Faulty Nike Air Max 270 Sneakers

Hi All,

Just checking whether I am being reasonable demanding a full refund of a faulty pair of shoes that lasted less than 3 months?

This is Nike AIR Max 270 with a hole on a side and a popped air bubble (not on pictures though).

HYPE DC store (Werribee, Melbourne) staff are being useless wasting my time calling a store manager on the phone and unable to provide a written response regarding the complaint. Shall I stop wasting my time and go directly to ACCC?

    As you should have tried everything in the linked post and therefore the only place missing is the ACCC if you think it is the right place to complain further.

  • Did you try contacting Nike direct as suggested in the thread you linked?

    • Nike support suggested to go through store (HypeDC) the first and then contact [email protected] which I am doing right now.

    ACCC are not going to take individual action for you specifically, they collate feedback and investigate companies on a larger scale.

    You'll want to contact Fair Trading instead if you believe you have a case. You'll likely need to prove it's manufacturing issue and not wear and tear though.

    Might be easier to just try another store first and hopefully get someone else more helpful before you embark on other routes.

      Well, HypeDC says it looks like a wear and tear - 6 weeks since purchase.
      Subject to elusive manager to confirm ….

        1 - Go through HypeDC with a written response for recourse. If they reject the refund/repair … step 2
        2 - Write a letter of demand - First step and see what they say
        3 - If no luck then you can go to VCAT - for a fee

        But I reckon they should come up with a remedy for you. If you have the receipt proving the date of purchase

  • Looks like you've caught the thread on a sharp object causing it to tear. I've experienced similar damage with my NMDs.

    Or the damage was present before you purchased them?

    What have you done to the shoes that caused this damage that you aren't telling us?

    If you get a shirt caught on a hook and it rips in half the day after you buy it, you can't expect a refund.

    Looks like it has been burned to be honest. Something looks odd.

    But I am giving the benefit of the doubt, similar thing happened to my ultra boosts where the big toe is. Just sewed them back up because couldn't be bothered getting the run around.

    Looks like they've had a hard life.

    Even the 0 of the 270 has come off.

    Any pics of the sole?

    • No pics for now, left them for the store manager to check.
      It looks like a hole on the worn off surface right on the air bubble.
      Which is annoying because bubble burst and the shoe is getting tilted to a side.
