        No, the IMEI number is the 'phone's ID. That is what they check. It reveals the place of first sale (in the case of Kogan HK Ltd. this could be China or the USA) and the date of activation. Also, the type of sale, such as from a carrier or from an Apple Store, or from a reseller.

      iPhones all come with 1 year international warranty so it doesn't matter where you buy it from. However, if you want the full 2 year warranty which is covered by Australian Consumer Law, then you need to buy from an Australian Reseller. Someone correct me if I'm wrong.

          @A3Australia: Actually, that is not technically correct. The ACL has extraterritorial application and can be applied to online retailers who carrying on business within Australia (see section 5 of the Competition and Consumer Act 2010). It just may be a little difficult to enforce against online retailers.

          However, if you read this article by Choice, the ACL can be pursued against parallel importers such as Kogan.

          The buyers of these iPhones are deamed to be the importers.

          They are being offered for sale by an overseas entity - Kogan HK Liinited.

          No GST is bring collected nor remotes to the Australuan government.

          This is a completely off shore transaction between the buyers and the overseas business.

          Extended Warranties are available for purchase for some Kogan HK Products, as listed on the Website. They may be purchased up to 14 days after delivery of your Kogan HK Products.

          We will carry spare parts for each Product for a reasonable period, which we consider generally corresponds with the length of the Standard and/or Extended Warranty period (1, 3 or 5 years as the case may be). Kogan reserves the right to refuse to supply spare parts where it considers the request to be outside a reasonable period and limited stock is available.
          11.4

          Nothing in these Terms and Conditions excludes the application of statutory conditions, warranties and guarantees.
          12. Liability

          To the extent permitted by law we will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise; and our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.

          For the avoidance of doubt, nothing in this clause limits or restricts Your ability to make a claim that may be available to You for Our failure to comply with a guarantee under the Australian Consumer Law.
          13. Intellectual Property

          All Intellectual Property in any Material on the Website is the property of KOGAN.COM PTY LTD. Unless expressly authorised under these Terms and Conditions or otherwise, you may not reproduce, adapt, modify, display, perform or distribute any Material or any part of any Material.
          14. Privacy

          By placing your Order or otherwise contacting Kogan HK, you agree that We may store, process and use data collected from your Order for the purposes of processing your Order. By placing your Order or otherwise contacting Us, you also agree that we may use such data, other than credit card details, in order to provide you with information from time to time on other KA Products or Kogan Hong Kong Products that may be of interest to you. You may obtain a copy of the data held by us concerning you on request in writing. We reserve the right to charge an administration fee for processing such request. If any data held by us concerning you is incorrect, we will correct it on your written request. Please refer to our Privacy Policy.
          15. Gift Vouchers

          Gift Vouchers & Credit Notes have a validity of 12 months from the date of purchase, unless otherwise specified at the time of issue in writing.

          Gift Vouchers & Credit Notes may be redeemed by entering the voucher code into the Gift Card field at checkout. Gift cards will not be refunded.
          16. Use of Kogan HK Products in Your jurisdiction

          It is Your responsibility to ensure that it is lawful to import the Kogan HK Products into Your jurisdiction and/or use them in Your jurisdiction. It is Your responsibility to obtain any permits for, or make any modifications to, the Kogan HK Products so as to enable them to be imported into or used within Your jurisdiction.

          Kogan HK reserves the right to make changes to the Kogan HK Website and these Terms and Conditions without notice. For the avoidance of doubt, any such changes will operate prospectively from the time that the revised Terms and Conditions are published on the website and will not impact any Purchase Contracts entered into prior to the date of the publication of the revised Terms and Conditions.

          In respect of any Order, certain taxes may be levied by the destination country to which your Kogan HK Products will be delivered. You will be the importer of record for the purpose of customs and border processing. It is your responsibility to determine whether any such taxes apply in your destination country for delivery or the country from which the Kogan HK Products are shipped. You agree that neither Kogan Australia nor Kogan HK is liable to you with respect to any loss, damage, cost, expense or injury you incur as a result your obligation to pay taxes in a particular jurisdiction.

