        Statements such as 'was $150/now $100' or '$150 now $100' are likely to be misleading if product had not been offered for sale at the specified 'was' or 'strike through' price of $150 before the sale commenced, but had instead been offered for sale at a lower price. In such circumstances, a consumer would not make the represented saving of $50 by purchasing the product for $100 during the sale.

        In this instance, the price was $99 immediately before this 'sale' and has been for over 5 weeks. It then went up to $119 and a $20 discount was offered. Hence it is misleading for you to claim a was price of $119 as the was price is $99 - ie: there is no savings at all.

        • a ‘before’, ‘was’ or ‘strike through’ price that is not the price those items were sold for in a reasonable period immediately before the sale period started

    Doing a search on eBay for 'Gesture Sensing Remote RC Stunt' shows that you actually have the highest price of all the eBay sellers.

    e.g This listing for a 42cm car in either blue or red is $97.50 ($85.80 for eBay Plus users)

      @scrimshaw I’m sure you can find a similar looking/size product even at half price.. what you don’t see is the build quality I'm afraid.

      As you can see in the selling history we were too selling a similar looking/size but lower spec product for $69. We learned from customers that they need a product with more power and durability, so we sourced this current product to cater quality & durability focused customers. For this reason we have very high percentage of returning customers who keep coming back to our store as they know we care about them and don't just sell cheap plastic just for sake of having the lowest priced item in eBay.

      • i know your trying to grow your business but please just stop, your digging yourself a massive hole. First of all i don't think those people would appreciate you releasing part of their purchase history. Second of all no matter what you say the evidence just stacks against you, this item was previously discounted on the 6th of December for the public as you say, no matter how you word it its still a misleading price, as its been jacked up and now we have to apply a code just to revert it back. you should of made it $98.99 would of helped your case
