NSW Police Caught Me Driving an Unregistered Car

Hello, I did my pink slip and green slip. I remember pressing the button to make the payment for rego renewal. However, I did not press the button "confirm payment" screen and got distracted (NO I am not making the story). I assumed that I finished my rego, while it was not :-(

Police stopped me and caught that the car was not registered. Within 5-10 minutes of offence, I pressed that "unfortunate" button that I missed.

All ServiceNSW rego renewal reminders were going to my junk email box. I never had any dramas in 16 years of my driving. I am depressed to hear that the fine cost is $820.

In this time of difficulties, do you know what I can do so that they can reduce the cost of this offence or cancel with the consideration of track record? What can I write or emphasis when I request to the authority?

Please be humble and suggest.

    If the fine was $200, less people would pay rego and take the risk.

    When it's nearly $1,000 for no rego, then double that for no insurance as well, people take notice.

    Junk mail or not, not pressing the proper button on the website or not, not paying the rego early enough to ensure it's definitely gone through or not, sounds like too many adult decisions on your part haven't been made correctly.

    You won't get a discount, just pay up and learn from it.

    Set a yearly reminder on your phone 1 week early, and pay the rego!
    Make sure you check its paid, and get on with your life.

    In 2006, I got done the DAY AFTER my rego expired and I was with a friend and I was literally GOING TO THE RTA (when it was called that) to get it renewed……. and the RTA was less than 7 minutes drive from my place yet the police pulled me over…… she wouldn't let me off as I got a 100% clean record and I got all my rego files to go to the RTA….. FML right?

    I find it interesting that renewals, once it's expired, all of a sudden it's a high risk illegal state. We all know renewing is just for revenue…… we all renew our drivers license yet no test are done to make sure we are still worthy to drive…… so when a DL expiries, all of a sudden we're criminals if we drive 10m, yet this thing called money to change a date makes us not….

    Your story doesn’t add up. You claim you didn’t submit the payment. i.e. you were aware that rego was due.
    Yet you claim you are blaming rego reminder going to junk mail.
    Pick an excuse and stick with it.
    Then pay the fine and learn a lesson.

        @howcan - It doesn’t have merit at all, it’s the OP’s email account and it’s not Service NSW fault or their problem that the OP’s email service provider identified it as junk mail and placed it in that inbox. I work for a council, people apply for residential parking permits everyday, some of them get rejected and we communicate this via email to the same email address the customer provided when applying, and sometimes the rejection email goes into their junk mail folder. Some customers assume that it was approved and they park in the zone thinking they have a permit to do so, then when they receive an infringement they complain that they didn’t receive the email… Our system automatically sends an email notifying the outcome, so we advise them to check their junk folder when they make the claim that they didn’t receive an email, and 99.9% of the time that’s where it is. If that’s what’s occurred it’s too bad so sad, that’s not a valid reason for one of our rangers to over turn/waive the fine, or Revenue NSW to do so which is who you need to argue the merits of your case with if you think it’s valid.

          • This assertion makes no sense, because the official registration renewal notice is posted via traditional mail from TfNSW, so the fact that the subsequent renewal reminders and expired rego alerts were going to their email junk box doesn't preclude the OP from being aware they had to renew their rego in the first place.

The only one out of the 2 of us who is making a goose of themselves here is you.             It doesn’t matter what the delivery method is, the customer claiming that they didn’t receive a physical letter is no different to an email. As long as Service NSW can prove that they sent the letter that’s all that matters. It’s not Service NSW responsibility to ensure that the customer receives the reminder letter, once it leaves them and is placed in Australia Post’s hands, so many variables can occur with postage causing the customer not to receive it… For example the postie may accidentally put it in someone else’s mailbox or it could have been stolen from the customers mailbox.

            The onus is on the customer to know when their renewal is due. As I previously mentioned I work for a council, and it’s no different to when a customer says they didn’t receive their rates notice, or their annual fire safety statement renewal reminder (which so many people don’t realise that this is essentially the equivalent of car registration for the property), or a reminder letter about pet registration. If the customer doesn’t action it when they’re supposed to that’s on them, whether they claim they didn’t receive the letter isn’t valid. It’s not our responsibility, it’s the customers responsibility to know their obligations and to follow it up with us, and no amount of whinging from the customer about not receiving the letter will change the outcome where we agree to waive the fine if we issued an infringement or applied interest/arrears fines to their rates to those who haven’t met their obligation.

The point being discussed was how the OP missed renewing his rego, no one ever claimed it was someone elses responsbility, and the OP never attempted to deflect their responsibility, they simply explained how the situation occurred despite the reminder safeguards being in place.

              The OP simply requested methods for the relevant authority to consider leniency considering the facts of the situation, they never tried to deny or escape their responsibilities.                 @Garry044: It is in the context of how it was meant on an online discussion forum, where there is no authority. The member I responded to has sloppy writing, and therefore if somebody misinterpreted what they were meaning and misunderstood them, then they should be questioning why that is and looking back over what they have said, rather than personally attacking other people who read what they have written and calling them dyslexic.

                I can only imagine what a formal official email would look like from member Howcan if they sent one to the council I work for requesting for an infringement to be waived, based on the members writing skills on here it would likely be poorly written drivel.

    If they stopped you and you would pay at the spot your registration, why wouldn't let you go? It wouldn't change anything as you still pay from the date of expiry, no date of the payment. Absurd.

    Take to court court, plead guilty and ask for a Section 10 on the basis that you've gone to the effort to get your vehicle safety inspection completed + paid to renew the CTP/greenslip (the two required steps to complete the renewal process) and you've failed to pay the rego tax due to user error on a computer.

