          Incorrect.

          It's important that people are aware of the Australian Consumer Law and consumer guarantees, and the difference between the consumer guarantees and voluntary warranties offered by sellers/suppliers.

          Warranties are extra promises (verbally or in writing) about the quality or standard of a good, which could include what the good can do and for how long. Warranties are voluntarily provided by the seller/supplier, and Soniq could offer consumers a 3 year warranty, 1 year warranty, 10 year warranty, any other number of years, or no warranty at all.

          The ACL does not decide what promises they provide in their warranties, or what products they offer them on, or for how long.

          What the ACL does ensure is:-

          These warranties are always provided in addition to the consumer guarantees and do not override or limit consumers’ rights under the ACL.

          The consumer guarantees provide rights that exist despite anything the supplier or manufacturer may say or do.

          So if Soniq provides a 1 year voluntary warranty on a product that it previously offered a 3 year warranty for, that makes zero difference in terms of the consumer guarantees, including that the goods are of acceptable quality. Meaning fit for purpose, acceptable in appearance, free from defects, safe, and durable - they must function for a reasonable time (not explicitly defined) after purchase.

          If a good or service fails to meet a guarantee, such as acceptable quality, the consumer has rights against the supplier (and in some cases the manufacturer), who will have to provide a remedy.

          Understanding the difference between the consumer guarantees and voluntary warranties is important for all OzBargainers, and reading Consumer guarantees - A guide for businesses and legal practitioners is highly recommended.

              There is no rule that says that goods, or specifically Soniq A-Series 75" televisions in this instance, must reasonably function for 3 years after purchase. One may well reasonably expect that for this product (and I would), but unless it has been specifically tested and upheld in a claim then such a definitive assertion is not substantiated and not very helpful.

              Particularly if it misleads people into thinking that 3 years applies to all televisions (or all goods in general), when different products may be less than that. Or if it misleads people into thinking that the upper limit is 3 years, when the reasonable expectation for this product may be longer than that.

              Again it is important for OzBargainers to understand the consumer guarantees (which do not define what is a reasonable time) and associated rights, and how these differ from voluntary warranties. Read the resources (here's another) and be an informed consumer.
