Gday Guys,

Just purchased some of these bulk and thought i would share. The freight charge is flat rate so on multiple QTY this deal really comes into it's own. Purchasing large QTY the freight cost is easily diluted however it is only $4.95 flat rate anyway. Has to be done through ebay listing to get discount.

    • If you had requested a refund through DS, they would have wanted it returned. So a PayPal dispute is the way to go.

      At least now you have a novel frisbee, dog toy, or paperweight ;-)

          My dispute took 1.5 days to settle. Money is now on its way from PayPal to my bank. I used consumer law jargon, which may have convinced DS I was serious.

        You posted an argument that we ALL had to return our tablets if we got a refund, based on a DS request YOU return your tablet.

        Support for that view probably comes from people who did not buy the tablet & don't understand consumer law!

        You now suggest we can't read that condition attached to our disputes. It's hard to read something that doesn't exist!

        To help people raise legitimate PayPal disputes, over a week ago I posted all correspondence (after raising dispute) with PayPal & DS just below.
        There has been no further correspondence from DS or PayPal.

        It's all down to the wording of individual disputes. You could simply compare your dispute with the model one I provided. The outcome was a speedy refund & no request to return.

    Add freezing etc if that was an issue. Don't know if colour will sway a refund.

    I got the refund from paypal. There is a note from Dicksmith asking me to return the tablet. Please don't think that you can get a refund and a free tablet.

      That's been the experience so far. Same experience reported by Chuppa
      Got my money :-) Still got the crappy tablet :-( It was so easy - if you approach the refund correctly.

      I never received a request to return tablet from DS. I did not contact DS, just raised a PayPal dispute.

      As I posted, if you request a refund through DS Online, you will need to return (& the refund will still be from PayPal). The merchant arranged the refund, rather than PayPal (as in a dispute). Failure to return the tablet to the merchant is likely to mean you will be invoiced again for the full payment, via PayPal.

      So I assume you requested a refund from DS Online, rather than the easier & recommended PayPal dispute. [My request to DS Online for an earlier refund based on failure to supply goods worth $5 took months, & they cancelled another order I wanted while arranging my refund!!]

      The email invoice from DS (-1 tablet) has been the only contact with DS, since the dispute was raised.

      PayPal email & account details posted above just show refunded, with no conditions. There has been no further contact - case has been closed.

      [Also, a refund based on a different colour to shown in advertising is not a valid reason under Australian consumer law, but a merchant may offer a solution. But as in my dispute, a different product (OS) supplied to that advertised, or not of merchandisable quality are valid.]

        I didn't raise a dispute through Dicksmith.

          Your first OzBargain post was you had to return the tablet, without a reason given for your refund request.

          Reasons already given by others for wanting a refund or replacement - unit does not work, constantly freezes, tablet delivered not as described by merchant, unresponsive, not suitable, wrong colour, etc - will get different responses by DS.

          But your "Please don't think that you can get a refund and a free tablet" went against experiences posted.

          As others got a refund & free tablet, I wondered if you had approached the refund process differently.

          As you had raised a PayPal dispute, but you say without contacting DS, I assume your reason for a refund must have been different, otherwise DS processed your dispute differently. (eg Contacting the merchant first as suggested in the PayPal dispute process will likely change the way DS responds to a dispute - requiring a return.)

          To help others, what was your reason for a refund request?

          If was not a valid reason under consumer law, DS would ask for a return as they are doing you a favour. I guess as mine & at least one other were valid under Australian consumer law, they did not ask for return.

          That's why I posted details above. It's all in the way a refund request is made. Of course DS are totaly within their rights to request the return.

          Thanks for clarifying the reasons for your dispute. Legal issues like this rely on wordy clarifications ;-)

          As I have already received a speedy settlement, the clarification is only to help others in wording their disputes with the merchant.

          Colour is not a valid reason for a refund under consumer law. The merchant does not have to do anything in that situation, but may offer to exchange or return for refund as goodwill. That is what DS has done in your case, which differs from others disputes.

          It was best not to complain about that, but strongly complain about the misrepresentation of the major feature in the ad - Android 4.1, which was not as delivered.

          If the merchant thinks the reason you raised anything other than you were dissatisfied with the colour in your complaint, just as supporting argument for a refund (rather than a potential case under consumer law), they would ignore it and offer a refund with return, based on your relatively minor dissatisfaction with pink. That was my advice earlier on how to make a PayPal dispute.

          DS broke Australian consumer law in this deal (misrepresenting the product) which carries penalties. I'd say those raising that issue along with the product was not of merchandisable quality, will keep their tablets. DS does not want action taken against them.

          This is no scam, just basic recourse under Australian law. I lodged a dispute never expecting anything more than a refund, and had factory reset & packed up the tablet awaiting return. As there was no request for return, it is still sitting in the box.

