I will have to wait until the next sale.

  • +1

Oh no … how can they change it in the middle of the deal …..

Anyone got the original screen dump to prove it?

    • +1

      Got the original email

"Max discount $300 per transaction; 2 transactions per person allowed. Ends 31 Dec. Other T&Cs apply."

They did not appear to send a follow up email stating that they'd pulled a "bait'n'switch"

      • +2

good spot, if they were able to advertise the sale surely they can notify us via the same method of communication for such a drastic amendment to the terms

  • +2

More like false advertising.. Put till 31st but pull it out as soon as traffic gets high. Lame. Such a shame tho. Expecting things like this from small sites but eBay? Just forfeited any goodwill they earned I guess.

  • +1

damn, that's rubbish, was intending to have a buying session tomorrow! looks like that's out of the window now then! Seems a bit poor of eBay to alter the terms of a sale halfway through said sale, you'd think their own business analysts would have told them it'd be popular!

  • +1

I'm peeved…I paid for a tablet with the 15% off gave me a discount of $57, and the dam seller cancelled my order with no explanation. Now its too late to buy elsewhere on the sale. (swearing profusely)

    • Oh so happy now….after reading all the comments I decided to give it a go.

The tablet has just been advertised by another ebay seller at a similar price.
So I called ebay (recorded the conversation) and they said they would give me the 15% off considering my first order was paid and cancelled within the promotion.

I kept her on the phone whilst I paid the seller for 2 tablets and she processed the discount. Discount should be refunded into my account by 3rd week in January she said. yipeee!!

Plus went through the Cashrewards site, never used it before, but hopefully another 4% off there as well. Not showing in my account view yet though.

Thanks for all the posted comments….you just saved me a bundle.

      • &^%$#&%)*& swearing profusely…another ebay seller has just cancelled my order for no explanation. Am I ever going to get these tablets??

        • +2

Oh I am so laughing now….even though the order was cancelled, ebay processed my discount…so I got $115 for FREE….yipee!!

  • +1

Danm, had a list of things lined up to purchase tonight.

There werent any concerns about stock levels during all the other sales, even when most of the retailers 'sold out/pulled' the most wanted items first day.
Being Christmas it could be justified that most retailers would be low on stock so yeah.

Oh well save all that money for NYE Celebrations or the next sale hahahah.

  • Just been chatting to ebay, and they have said they will cover my purchases and refund the amount via PayPal for all items i had in my Cart that i was going to checkout with.

    This is the extract
"Please don't worry, I would like to inform you that you can go ahead and purchase the item. Once you will purchase the item, please send us an email with the details of your purchase and we will give you the credit of that voucher.
Please mention the item no. amount of purchase and the buyer id."

So if you did have a Cart of items ready be sure to drop them a Chat message and see if they are as willing, she did take a few minutes between each response as i assume she was checking my account, maybe taking a Log of what i had in there so i dont all of a sudden add more? Who knows.

    • +2

Here is the starter for anyone who wants to copy/paste for the response.

Hi, I note an email received for a 15% off promotion that expires tomorrow. I've tried the code but it does not work. Are you able to honor the discount if I put through the purchase at full price?

      • Excellent. Mention the email as they haven't sent an update. And pleadimg ignorant (by sayimg the code doesn't work) shows that you are unaware & think its just an issue with the code. This demonstrates that you as a reasona le person expect the discount to still apply & haven't realised that they've pulled it.

  • +19

Ebay's action in advertising a sale to run until the VERY SPECIFIC time of 11.59pm on 31 December 2015 and then deciding - without warning - to shut down that overtly advertised promotion is a clear example of misleading and deceptive conduct under the Trade Practices Act.

Ebay significantly benefitted by "baiting" hundreds of thousands of buyers onto it's website with its 15% discount offer - and then, without notice, pulls the offer well before Ebay's overtly advertised ending time.

To say it's because of stock levels is a massive cop out.

Harvey Norman, in the past, has been forced to enter into enforceable undertakings with the Australian Competition and Consumer Commission for widely advertising an offer and not having anywhere near enough stock to cover that offer.

Ebay, on a much wider scale, with this 15% discount promotion, has engaged in much more deliberately deceptive conduct.

At the very minimum Ebay should be offering 15% off site wide discount codes, valid for 12 months, to anyone who attempted to get the discount before 11.59pm on 31 December 2015 and a public apology for this pure management ineptitude.

Also - they have sucked in additional sellers - keen to take advantage of this promotion - who will now be liable for listing and other fees. Ebay should also waive listing and final sale fees for any seller who listed their item from when the sale was first announced until 11.59pm on 31 December 2015.

If Ebay does not take the above steps seriously and quickly then it has totally shot it's reputation as an online sales portal.

Sellers and buyers would be much better in future selling and buying items through Gumtree - or another more credible forum - even though Ebay is a shareholder.

    Shame on you Ebay.

You have no cfedibility left after this very low, deceitful move!

