Dodgy Private Car Purchase, What Are My Options?

Hi all, I recently purchased a car from private seller on Facebook Market place.

In the ad it mentioned a number of features and extras (camping setup, fridge, solar panel, dual battery, ECT). In the advert there's multiple comments advising everything is in "working order" and has no issues.

Upon inspecting the car there were a few issues but nothing obvious. He also provided a RWC certificate that failed on two wheels though cleared on everything else. Upon replacement of these wheels I got another RWC which failed on multiple fronts, to the point the car should be sold for parts. The extras that were unable to be tested on the day due to a faulty second battery are all broken as well.

I reached out to the seller and advised him of the issues and requested we come to a reasonable solution of I sell the car to a wreckers and he compensates me a portion of what was paid. He's advised none of the issues were present on the day, the advertisement was accurate, and it's really not his problem.

I have evidence proving that he knowingly made a number of false claims in the ad and he's provided receipts of previous work further incriminating himself.

What are my options in regards to legal action I can take against him? Should I also reach out to the mechanic who completed the original RWC? Understandable if it's a live and learn experience and any advice would be much appreciated.

    I sold a car recently on Market place. I reduced the price heaps. To help buyers out I even got an RWC inspection that passed everything except two tyres. It was set up pretty well for camping too including fridge, and dual batteries and such. I had no problems when I last went out in it to the Grampians over Easter.

    Anyways the guy has come back wanting a refund or something!!

    Any advice on how to deal with him? He seems litigious.

    you probably went to the FBMP because you wanted to get a deal ,save abit of $$$ and cut out the middleman, but got more than what you bargained for. Thats why there is a premium paid on licensed used car dealers, whilst not perfect . trust and accountibility come at a cost.

      Trust and accountability don't belong in the same sentence as used car dealer

      • well at least you know who they are and can find where they live, and if necessary bring your goons along to make sure they meet thier end of the bargain.. never said the system was a perfect, but if you sell through consignment, then at least you won't have to deal with the worst humanity has to offer.

  • you got nothing, next time pay for an inspection and let this be an expensive lesson on trying to save a couple of dollars

  • keen to see the list. There is still plenty of judgement applied to a RWC. I had one fail my car due to a small crack in a boot seal then tell me they can get one for $900. I went to a reputable shop for the brand then and they didn't care.

  • Yeah, the seller set you up. So they showed a failed rwc, then said all it needs is two tyres, so get your own rwc. If they had got rwc in their name after failure (normal practice), then there would have been consequences for a dodgy roady. Have heard of inspectors having to fix mistakes they let through. You are covered for fraud so would get some legal advice. Especially with the accessories, looks like another set up.

      • Yeah was going to write more. If the op took it to like a lube mobile or chain mech, they will be strict and charge high prices. Better to have taken it to the first rwc person who failed it the first time. Get the "vibe" they are younger or a new buyer

  • Always do a pre-inspection check with a mobile mechanic before buying if private.

  • OP if you took it to a name brand mech, they go nuts,. seen rwc cost $3000, took car to import specialist and $250 with them