    On the bright side, could have been a 3-in-1 combo.

    Not only the car is unregistered, CTP does not cover unregistered vehicle (even already paid in full), also, being unregistered means owing money to government (unless concession).

    A nasty cop could write up 3 tickets (or if you didn't pass the attitude test).

    • I think if you had comprehensive or just third party property insurance would of been void too. An accident would of been pretty costly.

  • Unfortunately looks like it was solely your fault. There could be cases where it wasn't your fault and happened to me once. I was doing a rego on behalf of my pensioner relative where rego is free. After CTP payment the rego screen said something to the effect of 'all done nothing to do come rego date it will renew automatically' and we left it at that. After 4 months they got a cheque in the mail for ctp refund so it turns out rego was not done automatically and the car was unregistered needing blue slip. Complained to SNSW who admitted system fault and their insurer paid cost of re registering.

    Whole thing was a hassle though as needed receipts to claim everything and they didn't give any extra compensation for running around and time wasted. Lesson learnt is to regularly check your rego on the website or app. Hopefully they have some kind of SMS reminder option now for expired rego I think it would have helped in my experience.

  • Happened to me, kind of. Was overseas in South Africa. Internet was patchy + close to dial up speeds. Managed to pay my rego renewal while there. Got home and payment wasn't made at all. My guess is it was blocked for fraud. Had to pay $360 to renew that month.

    Many seem to be focusing on the reminder letters prior to it being due and also advising when it was overdue as thought it’s actually important, when via post or email (whether it landed in your inbox or junk folder) regardless receiving a reminder letter is completely irrelevant, and isn’t a valid excuse to have the infringement over turned… The onus is on the customer to know what their obligations are and to keep up with the dates that their obligations are due, it’s not Service NSW responsibility if you forget, all the letters are is a courtesy reminder.

    If Service NSW sent a letter then they have done their job, you not receiving the letter once it leaves them isn’t their problem and certainly doesn’t shift the blame and responsibility on to Service NSW if you didn’t pay/renew on time. Car registration expires every 6-12 months requiring renewal, just like your council rates are due annually or every quarter on the same dates, or just like how an annual fire safety statement expires on the same date every year and needs to be renewed, or just like how it’s mandatory to register your dog or cat in NSW within 6 months of ownership, for all of this it’s the customers responsibility to have their dates and affairs in order and for them to be aware of what their obligations are and exactly when they need to be paid without needing to be reminded.

      It is my mistake, and I own it. Yes, I will pay as per the law while I explore options to tell my side of the story of how it has happened. I know human emotions are thrown in the bin and easy to abuse people over the internet these days.

      Ask your self a question when you have to pay 1000$ for a mistake that you did not expect you would make. It is common to have emotions coming out and you will explore why it has happened to.me. So this is what I am doing here!

      When I am delayed for council bill they don't charge me $800 penalty. They sent me reminders x times even after when I did not pay.

      I explained already that I paid for the green slip and pink slip yes I went to the rego but did not complete my fault. But what is hurting me 800$ it is not 200$ but half of my weekly salary after paying taxes :(.

      You will never understand how it hurts that penalties cost ($) are chosen based on what ?! How about if the penalty for speeding by +5 km is 800? Will you accept it?

      Mistake? Yes I did, I should pay. But the cost hurts. Hope it makes sense.

        Well to be successful you are going to need to present a valid case arguing the merits, “I didn’t receive the reminder letters” won’t do.

        If you don’t pay your council rates on time, once it’s overdue interest is applied and starts accruing daily, and arrears fines can be applied also. I didn’t only mention rates though, I also brought up annual fire safety statements, and pet registration, the reason I brought these up is because just like the significant fine you received for not registering your vehicle when it was due, hefty fines are also given out to people that fail to meet their annual fire safety and pet registration obligations on time. The penalties aren’t random, every customer is treated the same with regards to the rules and what their obligations are, and what occurs when they break them and/or don’t meet them.

        People call council everyday upset and angry about infringements they have been issued wanting to argue over it with the ranger who has given them it, claiming they’re innocent and it’s not their fault, throwing all sorts of excuses out there to try to get out of it (we have heard them all), not wanting to take responsibility. And these customers are straight away told if they believe they have a valid case and it’s a mistake then go to Revenue NSW and present it to them, and it will be reviewed.

The OP was well aware they needed to renew their registration, did you see the part where they were completing the payment process before they got distracted and didn't click a button to finish the button?         The point of my comments were:

        *The OP come here to OzBargain of all places asking how to get out of the infringement they received or how to reduce the amount, I am advising that their reasons they listed for not registering their car on time are invalid, and won’t get them out of having to pay the fine. I was also advising the OP that they would be wise not to listen to people like yourself on OzBargain who have no fooking idea, particularly when you were stupid enough to be pointlessly discussing and arguing with other members over the semantics of the reminder letter and where it went and the OP not receiving it, when this won’t get the OP out of paying the infringement. Not only that, you don’t even seem to be able respond to me without resorting to personal attacks, which further supports my point that the OP would be better off not listening to you regarding what they can do about their infringement.

        *Secondly, the OP is complaining about the fine being an excessive amount, which I disagree with by the way, and I mentioned annual fire safety statements and pet registration because the penalties a customer receives for not meeting their obligations on time for these are similar to car registration, and “I didn’t receive the reminder notice” doesn’t fly as a valid reason to over turn the fines for these either when the customer hasn’t actioned them by the due date, just as it’s not for car registration. If the OP wants to beat it they are going to need a better reason that’s actually valid. The comments about their obligation were simply telling the OP to suck it up and pay it, they have done the wrong thing, which they acknowledge, case closed.