  • +3

Please read post of "oz gunner". I have had my discussion with ebay online chat team and am promised to be refunded 15% of the total payment of $2,769. Don't even have to split payment to two transactions (the total refund is over $300 limit). Sweet!

Good to see ebay hour the discount. I find they are decent.

    • +1

Yep. They were very helpful and didn't waste any time. No attempt was for made by them to weasel their way out of honouring the deal.

I encourage more people to do so because they shouldn't waste peoples time like this.

    • -1

I would rather pay the extra $300 than to bend over for them.

They fxxked up and I shouldn't have to call ebay just to beg for that 15% which they advertised to expire on the 31st December.

I bought a router yesterday with the 15% which is the only thing I really wanted to purchase.
Today I have 4 items in the cart with a total discount of $44.

      But you know what?
I would rather pay that extra $44 and buy them direct from the retailers so eBay gets zilch.
It's not worth selling my dignity and pride over $44.

From now on, I'm going to avoid eBay at all cost and shop on Amazon, Alibaba or direct from local retailers/importers.

  • +1

Same, I completed my purchase at 12:52pm and was waiting for the seller to update the freight to complete the purchase. I thought I missed out but have been promised the 15% rebate via Paypal.

Make the phone call, Ebay are being really good about it and mention that they are doing this as a gesture of good will.

In any case I am getting my 15%.

    • Make the phone call, Ebay are being really good

They have a number to call?

      • Yeah if you go to the Contact Us page, they'll give you their phone number with a pin code

    • +4

i swear-wording hate when companies pretend that honoring something that they have previously promised is a gesture of goodwill. Ditto for when i have issues with telstra and they offer to restore my prepaid credit to what it was before the issue happened as a gesture of goodwill (ie in the middle of the month all my credit dissappears for no good reason). Its not a gesture of goodwill, you swear-worded up and you must now fix it.

      • In the end I have the same outcome. I don't care what they call it so long as I get what was promised in the deal. On this they have delivered….for me anyway.

  • I've just emptied my cart, thanks eBay…

  • Here's what Manir at Ebay is telling me:

"I am sorry to inform you that we do not have any access or authorisation to reactivate this promotion."

"I can request a manual refund of the discount amount once the items are paid. However I cannot guarantee that you will receive the refund. The designated department will review my request and if they find that all the terms and conditions associated with the promotion were fulfilled, they will manually refund you the voucher discount amount within the next 10-15 days."

    Pretty lame.

  • +8

wow really …this is BS. was going to place my order just to notice that the code isn't working..and its not 31th.

  • Yay, eBay responded so getting my Sony KD65X8500C for the awesome price of 2471 - 300 (eBay) - 98.84 (cashrewards) = 2072.16$

  • +4

I did not see this one coming!! Its not even that good.. like the previous 20% ones..

  • +1

(AGENT): I understand that the offer expired early but you don't have to worry. I would request you to please send us an email so that we can help you with the credit of the voucher amount.
(AGENT): Once you pay for the item, please mention the item numbers and we will help you with the one time courtesy credit.
(MEMBER): is that an ebay credit or a payful refund?
(AGENT): The amount will be credited in your paypal account.
(AGENT): Please don't worry about it, you can have the SR# Xxxxxxxxx for future reference.
(AGENT): Moreover, you will get the whole chat transcript once the chat will get disconnected.
(MEMBER): So do I put them through now? and it can be organised from your end?
(AGENT): Yes, but you have to intimate us once you pay for full.
(MEMBER): I have placed the order and paid in full
(AGENT): Okay, let me check this.
    (AGENT): Yes, thank you.

    • +7

(AGENT): Yes, but you have to intimate us once you pay for full.

Damn, didn't know you had to get down and dirty with ebay for them to fulfil your discount…

      • +3

Had to turn on Skype and show a bit of nipple for that part.

        • +1

Think these guys should rename themselves to ePlay…

        • @montorola: I think they have been taking their customer service training from here

  • +1

Thpppppt to this then. 15% was barely worth getting excited about, but to then pull the discount early, due to 'concerns around stock levels affecting customer experience' is hilarious in the extreme.

Good luck to everyone dealing with eBay customer service and the promised 15-20 day turn around on a Paypal refund.

    • I was informed that I would received the Paypal credit in 4-5 business days. The guy I had on the phone verified my purchase payment during the call. I will also receive an email when it goes through.

      I am good with this.

  • So i place a bid on an item I want based on the fact that the offer expires on 31 Dec. The auction has ended 10 min ago, and the code didnt work.

Found out that the offer has expired 36 hours early.

I am now waiting for a customer service rep to chat now.

    • Feels like a trap. I was about to place bid on an item too.

    • Is it normal to wait 30mins with no response? I'm assuming they have their hands full with angry ozbargainers

      • Yeah, I had to wait around 20mins until I was responded to

  • Just settled down with the laptop to buy a whole lot of stuff, and now I find this.
    Bastards!

