                  • @gadgetguy: Well, because of non-return fee. At lease I return something.

                    • +1

@j00828: You will be charged the same for non-return as for a "wrong device".

                      • @gadgetguy: I know I will, and I am happy to let them charge the Trade-in value, but not other fee.

                        • +3

@j00828: What other fee? They only charge 1 fee. There is no point in intentionally sending a different phone back as they will charge you the same fee whether you send the wrong phone back or don't send a phone at all.

              • +4

                @Ashmit: And clause 5.2 states………

Once the Samsung Trade-Up App confirms that Your Existing Device Qualifies for the Program, in consideration for the
supply of Your Existing Device, You will be advised of the discount that You will receive off the Purchase Price of a New Samsung Device if You purchase Your New Samsung Device Online and trade-in Your Existing Device to Us

When I ran the Trade-Up app the discount I was advised of was $25 not $525.

    • Thanks

It's been more than 14 days since the deal started and the clock started ticking to send trade in phones back. And we still don't know what will be charged for non return?!!

    • —snip—

    • +12

I have discussed with someone who has outlined that the Terms of Service have not be adequately updated to reflect this promotion for use in Australia, and they have agreed that the terms are ambiguous, however that all responsibility for fees lie with Samsung's subsidiary, Asurion.
I have received definitive information from Samsung that they will not be the one to process any non-return fee, I am waiting for this in writing. All fees are charged by Asurion.
Correspondence with Asurion(read: Akshit) as clearly indicated previously by other members of the community that the promotion value applied will still remain, you will only be charged the device value as a non-return fee.
Under Australian Consumer Law - all you must argue is that due to the contradictory information provided prior to purchase of the device, and the unclear terms of service, any charge-back would be a breach due to providing misleading information/ terms.

The Terms clearly specify: "discount at time of checkout", which would be $500 + phone value. However distinguishing between the non-return fee, the ineligible device fee, or the mis-graded device fee is impossible in the terms; for the terms to be valid - they would need to charge the total amount back to each customer for each device from each category used for purchasing - which would be a PR nightmare due to the frequency they run these trade-up campaigns.

In summary, the information I personally received prior to purchasing the phone from Samsung directly was: "You can keep the promotional value, direct all further queries to Asurion", and the information I personally received from Asurion was: "You can keep the promotional value, and you will need to pay the non-return fee, there are no additional fees charged by Samsung."

So, in any case, I am confident that I will not need to pay any fee.

      • awesome summary..

      • +4

        Judge Judy has spoken

      • With such ambiguous terms and conditions, depending on individuals intention either some would see it as an opportunity to get $500 off by declaring their physical phones are in good condition but in reality not always the case which upon physical assessment the device would deemed as mis-grading hence didn’t return it and/or want to keep the old device or sell it at higher price.

      • +1

Yes, that's what I got from Samsung and Ausirion AKA Akshit!!! No extra fees, bonus $500 value, bonus vouchers including $200 and $50 will be deducted if you decide to keep the phone. Only a non return fee will be charged. Besides neither Samsung's nor Ausirion's T&Cs doesn't clearly mentions about charging $500 bonus, so we all need to stop discussing this and start enjoying the damn phone!

        • can we please keep on discussing it? :P

          • @U30004: Yeah we should, otherwise where's the fun in that.

            • @IpGem: lol, yaaa

            • +1

@IpGem: I have been so caught up in this discussion that I havent even got the new phone box out of the parcel it came in 2 weeks ago

      • In the Samsung T&C it says they may preclude you in the deal for non return etc… I wonder is it possible that they may preclude you for the trade up deals in the future?

        • lol, why would they want to give people a reason to not buy their phones?

  • Would love a PM with anything you get in writing. :)

  • We're all waiting for an update with bated breath for the penny to drop!

  • Guys the promo is back but only $400 discount now instead of $500.

    • It said up to?

    • From the bottom of the page:

      Additional discount available on Galaxy S21 5G ($200), Galaxy S21+ 5G ($300) and Galaxy S21 Ultra ($400) from from 5:00pm (AEST) 12 April until 11:59pm (AEST) 29 April 2021 unless withdrawn earlier.

      • But the phone price gone up a lot, not a deal anymore.

        • Yes, unfortunately. Let's see.

          • @SpaceNinja: Also there is no additional trade-in discount at partner stores so far as well.

        • also tradein value has dropped on phones

    • +1

Just tested it and if you have the previous $200 code from support you can stack it as well.
I put it all in and got $600 off + the amount for the trade-in (for me being a rubbish $35 on an S10+ with a cracked back), total price was $1314 on an S21 Ultra 256GB
I haven't tried adding the $50 sign up credit as well however.

Also note that Samsung has removed the discount from the phones themselves, so not as good as the previous deal.

