If the HDDs have never been used, you don't know if it's damaged or not. For all we know, they might be, and they are untested.
I assume that the 3 Years Warranty is still valid on these?
If they're physically damaged, I don't think they will honor it. But otherwise, yes it should still be valid.
I don't think it's that good a deal for products with the packaging damaged (and possibly their contents). I've seen similar deals for non damaged stock.

Warranty is still valid as it is only small rips and tears on the exterior packing

I don't think this is legal if the product is faulty. You may take them to ACCC on this.
Lol, when I return something from office works, they usually give me a change over one the spot, plus pay me the difference in the product (ie how much its gone down)
