Just told me the seller had 3 days to respond to their request for information and they missed the chance. So i asked why then it hasn't been ruled in my favour. Then I was told it will be ruled in my favour now. What the heck??
I just received a confirmation email that my refund has been processed.
Seems like they will just take their sweet time unless you call and pester them.Finally I can put this fiasco behind me and move on. I just hope there aren't too many people who decided to wait around even aftee all the trouble so far.

Mine was pretty much your scenario (now paypal has revised the deadline for their review to 24th of July) your response prompted for me to call Paypal and get it done with once and for all. They were absolutely useless in helping me, so I called up my credit card provider to do a charge back and it was done in a matter of mins. (so much for relying on Paypal)
My credit card agent I spoke to said that the funds will be refunded no questions asked. Got reference no and everything. I wouldn't hold one's breath for Paypal to sort this out, do it yourself and things will get rolling.
I am so glad I have finally got out of this wild ride and it is a big lesson learnt for me.

My review date was the 20th and I just double checked- it had not been moved.
But I thought why wait that long and just gave them a call.
After going through the history first he was going to read me the reply from the seller. I told him that I was already aware of it ;-) and that I was no longer willing to wait as the seller failed to provide the goods in a timely manner and I had purchased from another seller (payment with paypal ;-) ).
I was polite but determined and informed him that it would be his decision if the refund was from Paypal or otherwise with a Credit Card back charge.
After that i was on hold for about 10 minutes and than he informed me that he will be closing this right now in my favor. The money would be charged back to my crdi card but this would take up to 12 business days (which is fine with me, happy enough knowing I get it back without any further dramas).PS: Just checked my account and it said:" After careful consideration, we're unable to decide this claim in your favour at this time." (SHOCK!!!!)
But looking at the transaction it states: "$470.00 was refunded on 7 July 2017 to VISA x"Cross fingers it all works out in the end (Roboguy when you read this…. )
Now I received this email from Paypal:

Had the same thing happen to be a while back for a different product. Tracking showed the parcel as delivered - to a completely different suburb from my address. Got the same response when trying to deal with Paypay, initiated a chargeback with my credit card company and got money in my account almost immediately.

I called PayPal and they had received the long story from Roboguy and were still 'processing' my claim.
At first they seem to think it was ok and that there was a tracking number so Roboguy has provided some shipping number to PayPal.
Id suggest people call PayPal to question their process.
Im back waiting for PayPal to absorb the idea that 30 days delivery does not mean 60+ days.

Chuffed with my robot too which arrived yesterday from another deal (ordered on the 23rd June and received 6th Jul - 13 days inc. weekends)
Is there a recommended process/template suggested with raising the paypal dispute? I've never needed to do it before so if someone wants to detail it, I'd much appreciate it. I'm sure I'll figure it out otherwise.
Well unfortunately it depends on who answers the call at paypal. Who I spoke to was incredibly unhelpful and would not help to resolve the case.

Thanks for the advice :) I got slightly further with the second call but now they are saying they have been given a tracking number which they say shows delivery is due on the 22nd July. I doubt this is correct. Will follow up again on Monday.
I got the same response and they even sent me a link proving that there is a valid tracking for 22nd July which is at best estimated, not actual.
Hence the reason to favour Roboguy for the time being.So I can say with confidence, that not all decisions by Paypal will be in your favor for now and that there is valid tracking which is still an estimate at best. (funny that Roboguy sent me an email that he got confirmation from supplier that it will arrive on estimated 15th July, but the actual tracking shows 22nd which is still an estimate(requested from Paypal, not sent to me by Roboguy). Who knows if its get pushed back again because it keeps changing?
Anyway no matter, my credit card provider told me there would be no problem and assured with refunding me when I requested chargeback and explained to them how long has passed since purchase. Just a matter of time for me.
Ask for the tracking number. You must be entitled to it from paypal

That is the basis for Paypal to refuse the claim in my favour. If that is not the tracking then I did not get one. Regardless I have requested for chargeback, because Paypal is incredibly unhelpful.