          Title and risk in the Kogan HK Products pass to You at the point of dispatch or embarkation by Kogan HK to Your courier.

        Kogan HK Limited may source their iPhones from several different markets/countries. You may receive a USA market model. This would have to be returned to the USA for warranty exchange/repair and for any 'out of warranty' replacement. Same with any China/HK model etc.

        However, if you want the full 2 year warranty which is covered by Australian Consumer Law, then you need to buy from an Australian Reseller.

        Correct. Except that it is not a warranty it is a guarantee (Consumer Guarantee).

        I am thinking this was a WiFi only iPad? NOT one with cellular connectivity? It is only iPhones, and iPads with cellular, that do not (usually) enjoy the 12 month international warranty support.

        • No, it was a model with cellular connectivity. 1st gen though, maybe something has changed recently, idk, as my story happened in 2011.

          Four years ago, but same policy should have applied.

          I had heard about UK market model iPhones being replaced under warranty in Australia, and even a HK market model.

          Apple are usually very good in terms of replacing their stuff. My iPhone 4s once jumped out of car window on the road to Canberra and went straight under the truck.

          Front screen was ripped off completely, only about 5% of back glass panel remained, etc. I went to an Apple store in Chatswood and talked to the blue-shirt guy if they can recover my data from it. No, they couldn't due to the device status (no surprises here), but straight away he offered me a brand new one for just the $200 (can't remember was it $200 or $215) as I was still under the warranty and he considered this as a repair situation or something like this.

          Apple may restrict warranty service for iPhone and iPad to the country where Apple or its Authorized Distributors originally sold the device.

          So, I guess, it is all very random in terms of buying iPhone internationally because they can ditch you any time they want.

      I think you're right as when iPhone 6 was released the price of Samsung S5 was on special for a couple of weeks
      with the Ebay 15% weekend I got Samsung S5 for $486 from DWI and still haven't seen it that cheap since
      so I think Apple are giving it to Samsung for releasing the S6…… those companies are like Tweedle dee & Tweedle dum ;)

      I believe that is because it would be debatable (legally).

      Technically, these are second hand (not normally used) phones.

      They have been purchased from re-sellers, Apple Stores, carriers, wherever. Either by Kogan HK Ltd. or by a supplier to Kogan HK Ltd. Kogan HK Ltd and Kogan Australia are NOT Apple re-sellers.

      Note that some handsets have been opened and used in order to unlock them from their (USA) carrier.

    I asked Apple the other day about the guarantee for phones sourced say from ebay, and was told that the date of the guarantee starts from when it was FIRST purchased. Apple apparently has a website to check the serial number against the start of that guarantee.

      They check the IMEI number, but the serial number would give the same results.

      If the date of first sale is not recorded they use the activation date.

    16GB is too small. Hated Apple sells iPhone 6 with 16GB/64GB/128GB. Samsung doing the right thing for S6 with 32GB/64GB/128GB (but deleted SD Card slot…)

    I won't bother with 16GB without SD Card slot.

      I second that. 16gb on a flagship smartphone is ludicrous. You can't even enjoy the phone since you will always be keeping an eye on the amount of storage you have left and how future updates will further erode on it.

      $750-800 for a 64gb would be nice.

    I doubt that Kogan HK use HK Post to send iPhones from Hong Kong to Australia.

    It would be illegal to do so under HK Postal regulations.

  • Finally some good news, my friend bought a silver and a space grey and he just got it yesterday. Apparently it takes longer for rose gold to be shipped out as they are quite popular in HK. He also checked the IMIE number and both his new iPhone are brand new.

  • After reading these posts, I went on to the online chat with Kogan to find out where mine was. John P said that it would be dispatched within the day.

    As soon as I finished with John the phone arrived at my doorstep… But I never received an email confirming dispatch.