          I've won legal action against a business over a supply issue where no money changed hands. That case set a legal precedent. Believe me a crappy tablet, that has been left in my possession, was nothing compared to what a legal case & adverse publicity can cost a business.

          "you know it's not right" - yes, what DS did was not right under the law.

          If you had worded your PayPal dispute differently (as I suggested), you would probably be in the same situation as others - stuck with a crappy tablet DS does not want back.

          ACCC & State Offices of Fair Trading have booklets/ downloads of advice for cases like this. A quick phone call would have been advisable before lodging a dispute. You can't change it after it is lodged.

      Discussed DS not requesting return. Their opinion is…

      DS has left their property in my custody, and has 30 days to reclaim it.

      It's up to DS to request return & arrange recovery within 30 days of dispute resolution. Otherwise it is my property under law.

      That accords with my opinion, although I was not sure of the time limit.

      I have posted here that the unit is factory reset, boxed, ready for request to return.

      As there has not been and is not likely to be a move by DS to recover tablet…
      It's effectively free (in another 18 days).

    The box wasnt sealed, but it still had the screen plastic on the tablet.

    Has anybody else noticed a considerable lag? And if so, how to fix it?

    Do the right thing guys! You get the refund and you should return the item. It's fair and square. We are not promoting thief behaviours here on ozbargain Are We?!

      But your understanding of consumer & criminal law is lacking.

      This is not much different to OzBargainers ordering based on an obviously incorrect stock price. Some are lucky & get a great deal, despite little payment. Where was the moral outrage then ;-) While that's clearly not theft, it certainly hurts the merchant.

      Here we paid little & expected an underperforming tablet, but many got far less.

      It is also similar to supermarket pricing policy, when a scanned item is dearer than the shelf price, you get it free. (That kept me in food in my student days, but is far from theft.) If the merchant had done the right thing, there would be no need to compensate.

      DS incorrectly described the product for sale, and (for many at least) it was not of merchandisable quality, so a refund is required under consumer law.

      Not asking for return of pretty unsaleable stock is certainly cheaper than an ACCC case. (There are usually incorrect calls for ACCC action when people miss out on deals, but this case would fly, but possibly through state offices of fair trading.)

      DS were hoping to dump a lot of shoddy stock on us, so you might question who is in the legal or moral right.

      So the question "We are not promoting thief behaviours here on ozbargain Are We?!" is incorrect in its assumptions & better directed at DS.

      I'm certainly not advocating any criminal behavior (which it is not) in OzBargainers. I'm recommending use of consumer law. (I have set a legal precedent in one case.) It's just a rare advantage where a merchant stuffed up, and some may elect to benefit.

      If you lodge a dispute with PayPal, DS have not required return of device & do not provide any means of return, just an invoice for -1 tablet.

      Not returning (when here was no request to do so) under these grounds is not theft, under the law. It was DS that did not do the right thing. (Otherwise they would ask for the return!)

      If you walk into DS with the tablet for return, staff will not know what to do with it, so it is unlikely to be returned to stock. The tablet is not on their stock system, and their online system has already written it off (shown in the refund invoice).

      It is unusual DS didn't want the tablet back, but I'm not surprised given their misadvertising and poor quality of the device.

      However if you ask for a refund directly from DS, they provide a reply paid authorisation or free courier return with the refund. Failure to return would likely lead to a PayPal invoice for the full amount (currently $99 + delivery).

      Now fchis, if you had bought this tablet, are you saying you would refuse it for free?? If a deal were posted for this tablet for free, you would not be interested? Where's the revoke OzBargain membership button ;-)

      Would your opinion change if that tablet was sitting in front of you for free?

      (Of course everyone is free to come to their own opinion on what is "right", but it is a pretty relative notion. On OzBargain we see how those who get a great deal are very happy with the business, and those who miss out want retribution against the business.)

      No one here set out with any intent to defraud DS (your "thief behaviours"). It was an unexpected windfall for us, and a small penalty for DS. DS is just not asking for the return, if you lodge a legitimate PayPal dispute.

      BUT DS did set out to mislead consumers through deceptive advertising of this tablet, which is against the law.

      DS advertised this product with 4.1 Android OS, but units supplied had an older OS. DS was still doing so when I just checked this eBay offering, despite being informed of this deceptive advertising days ago!

      So everyone who bought this product is entitled to claim a refund under consumer law.

      Provision of a different product to that advertised is the basis of a legitimate refund. A free tablet may be a bonus for DS's (apparently - placed here for legal reasons) deceptive conduct.

      It is individual OzBargainers choice to take the easier route of a PayPal dispute with probability of a free tablet; or try the harder route of applying for a refund with DS Online (I've had so much difficulty with that in the past), boxing up the product & arranging & being around for courier pickup or posting it back in a carton.