Yea na it doesn't work that way with cargo shipping. It wouldn't be allowed onto the docks at Sydney as the BOL is stated for Melbourne. Even if the ship was parked there it will stay on board until it hit Melbourne.

Thanks guys, called up paypal just then. I said like 5 words (my full name, yep, ok, hi, thanks) and everything was resolved.
Long story, paypal asked if I was calling about the dispute I said yep, they said can I put you on hold, I said OK, they came back and said are you there so I said hi, then they go the seller provided them with a tracking number which was invalid so they won't prolong the case and will be issuing a refund asap. Very happy with the result.
Best of luck to you roboguy, definitely on my blacklist though due to the way how you handled this entire case. If you had only issued a refund on request rather than stuffing around I would have possibly given you another some other time but now it's 100% NO.

he's providing a tracking number for the container that has his order rather than a tracking number for any individual customer. Further, it seems to indicate that the ship won't even arrive in Melbourne until 22/7.. which means no one will get it until August at least (contrary to roboguy's estimate of 15 July). I think this last lie is the last straw for me too. I was happy to be patient and tolerate some lack of transparency but this is starting to get ridiculous. Not sure lack of experience is quite adequate to explain things anymore.

I just created a dispute, and PayPal advised that the seller couldn't respond and prompted me to escalate to a claim.
I mainly am going down this path as someone mentioned it seems unlikely that warranty would be provided if the sellers business fails.

Good to see other victims of Roboguy are getting results with Paypal dispute.
Judging by the posts, it looks like Roboguy is providing BS tracking number (Probably the tracking number from his supplier) in an attempt to delay or throw off Paypal disputes. This is a really disgusting behaviour. I'm surprised to see people wishing him good luck after how he screwed everyone over.
If anyone is really giving this guy another chance and still waiting for their order to arrive, I'm sorry but you are really naive and should really sort this crap out and run in the opposite direction ASAP.
Even if you receive the order, I somehow think more pain will await you should you have to deal with Roboguy with warranty in the future (that is if the business still exists in the future).This is exactly why I suggested that everyone should raise a dispute immediately when he confirmed that shipping has been delayed to 21-27 July. There were some stupid advice floating around at the time that it will take longer to get results with Paypal dispute than waiting for delivery.
Well, who's stupid now? 7 July and I have confirmation that I'm getting my money back. Even if we step into an alternate universe where everything Roboguy says is true and correct, he therefore has tracking details which would probably appease his customers but he still won't pass them on.
Back in reality, even a person who has no idea wouldn't be this bad, so I just don't see a person making an attempt to establish a legitimate business. I have to make too many leaps in logic, this being a scam still seems more reasonable as opposed to the horrendous levels of incompetence we need to assume to be in this position.

Roboguy actually called on the day paypal closed the dispute to tell me he has no idea why paypal are closing disputes this way. After speaking with him, I think he's a young guy doing what he can in a crap situation, really inexperience in import stuff and really inexperience customer service

I'm patiently waiting but have just lodged a dispute just in case now. One thing I noticed. Paypal may have limited his account. It says seller's not responding to communications and claim is automatically escalted for review and can take up to 30 days
I think it speaks volumes about Roboguy's dishonesty if he provides dodgy tracking numbers to PayPal (and has been refusing to provide them to anyone else).
I'd advise anyone to get out while they can.
It's difficult to say whether the whole thing has been a scam from the beginning, but it is certainly starting to appear that way.

