          @majord: Although it's a fine line, the Kogan case involved specific lead-in advertised offers, most if not all of these will not have. As they say in the classics, read it and weep:

          The problem is essentially balancing these issues: misleading consumers V stifling competition V the final price reality. Wrt the latter, if a seller ups his normal price by 10% but is still the best price available anywhere by say 5% why would anyone want to knock that on the head? Cases of gross price changing (esp above RRP) should be reported to authorities or outed on social media - inc Ozb.

        • @Possumbly: It's a reasonable position to simultaneously say that you recognise the behaviour is illegal and still buy from them. It's also entirely reasonable to say it's illegal and not buy because of that.

          It's still illegal in either case, and saying it's illegal doesn't say this it's not the cheapest, and it doesn't say that you're not going to buy it.

          The reason is simple, pricejacking like this is not misleading to someone who did their research, it's misleading to others who didn't. And some people care about other people. This is all the "knocking" it is about.

          Yes, in some cases the pricejacking is not as bad as other cases, but AIUI in terms of determining whether someone is illegal, the law only cares about the deceptiveness.

        • @mattythecapybara: you can't mislead if you're silent. The problem is tying down responsibility. Ebay makes the offers, sellers set their prices.

          It's not unreasonable that many will lift prices if their margins are cut, especially if ebay fees remain the same. It's also not unreasonable that they would revert to non-discounted prices for a 20% off sale.

          The ACCC should do more to clarify what is acceptable as far as price movement on non-auction ebay sale items is concerned. I might even get around to asking them for that clarification. If it was "illegal" then most of us would expect that they'd have advised ebay and sellers of that long ago.

        • @Possumbly: While IANAL, if you agree to participate in these voluntary sales, you are in effect making the 20% claim as if you initiated that sale. For a site-wide sale, it would be another matter.

        • @mattythecapybara: simple fact is that one sale ends, another (sometimes better, sometimes worse) starts. Where a seller is already offering a discount it's not unreasonable at all for them to replace that with the new 20%. Happens regularly with retail and online stores. The ACCC's problem is what constitutes a "regular price". There are undoubtedly sellers who cross the line from time to time and that's why the ACCC should make a statement to ebay and its sellers. They must know about the practice since people on Ozb have said they've complained about it.

          The solution for anyone aggrieved is to complain - not to Ozb readers but to the ACCC. It's a simple and quick process.

        • @Possumbly: I'm not suggesting there's no subtleties around what you're talking about, but while probably not uncommon, that isn't the most common case. I don't think anyone would expect a 40% discount off the original price in the case you suggest.

          This makes no sense, why would eBay only offer the discount for select sellers? The fact is that eBay wear the discount on sitewide deals only.

          On these 20% deals the seller has to wear the 20% plus has to pay eBay fees on the undiscounted price. That is a huge hit to take and many companies are losing money on some products.

          Because the sellers have said this in the past.

          Sellers have said before they post for all of it and pay full eBay fees on the pre discount amount. This has been from people involved in the promotions and those that have declined to take part.

        Agree tromboc, the problem is knowing which sellers are in that position and what the margin is. For competition to thrive sellers have to make a decent profit overall - something which some Ozbs (29 on this deal alone) don't seem to understand. Small businesses and single owners might be prepared to have loss leaders from time to time but they don't have the luxury of bulk purchasing or bulk sales to fall back on. Even the big boys and girls couldn't survive (for long) with 20% discounts on top of large existing discounts.

      Just because there is price jacking, it doesn't mean there are no bargains.

      This SSD for example was a bargain and sold hundreds without price jacking. Final price was $49.85 with CR - one of the cheapest prices a 120GB SSD has ever been!

          @swapsey: eBay are definitely trying to get more sales, no denials about that, but there are definitely legit bargains amongst the mix.

          I decided to spend the morning comparing tech prices to my suppliers. Heaps of $500+ tech products have only $10 profit with the 20% off coupon.

    First go at a search link

    I've included all 104 sellers (store link not store name), and fixed the ones eBay fails to link to properly on that page (how hard is it eBay??) but it says one or more of the seller IDs is not found - if you can work out which, I can fix the link.

    Edit: Lifespan Australia shows up in a Google search, but when you go to it, eBay says the store doesn't exist. I've removed it, but the 103 store search still complains. I have manually clicked each of the other 103 stores from my link and they work though, so this link should be fine to use (unless someone can see an obvious error).

    • Not certain which store is the issue here, but the url is too long (for most browsers anyway, Vivaldi (Chromium-based) karks out at 2000. May need to split it into two search links.

      So close! It's not the store names you're going for, it's the user ID. Let's look at the first one. It says Action-Bike-Ski as the store name in the URL, but that's not what you add. You have to find the id name here and you'll see in the URL that it's actually actionbikeski. So unfortunately as I was going through yours it probably only registered 20% as majority of the store names have slight variations to their ebay user ID. Good effort though, must've still taken a long while to get it done.

        Cheers. Wouldn't it be nice if eBay just provided a link! Didn't take long because I just took the HTML from the eBay list, ran it through some filters and produced the link, then fixed the ones where eBay had the store link wrong anyway. Since we need to user ID, I can write a script to grab that from each store page for next time to produce the link in no time (except for the ones that eBay fails to link to properly… why eBay why?!?)

      At least they have the decency to decline & not be apart of these deals unlike the rest of these scumbags who abuse the advertisement of the sale then just jack the prices up. It's a pathetic business practice and ebay is trash for letting them get away with it.
