    They have updated the landing webpage with the following info:

    So they are within their rights to refuse this offer to anyone else. The link was supposed to only be for those customers who entered a specific competition, so I would suggest it was a targeted campaign. Happy to be corrected if not the case.

      Well I screenshot everything about the promotion on their website (showing it ends on 30 June 2017) and pdf and my application summary indicating when I opened the amount. I also entered the page using their official website (knowing they may play this trick).

      Also by entering MINI as promo code, you enter into the competition.

      I'll go to ACCC and the Ombudsmen if they refuse to grant the money.

        They are essentially playing "who will cost us $50 and who will not" at this point, since every average user signing up yesterday was entering to be rewarded from a promotion they (at the time) we're fully prepared to give out — legally.

      My thought is that they can change the T&C to stop people from taking advantages of the promotion anymore. But they can't refuse to grant the money to people who already opened the account under the old T&C especially it's not clear that you need to enter competition b4 opening the account. If we all go to Ombudsmen then IMB will be seriously down lol. It's a contract that you opened the account under the old T&C and they will breach the contract if they don't give the $50 as stated

        Too little too late, I think those that applied under the previous T&C should legally be fine.

        IMB (or any merchant for that matter) should google ozbargain before writing up their T&C and launching promotions :)

        Even their new T&C sound a bit odd. How will they determine an applicant applied via a 3rd party site? And how can they determine an applicant entered their Mini comp?

          They may have record re how you entered the website and your details about entering the competition. But yes they can't by law refuse to grant $50 to those already opened the account. And I specifically went to the IMB official website via Google then put in $50 in the IMB search engine.

    Based on the below post from their website re the count of entries for the Mini competition….they have been slammed and are back pedalling to try and slow the cash from rolling out.

      Well you did not now because you changed the T&C. For those who signed up before the old T&C changed should be eligible because your old T&C is unclear that you must have entered the competition. The old T&C only stated that new members who entered the promo code would be eligible to $50.

      Edit: Your ethic and attitude of not granting the $50 as stated in the promotion makes genuine customers who want to change current banking arrangement back off big time. Good to know how you guys work before putting our hard-earn money into an untrustworthy bank.

      I didn't register an account because of the hassle of needing to close it, but the rep's attitude is pretty bad. Rather than owning up that they stuffed up, they're blaming the OP instead.

      The inconvenience is caused by the bank's failure to write the t&c clearly, not by the OP. Pointing fingers and shifting blame only makes you look worse.

      Almost seems like bait and switch, offer a great sign up promo for new customers, change the terms and conditions half way through the promo and inform everyone who signed up that they agreed to these new terms and conditions which disqualifies everyone from the sign up bonus, but happy to have all the new customers stay on with their product anyway…. heh

    Seems to me like an honest mistake by IMB which they corrected fairly quickly.

    Not sure why people would want to go to the effort to threaten and punish IMB just so that they can earn a few bucks for free. Especially since no one lost anything more than a few minutes of their time.

    Feels very un-Australian, as do some of the comments above. I certainly wouldnt want to earn money like that, and it makes me lose faith in what was once a very well intentioned community.

      It's not a few bucks - it's $50. If you have a family, probably at least $100.

      The major concern is the principle behind it that they're false advertising and unethical. I'm particularly annoyed with them not being honest and ripping (or even scamming) people off. I really hate people pull these tricks. If they don't want to honour it, they shouldn't have promoted it at the first place. Their problem of underestimating the amount of participants in the promotion is not a good reason to change T&C to just make you ineligible. They should stick with what they said and honour the $50 for those who already signed up - which a reliable business would do. If it's as you said that it's an honest mistake, they should suck with their mistake. That's just life. They should learn the lesson and move on. They can't make a mistake but blame others for it.

If they were offering $50 to everyone signing up, why would they bother with a promo code? Especially one called 'mini'. It seems more than likely they were targeting those that had entered the mini car promotion (who had previously agreed to receive promotional material and calls regarding loans, financing etc) and received an email link with this promotion. Unfortunately the link was open for everyone and Ozbargainers found it, and IMB subsequently fixed it in the morning when business day commenced. Lesson learnt.

        I'm all for trying your luck, as many people do with other 'pricing error' posts. But when it doesn't get honoured, I accept it and move on as I haven't lost anything for trying. However reading the letter of the law, you may argue that you are 'entitled' to that $50, which the previous day you never had and you certainly didn't earn. And you want to teach the company 'a lesson' by suing them/complaining/punishing, a mentality that is more akin to the way the United States is now but I hope Australia has not become. Because even if you do win, there may be employees who lose their job at IMB over the 100-200k they stand to lose. I certainly wouldn't wish that upon anyone for a measly $50 profit for myself.

        But there are those, like yourself, who are desperate to earn money without any apparent care in the way you do so. All I can say is that if your passion about exploiting $50 from IMB was equal to that of your own career, $50 would seem like only a few bucks to you too.

          It's not really about the $50, I don't really mind that. But anything that is easy to open yet deliberately difficult to close is a sure sign of dishonesty. If you don't pay out the $50 at least cancel all our accounts. It's just like getting a full refund from a price error, do you have a problem if a company made it almost impossible to get a refund from the price error?