Raising a dispute now after waiting all this time then going somewhere else to buy it is even more of a chore that I don't wish to partake in.Even with the ebay deals? Similar priced and you know with ebay you gotta have the stock to ship otherwise they crack it.
I reckon dealing with warranty will be a bigger chore if it even exists. In the likelihood that his business dissolves because of this debacle, you've lost a lot of value in your vacuum by not having local warranty which eBay sellers are offering at a lower price
It's your choice but i don't understand how buying elsewhere is more of a chore. It takes a few clicks to buy somewhere else. Maybe another 5-10 minutes to call your credit card company and lodge a dispute if Paypal doesn't want to help out. Sounds much easier than ongoing uncertainty

At the end of August, if I still haven't got my robot, I simply lodge a Paypal claim. If Paypal refuse it, I lodge a credit card chargeback.
It's $400. That's not a lot of money to me so I frankly don't care that it's sitting in his bank account and not mine.

called paypal twice now and both times got told that there is alot of people claiming againest roboguy and they cant do anything about it till there advanced team looks in to it, asked to speak to their teamleader and they said oh shes on lunch she will call you back….. 4hours later nothing guess it looks like a credit card charge back it is
Call them back once more and say if its not refunded then you have no choice but to issue a charge back. That way you cover your ass a bit when you need to use Paypal in the future. It also helps with the bank as Paypal is actively not helping in resolving your issue.

Looking at the latest shipping info posted above, even if the ship docks in Melbourne on 22nd July, doesn't Roboguy live in rural NSW? So it has to clear customs (and would a huge load of non-Australian standard robot vaccuums just pass through without a second check?) and physically get to his residence, to then be sent out to each of us? Even if we pretend his T&C's don't breach consumer law, he has clearly stated here that if our items don't arrive by 26th July we are all entitled to a refund. That would be my guess as to why he isn't logging in - it simply isn't going to happen.

PayPal told me they wouldn't refund until after the 22nd, they wanted to see if the tracking information updated (or something along those lines).
That's an absolute garbage. I would suggest just contacting your bank directly. Shipment from his supplier has nothing to do with end customer. Paypal shouldn't even be accepting that tracking number as proof of shipment.
Yep. I agree with djc926. With the amount of disputes and claims that Paypal is overwhelmed with, they ain't going to give you refunds as easy as some others have received here now.
As much as I tried to avoid chargeback because the extra charge on the seller (to Roboguy it is nothing personal, just want my money back), it was the only choice I had to ensure I get my refund. Our request is perfectly legit unlike some chargeback scams some buyers do to seller. Don't waste any further time with Paypal, tried many times to no avail.
I will keep the members updated with my progress with my chargeback when I get further updates. As for now I'm just gonna relax and just observe how things unfold here.

I called up Paypal to follow up on my escalation and see if I can get a refund quicker and they wouldn't budge. The lady on the phone said their decision will be made by 21st of July or if seller responds till then. Like one of the posters above I said I have no choice but to do a charge back via my CC provider.
Edit: Raised a CC charge back with 28 Degrees within 5 mins for goods not delivered by agreed delivery date. Called paypal this morning, was told they cant do anything and if I no longer want the item I need to refuse delivery and get it returned to sender. Now I will be disputing the charge on my credit card.

Should make people think twice before placing too much reliance on Paypal protection and make sure you pay with a linked credit card for extra protection.We wanted to let you know that our shipment was supposed to leave the Yantian Port on the 3rd of July via the CAP ARNAUTI and arrive into Melbourne on the 15th of July, unfortunately we received notification late last week from APL and our supplier that due to the CAP ARNAUTI (Live Tracking) being overbooked ours and other people’s shipments were of the few that did not make it onto the ship. APL has rescheduled the shipment to leave today (10th of July) on the LENA-S. The LENA-S (Live Tracking) is scheduled to arrive into Melbourne Port on the 22nd of July.
We have been able to simplify how we will conduct delivery within Australia which will allow us to cut several days of postage time, this should hopefully make up for some of the days we have lost due to this unforeseen hold up. We are still aiming for delivery around the 26th of July, this will be a struggle, but we do believe for the most part we will be able to archive this.
Your 12-month warranty will not commence until the 1st of August 2017, so the delay in delivery has not intruded on your warranty period.

I think it will be in our favour if we all lodge complains with ACCC and to also ensure Paypal is aware of these complains.
Hopefully there will be enough complains or momentum for Paypal to action faster and in our favour as consumers so that we all can get our refunds and move on with our life, which I believe most of us are seeking.
I for one will certainly be sending ACCC my complain today and do hope many of you as well.
