I bought $350 value item on Kogan and it was delivered to a wrong address by Amarex who confirmed that tracked GPS showed a wrong house (I also have their proof of photo and email to a wrong address as well as my security camera footages showed no delivery on the date/time they claimed they delivered to me).
I contacted Kogan to ask for refund, they refused so as they claimed it was left their warehouse to deliver to me so they wanted me to fill up a Stat Dec to say that I did not receive the item but with a harassment tone in the end "Please understand that making a 'false declaration in a Statutory Declaration is an offence under the law, and will attract legal ramifications if this is identified to be the case."
What is my consumer rights here if I do not want to go do the Stat Dec? They can't just make a claim against Amarex instead asking me to do that?
Updated: Kogan has agreed to refund me after the person who received it contact them to return the wrong parcel. Will not do business with them
Beyond the hassle and poor customer service, do you have a problem with providing the stat dec?
While I personally think it's ridiculous, it may just be your shortest road home here.
