      At first I would have thought quite high.

      But I just saw that the account already allows me to download a tax invoice. I reckon that is rather final.

      Not a lawyer, but in my lay-opinion a tax invoice is a confirmation that a binding contract has been formed. In conjunction with the fact that they accepted payment, I don't think they have much of a legal argument to cancel any more.

      Different to other companies that are careful how they word their initial reply. Often they send an 'order acknowledgment' only. That in my view is still non-binding, since they have not actually accepted my order. Amazon goes even further, by processing payment only when the item ships.

        They are within their rights to cancel & refund due to a pricing error, should they want to, and no laws are broken.
        You'll find plenty of documented information on this at the ACCC website under Australian Consumer Law - most savvy OzBargainers know this ;)

          The question is when a contract becomes binding on both sides.

          While The Iconic argues based on their T&C, I have my doubts those T&C would stand up in court if someone challenges them.

          By issuing a tax invoice they went a lot further than other retailers go before they ship out items. You simply won't get a tax invoice from Amazon for example, until the item has shipped, and Amazon only takes payment when something is ready to ship.

          Let's go a step further: assume a retailer has posted an item, and only then they realise their mistake and ask for it back. Would you still argue that they have a legal right to do so?

          There has to be a line somewhere. And in my view by accepting payment and issuing a tax invoice The Iconic was firmly on the other side of that line.

          Now since those shorts were neither particularly nice nor great value I won't waste my time to argue with them. What it does though is that they are now way down on my respect and trust scale and won't get business out of me ever.