      Easy refund and a free crappy tablet, or a lot of inconvenience & just a bad experience - your choice. I chose the easier PayPal dispute, even though I did not expect the tablet for free.

      Returning a deceptively advertised product without being asked to do so is rewarding the merchant for their wrong doing. [And I have owned my own businesses, so know what it is like to pay out for mistakes by myself or my staff.]

      I notice no criticism of DS for provable illegal conduct ;-)

    • Without a request for return by the merchant, there is no obligation. That has been the situation reported with PayPal disputes.

      If the merchant requires return, free return has been arranged, as per previous comments. That's in cases where a refund was requested from DS Online.

      But paying for the return of DOA products is likely to cost more than its worth to DS.

  • Still nothing on my PayPal dispute. I got a generic reply fro the DSE website saying to take them in-store, but due to stew balls experience I don't want to waste my time.

    Maybe its because I boutght 3, they think I'm trying to scam them or something.

      If you asked for a refund through both DS & PayPal, there may be delays due to confusion. Best to try PayPal first.

      A bit late for your dispute… as I posted, it is best to stress the delivered units were not as described (older OS) so deceptive advertising, and were not of merchandisable quality (DOA in your case). That's the legal language that motivates merchants to a speedy refund.

      [I've got a speedy refund from a business that my State's Office of Fair Trading told me off the record was run by the "mafia". They were impressed.]

  • This is ridiculous. DSE are still ignoring my PayPal dispute. So I went in store and went through the while damn process which took best part of an hour, only to find out that they cant refund them because they can't get in touch with their own online sales department. The guy did try though I've gotta give him credit for that.

    So what now? Should I just escalate the PayPal dispute to a claim? I'm not sure what else I can do. They haven't even bothered to give me any return shipping details, or in fact any response whatsoever via PayPal.

      Escalate! I'd say you have gone beyond what can be expected of a customer when the problem was totally of the merchants making.

      DS stores are separate from DS Online, which could be separate to DS eBay… organisations often have difficulty communicating between their separate entities. They don't seem to understand how frustrating that is for customers.

      Keep sane & good luck. If I see you juggling 3 tablets on a street corner, I'll throw you some change ;-) (I'm just very glad I got my refund so easily.)

        Yes. I escalated to a claim this morning, and within 2 hours I got the full refund. I have still received zero communications from DSE even about returning the 3 paperweights I bought.

          So another refund with no request to return. PayPal dispute is the easiest way.

      Of course buying through eBay with PayPal can be a way to get a free tablet, but not even worth it for free!

      • I was one of the lucky ones.
        I got white instead of the advertised black but I'm quite impressed with it.

        The Good:
        It plays 1080p videos and displays 14 megapixels photos with no problems. Youtube HD videos run fine too.
        PDFs and Kindle books are also fine. Of course the text aren't as sharp as the premium tablets but I was surprised you can still read the text.
        The OK:
        Surfing the net can be a bit slow but if you save it for offline reading it's actually quite good.
        The Bad:
        Angry Birds doesn't run smoothly and another app I installed had garbled graphics. Never bothered installing other apps.
        The mini USB port used to transfer files was also poorly made. You have to make sure your cable is inserted properly.

        So overall if you want a cheap tablet to watch videos, view photos, read PDFs, ebooks and view offline webpages then I would recommend getting this el cheapo $35/$39 tablet.

  • Got sucked in and bought two…. my mate bought two as well…. His both work but only one of mine does…. the other doesn't even boot up… DOA!!!

    With two kids, I really want a second working one…. SO I had to buy another one and then put a claim in through PayPal for the 2nd one….. Not impressed at all!

  • For those who got it to work, can you use Netflix on it?

    • Why would anyone watch it on a slow tablet with minimal RAM, which lags doing basic tasks, on a hard to view screen. There is short battery life & no Bluetooth for better sound, volume is low, so that leaves only the headset connection.

    I really don't understand why people are still buying these after people listed the problems with this unit & how DS has deceptive advertised these as having a more recent OS.

    For $49 my local Coles has (5pm yesterday) the dual core 7" PendoPad running Android 4.4 from memory rather than 4.0.4 of this crappy tablet. A much better, faster tablet with more features for about the same price. The quad core model 1MB RAM Android 4.4.2 may still be available for $59.

  • With all the problems with this tablet, and DS deceptively advertising it as a better model (a breach of consumer law - with penalties), it still has so many + votes. Even some who have returned it still show a + vote. That misleads new comers that this is a great deal.

    • After advising DS of their misleading advertising over a week ago, DS has not corrected it.

      Have reported misleading advertising by DS to Queensland Office of Fair Trading. They agreed it is misleading.

      They also suggested lodging complaint with eBay, as eBay is responsive to these issues.

      For those disgruntled by this deal, dispute with PayPal & complain to local Office of Fair Trading & eBay ;-)
