No, you don't have to be a student to use this at all. It's simply meant for non-commercial use, i.e. if you're a small business then this is not for you, but if you just want to get the whole family using it then this is ideal.
Sure It's Not Cheating is a better deal if you're a student, but not everyone is and you do get the extra 3rd license with this. Both deals are good value imo.
if you're a student just google "itsnotcheating" - it will forward you to the cheap site for students.
i never understood this product.. why not get the ULTIMATE version direct from microsoft for $75? sure, it's only valid on 2 systems instead of 3, but it's cheaper and you get more programs and even if you want the physical disc it's only $14 extra (still cheaper than $99).
am i missing something?
