My Swimming Pool Is Non-Compliant. Need Specialist to Fix It

Hi guys,

Are you aware of any company in Sydney who can help me get compliant with the swimming pool issues I got with the recent purchase of the property. I am currently looking for quotes and can provide the non compliant details to the company or tradie.

Would appreciate some recommendations.

      Fence, height of the fence, doors having access to swimming pool, climbable objects close by etc

      • Perhaps get a fencing company to look at it and see if you can make a small ring fence around the pool to enclose it at thr right height.

        I'm guessing you inherited an old build and now the grace period has expired.

          I thought old owners were not allowed to sell a property with a non compliant pool.
          Oh, this is what I found for VIC: "When selling a property, a vendor is not currently required under Section 32 of the Sale of Land Act 1962 (Vic) to disclose whether its pool is compliant or not."
          What shitty laws.
          And this from some law firm webpage: "What Happens If The Relevant Certificate Is Not Attached To The Contract?
          If a prescribed document is not attached to the contract, then the Purchaser may choose to rescind the contract within 14 days of the date of the contract. In this case the deposit will be refunded to the Purchaser."
          Yeah right, the usual "You can rescind the contract"

            For NSW you can sell with a non-compliant pool, you just have to disclose it.

        You didn't even bother to state what the issues are or where you are located. No point suggesting a swimming pool pump specialist based in Darwin if you have a fencing compliance issue in Perth…

        Also, it doesn't matter what experience others have had as it may not reflect your own. Call at least 3 local companies, get quotes from each and go for the one that gives you most confidence, explanation and reasonable pricing.

    • Most hits for "Swimming pool company <myarea>" will not help as you need to add fence. Most pool companies look after pools w.r.t. cleaning and simple repairs, not installing tpools or fences.

      Another thing to search for is fencing companies as most of then do pool fencing.

    I had a similar issue 6 months ago (but in QLD) and had to get a compliance certificate.

    a pool shop won't help (well, I rang the 4 local pool shops in my area and they all said I need a compliance person - they just do pool maintenance and parts)

    googled "pool compliance <insert suburb> and then rang the places listed to get the cheapest price.

    the cheapest person was $140. - always make sure they include a second visit in their fee .

    they came out, checked all the safety requirements against the checklist., and then provided me with a list of stuff that had to be fixed.

    I had 7 issues - some really minor - that had passed the compliance test 3 years earlier when I bought the house.

    but anyway, I could DIY everything so I asked the guy to come back in a week, so I could fix the issues, and when he came back he certified the pool - form 23.

        The council did a surprise inspection and found things weren't to code. They gave me 4 weeks to get it sorted.

    You do t need pool engineering, you need a little help with your pool fence.

    Since you just bought the property did it not have to come with a compliance certificate? It may vary by State though…

    If you have a house door which enters directly to the pool…remove it replace with a window…..if you have windows which open to the pool….remove the ability to open the…….fence to low….buy a new fence………….things which are climable near the pool………..remove the climable objects

    • Not that easy. Just to fence our pool we submitted a total of 10 emails/forms/queries, 3 came out to check, and just made a basic quote, who would allow them ample margin in bolstering final bill. so we got a reference from friends.

      • so you managed to get a solution which sounds reasonable and simple - the thought process…not the actual achieving process but

        all contractors will (profanity) you around if your job is small and/or fiddly……its a lot of effort for not much reward

  • It all depends what you need doing.

    Glass fence the issue? Probably best with a specialist pool fencer.

    Non-glass fence the issue? Can probably us any reputable fencer.

    Issues with trees/shrubs in/adjacent to the pool area? Gardener or landscaper will be your go to.

    So and and so forth …

    We had an issue with local council enforcing requirements, and the pool has been at the property prior to us moving in which was 15 years. We just made the fence compliant with Newcastle/LGA requirements. We simply moved, and lifted the fence. We had to buy new Poles from Bunnings, as well as Marine grade Anchor Bolts. Saved a few $thousand Dollar$ in the process. Tools used included :-
    * A Rotary Hammer Powered drill
    * Angle grinder (with Discs suitable for Steel)
    * Impact Driver
    * Reciprocating Saw (with Blade suitable for Steel.
    I had all the tools already, but borrowed the Rotary Hammer (A hilti?) from a friend.

  • As most people have said, you're going to need a fence man, nothing really to do with swimming pool repairs

    I had something similar, when i wanted ot rent out the house I needed a Certificate of Compliance. I then found out that when i had extended the pool fence (and had simply copied the height of the pool fence) that the height was about 5mm too high. They were SUPER pedantic

    Question: why do you want it to be compliant? If you're living in it, these are scarcely safety risks. Just fix the "can climb over fence" issue, and that should be fine. If you're renting it out like me, then yeah you're going to want to get it all fixed first. At $50 per visit for the council's pool inspector, it can add up if you need to keep fixing things.

  • As you have a range of issues you may need a fence company AND a landscaper or builder or perhaps a handyman.

    Learn what the requirements are, do your own measuring and checking so you can be sure what you want to be made compliant is actually made compliant.

    Our pool had similar issues. Fence too low, climable objects. I shifted one section of fence away from the gas meter so it complied. Had an air conditioner unit lifted to top of the wall instead of on the ground. It didn’t occur to me the AC unit was a problem until a friends kid used it to jump the fence. I also adjusted a couple more sections of fence for height and replaced the gate latches and hinges. All DIY except the AC unit. It’s not difficult digging out an old fence post and installing a new one with a bit of rapid set concrete. Council inspector was not at all concerned about the collapsing low boundary fence as it back onto a neighbours properly fenced pool area.

    any pool fencing company will do, it just needs to be a fully enclosed fence that is a certain height with a child safe gate on it, and not built near climbable objects, just ring around and get the cheapest quote, they will know what they are doing