          @demiurge: I hope they do cancel accounts for those that expected the 50 dollars and don't want to stay. And I suspect the closing of account at branches only was there before this promotion, and has nothing to do with dishonesty. Also you didn't lose anything so you can't compare it to refund example you gave. On the contrary, you got a free bank account that doesn't cost anything. You could just as easily forget about the account, cut the card and walk away.

          Are you working for IMB?

          As a bank, they should take into account about risks of promotions or any business decisions they make. I'm sure other candidates will get the job if someone loses their job because they didn't do it properly. Yes, it's money that we didn't earn, but so as many other deals. Now that they have all your personal information. You can't even close your bank account unless you go to branch in person, which makes it difficult to move on. Seems terrible to me.

          The criteria of entering the competition isn't stated in the T&C. Now that they just change it and add facts which looks actually illegal if they don't honour the promotion for those who open the account under the impression of the promotion. Not meaning to punish them if they stick with what they say in regard to the old T&C as they should. Complaining / suing / punishing is only for when they don't what they should have done at the first place.

          Just like ING, you get $75 when you enter a promo code. The deal is for the general public and they still brother with the promo code.

        • @venu: It's simply not true that a free bank account doesn't cost anything. It increases the risk of your identity being stolen. And should anything happen to your account you are ultimately responsible for it. Would you just open a bank account for the sake of it?

          Nope. There're two different types of ING codes: one for referral and one for just signing up without a referral. ING puts the promo code on the website as well since not everyone knows Ozbargain or has a referral code. I personally signed up using the code published on the ING website that is accessible to the public because I was not aware of any referral codes or Ozbargain when I opened the account. And yet, I have been using my ING account for years now.

          Not everything is time efficient. Really, it's the principle behind that I felt like scammed. And if everyone just drops the "trouble", some may just do things deliberately unethical because they bet you won't bother.

          Well, not every product is free. If I sign for an Everyday Unlimited or Kickstart Everyday account, there's a fee of $6/month. If you look at their fee schedules, they have ridiculous charges for transactions like BPay of Eftpos charge. You even need to pay $1.6/month if you choose a Visa card instead of a Cash card that most banks will just waive the Visa card fee. They're in arms length to earn money if you use their products, so as long as you use their products, it DOES COST you financially. If you leave the account open, they'll keep charging you for Visa card or bank account maintenance fee. It just depends on what type of account you signed up for.

          You are right that there is a higher risk of identity theft in internet or forums. But it's unlikely that you will give your Passport, driver licence or Medicare details on the internet. You probably just give out address, mobile number or date of birth for some promotions like freebies. The consequences of having your passport or driver licence details being stolen are more serious than having your contact details like mobile number being misused.

          Most people won't research how to close an account before signing up. I'm not opening an account for the sake of the hassle to close it. IMB knew the risk of blowing up their money if they didn't write the T&C clearly, isn't that purely their own mistake not to draft it properly at the first place? If I sign up with an "honest mistake of not being aware of the fees", can I say that I'm not paying the fees because I quickly realise my "mistake" and fix it up by closing it? No. Same logic applies to them.

          We provided personal information to open an account under the impression of the promotion. It's true that they will still have your record, but closing an account prevents thieves from using your bank accounts illegally (eg. overdraft your account even if your account doesn't have money, and eventually you need to pay the overdraft fee and potentially dispute the stolen money which can cost more hassle).

        • @citygal: Most people isn't really an excuse. In many other deals with bonuses and sign up perks, there are people posting how to cancel/close account. I'd say its the smart thing to do before you sign up to something. Anyway, I've always said it was IMB's mistake for screwing up their T&C, and it seems customers screwed up by not realising they couldn't exit easily and that they gave away their personal details that can be stolen at any time. If you want to contact and have your information/account deleted, I can respect that. But IMHO I don't think IMB was intentionally scamming anyone, and I think trying to get the $50 out of them is petty.

        The promotion for this deal was via email to the people that were eligible for this promotion. Someone reposting that code to OzBargain to allow ineligible people to sign up is not the bank's fault.

        This was a targeted deal, just like those that are posted to OzBargain daily.

          That is evidence of incompetence, not intent. Intent would require some form of promotion to ineligible people or some internal link and I don't believe either exists.

          Edit: You mentioned the page existed in search results and then edited.

        • The eligibility criteria isn't clearly stated in the old T&C. A reasonable person in many of our position would not have known that he or she is ineligible. So the point of encouraging ineligible people is irrelevant because we would not have known that we are ineligible.

    Hi Guys,
    I had a chat with IMB representative Anne this morning and after long clarification, she had confirmed 50 dollars promotion.
    It was almost 50 minutes waiting for my call to be answered.
    Also, it is impossible to close the account unless you are going to the physical branch.So biiig headache.
    So this is not a mistake or even scam.
    This is a classical case of the misrepresentation and should be punished accordingly.
    We could easy do class action additionally to the FOS complaint and negative review.

      The bank in no way encouraged ineligible people to sign up. In fact by requiring a link that was sent via email to only eligible people they did the complete opposite. Sometime taking a link that was sent to them in a personal communication and posting it here has nothing to do with the bank. I'm not denying they did a terrible job of hiding that page but how exactly did they promote that offer to ineligble people?

        We're just all upset because we're missing out, but definitely agree with you that the bank didn't encourage ineligible people to sign up.