  • +2

    WTF no balance left !?!

Heres a screenshot of the original T&C's if anyone is interested.

    • Have a look at # 18 in your screenshot, bruh.

"eBay reserves the right to vary the terms and conditions of the offer at its reasonable discretion by publishing revised terms on ebay.com.au."

I know it's stinker but the term is right there.

      • "Reasonable"

        • Can be interpreted in any way, depending on whose perspective.

      • +1

Just because they claim to be able to do it, doesn't mean they legally can

    • Thanks.

I'm submitting a compliant to the ACCC and that's very useful.

  • eBay has been an absolute joke last few years. Used to be a great place to buy and sell back in the day. Then they got greedy and started wrecking the place with all sorts of unnecessary changes year after year.

  • +1

I was told via chat that the items in my cart since last night - 'you might get a refund for the discount amount'
I then went on about how that sounds like a scam - pay now and you 'might' get a refund.
    Anyway
Was told to 'wait a few days' 'eBay has periodic promotions'

    • +1

What a joke. Only got back from overseas today. DAMN YOU EBAY

  • +5

been waiting for a chat agent for 30 minutes now..

    • +3

      There there, have a +1

      • +1

still waiting , I think a lot of people are trying to contact e bay about this…

        • It took me 50 min to talk to an agent and he couldn't help.

  • And here come the negs…..

    • And here comes the invalid negs…..

      • Oh my please no..

  • +1

Been waiting for chat for over 35 min too.

  • +2

The thing that has me really pissed is that I will now not make as much money from my 5 auctions ending tonight. Hell, I think they will go for less than they would have with no promo running at all over this period, as people will now have a bad taste in their mouth and be avoiding ebay. I'm waiting in a live chat trying to get some kind of compensation/answers, but i think my chances of that are practically 0%. Bastards.

The funnest part is that if I decided to end my auctions now because of this, they will charge me final value fees based on the current bid for all the items. :(

  • Like someone else - was waiting to get home from work and buy the stuff I needed, only to find the offer is finished. Crappy!!!

  • +1

Dunno why eBay would pull such a dumb move, it's totally gonna screw up their 2016!

  • +1

Just called eBay and after talking for a few minutes they said they will honor the deal by refunding the amount to my paypal and to go ahead with purchasing it. They said to call them back after purchasing it and they will confirm I will be getting a refund of the 15% in 15 business days.

So try your luck and give them a call. (Don't bother with chat since the wait is well over 30 minutes)

    eBay's number: 1800 322 928

    • Don't bother calling right now - the helpdesk closed at 9pm.

      Call centre opening hours:
      8am - 9pm during weekdays
      8am - 5pm during weekends

    • +1

      offices closed

  • Spent 55 minutes on line chat all I managed to get was :::

xxxxxxx ( REP ): Please try to understand that I cannot make any false promises. If you want you can send us an email and we'll escalate this to them and if they confirm, then you can buy the items

  • Odd move by eBay, I feel sorry for all the people who missed out and even for those who work for eBay's customer service who have to deal with all the angry customers when it wasn't personally their fault.

Maybe a large retailer was pissed off at eBay for having the promotion and eBay caved to pressure by shutting down the deal to please them.

I think eBay are within their right to end the promo early though but I also think people are within their right to be disappointing and voice their opinion but they shouldn't be outraged or entitled to the promo just for missing out on a deal which only happened in the first place because eBay provided it.

    • "Maybe a large retailer was pissed off at eBay for having the promotion and eBay caved to pressure by shutting down the deal to please them."

      But why?

Large retailer like Target, BigW, Dick Smith and the lot will have their own eBay store anyway.
Not like the 15% will come out of the retailers' bank account.
My understanding is, eBay will front the cost and sellers will get the money in full.

In fact, such promotion will drive up sales.

      • +2

Not really sure but something suss is going on when they all jack up their prices whenever they are a participant of an eBay deal or pull stock off eBay but continue to sell on their own website. Maybe this time eBay didn't give them a heads up since it wasn't just selected retailers.

        Just a (conspiracy) theory :P

  • Chat not helping at all. They won't budge

    Manir21:26 PM
Well, we received instructions not to forward these requests now.

  • "I would like to inform you that given offer has been finished today so now you can not avail this offer." classic ebay support

  • +6

Live chat is completely useless, they are continually ignoring my questions and simply telling me the promotion is over and to wait for another promotion.

      • +2

I don't see why not, valid reason to do it

      • +2

I don't know why you're only replying to me, since I'm not the only one negging this deal.
Regardless, it's nothing against you, but I believe the neg is warranted based on the voting rules (major issue with retailer).

      • +2

What deal? I thought there was but there isn't any deal.

      • +1

Wouldn't take it personally mate - kudos to you for posting it to begin with, but I think a lot of people are a little peeved with eBay that it ended prior to the originally advertised date. And yes the fine print says that eBay are within their right to do so, but still.. it's poor form, particularly considering the time of the year.
