Car Accident Debt Collection

I had a minor accident back in 2021. I was about to move into right lane, the other driver hit me from back side. My question is:

He straight away went to his insurance and sent me 9k bill just because of minor scratch. He put everything on me even though he hit me from back. Fortunately, my car got no scratch at all. Literally like nothing happened.

But at the time of accident in 2021, I had an insurance. Then I moved to different state. Now the ARL is just asking me straight away 9k bill.

I need your suggestions please as I think 9k is really too much. And not a single scratch on my car. Slight rub in the back side, but I cleaned it with cloth and hot water.

So how can I approach my old insurance company and make them pay? Obviously I can't pay that much.

    If you had insurance, why didn't you go to your insurance company at the time of the accident? Unless you only had compulsory third party and no third party property insurance

    Furthermore, just because there's no visible damage doesn't mean there isn't damage underneath.

      I had comprehensive insurance. My question is if I contact my old insurance, then it will help?

        How are we supposed to know? We're not your old insurance company. Maybe actually try contact them and ask?

        Furthermore, this $9K could also include hire car costs.

      He had insurance with a company, now he does not. Hence, "old insurance company". What do you mean by "which is it?"

      • Why didn't he/she contest the other driver's claim back in 2021? Moving interstate doesn't negate dealing with the issue - it's not as if they have to physically attend their insurer's offices in the state they used to reside in.

    You’re now dealing with the insurance company, who have huge resources both legal & financial. The fact you had insurance and didn’t follow through now after insurance has lapsed-doesn’t leave you many options.
    If this is on Dash-Cam you might have a chance.
    You should have pursued this while insured.

    Call them, lodge a claim on your policy for the time you had it. Pay the excess, Send them all the paperwork you have that shows the accident date was during the coverage.

    Job done.

    Even though you no longer have insurance with them, they still cover you for the period you did have insurance with them.

        You said you had comprehensive insurance, but then say the insurance company isn't cooperating with you? Doesn't make sense. Why wouldn't they co-operate with you? Were you not legal to drive (e.g. drink driving) at the time of the accident or something?

          Oh man, I explained you earlier. I mean that I am in different state whenever I call them they direct me to other customer representative and sometimes hold my call for longer time. Just not coming straight to point. I was and I am legally driving.

    Can you be clearer in terms of timeline?
    So they lodged it with their insurance straight away following the accident in 2021?
    Did you respond or ignore communications until now?
    Did you take photos?
    Do you still have any policy documents with your old insurer?

    Also, it doesn’t matter if your scratch “rubbed off” and theirs cost 9k to repair, the party deemed at fault will have to pay. Insurance (if you did have it) will sort it out, you will need to pay the agreed excess if you’re deemed at fault.

    • I am ready to pay access. I have email proof as well which I sent to my insurance in 2021 with attached receipt (sent by other party). After that, I moved to interstate regarding work.

    Why did you not deal with this in 2021? Did you just think it was going to go away?

      He probably tried to dodge the excess fee thinking if he ignores it it will go away. IMO that's why his insurance company at the time denied the claim.

    Just give the claimant, your Insurance company's detail (at the time of the incident) and let them deal with it.
    Thats what insurance is for. even it is an old claim

    If the accident happened in 2021 and the OP said the other party acted with his insurance to claim $9k, what has OP been doing all this time?

    • By the sound of it they ignored it and hoped for the best.
      They’re also being really vague about the details as well and haven’t answered any questions clearly.

    A few questions before I can answer your question:

    1. In that incident, were you at fault?
    2. Did you contact your insurance company at that time and paid the excess? I'm emphasising on PAID not ready to pay.
    3. Can you screenshot us your email trail between you and your insurance company at the time?
    4. At this stage, what does your insurance company in 2021 say before this? Give them a call rather than wait for an email.
    5. Do you wish to settle this or ignore it for the next 7 years?