      • I got mine blue 256gb for $580 2 weeks ago. :-)
I dunno of $1314 is such a good deal

  • I am in call with Samsung. They say that we will be charged for trade in value plus $500 discount. I said to him that yesterday I was told that I will be charged only trade in value. How come you have a different stance today. The guy said that we apologise for the misinformation passed to you yesterday but we have checked now that we be charged trade in value Plus $500. I feel its better to return the phone.

    • I think the real answer will come when people start posting about the charges they get in the next 2 weeks or so. Luckily my S21 Ultra is not here yet so i can wait and see the outcomes as if i can, i will defo keep the S20 plus i have and let them take the $375. I could easily get $800 for it right now

      • Yeah but you got $875 for your S20, hence good deal.
They're not retards down at Samsung, they're running a business. They will get their $500 one way or the other.

  • So has Akshit actually given anyone labels and responded to a reply?

    • Yes, he gave me 2x labels on seperate occasions for 2 seperate orders, didn't get it automatically had to request from him.

      • What are labels and what did Akshit gave?

        • Auspost return labels, that you take to the post office and they scan it and give you a box to send it back in.

  • Mail from Samsung which aligns with the old link. That mean they have full right to charge.

Greetings from Samsung Australia Online Store!

Due to the recent release of the Samsung Galaxy S21 series, we are expecting an influx of inquiries. It may take us

6.2 You will also need to enter valid credit card details into the Samsung Trade-Up App, which only

    Your credit card:

    (a) a Device Non-Return Fee if You do not return Your Existing Device to Us within seven

days after the date on which You receive Your New Samsung Device.

payment of Your In-eligible Device Fee, Your In-eligible Device will be returned to You.

    Kind regards,

    • But i used a debit card on both my trade ups

    • +2

None of these deal with $500 promotional bonus which is different to trade up discount. I only authorised my credit card to be charged for trade up value (i.e. value of the phone) and no way they can charge more than that without informing me or seeking my consent. I trust the written messages from Samsung agents and Asurion over discussion on a call, unless you post the recording here.

      • -1

I agree with you mate. But If you refer to the link, they have full right to charge the amount as Non Return fee

Device Non-Return Fee means a fee which is equal to the amount of the discount You received when
Your unique Trade ID was applied at the point of sale when You purchased Your New Samsung Device
Online in accordance with clause 5.2 of these Terms and Conditions.

        • +3

I got in touch with them due to the fact I didn't receive a return label and will be unavailable due to an interstate trip for some time (no, not taking my old handset with me!).

I notified Asurion and Samsung about it.

All I got in return was an email from Akshit that outlined that in case of non-return I only will be charged the quoted trade in value (same email a lot of people got here, and didn't address my original question about missing labels).

Also, the $500 bonus got triggered by entering a trade up ID, not by returning the device (would be a cashback rather than upfront bonus).

Also, the invoice has the following listed: Your trade in discount plus your $500 trade in bonus has been applied.
So Samsung itself says that there is a difference between the trade-in discount and the bonus.

        • @ashishmittal80 with this logic they can charge you back the 200 dollar promo code discount as well. that was also at point of sale discount

          • @U30004: don't forget the $50 sign-up bonus

            • @dragonos81: yes and them precluding you from ever buying a samsung again.. EVER

              • @U30004: I doubt that could happen, they can't really identify a person one can always use another account/name. The best samsung can do is prob ban the card if used as payment but I doubt they would bother.

                • @Meovel: yes, I was being sarcastic :P

                  just adding to the paranoia

        • +4

Everybody who quotes this part of the T&Cs forgets to follow up on the "in accordance with clause 5.2" which defines the figure in question as that received when you ran the Tradeup ID app. That figure did NOT include the $500 discount.

    • I use debit card as well. That mail from Samsung say nothing about $500 bonus.

      • Refer to statement above mate. It says Amount which was discounted when trade id was applied. Which was Trade in value plus $500

        • Well, we have to just wait and see.

        • +4

Samsung has numerous time stated that they are not part of the $500 bonus as that is 100% managed by Asurion.

Asurion also then confirmed that upon device non - return that you will only be charge trade in value with promotion of $500 to remain as is (from Akshit emails)

          • @yontk: In every single chat I had with Samsung I got redirected to use Asurions email address for all enquiries.
And Asurion mentioned that only the quoted trade-in value gets charged and all promotions are unaffected - even though I only requested a return label and asked about the "worst-case" scenario of non-return.

Overall, a bad experience with Samsung / Asurion. There seems to be no communication between them and also staff seems to have received no training regarding the promotion.

        • Is that you?

            • +2

@Ashmit: just relax mate, if you think samsung are going to charge you 500$ then send back your phone to them.

  • This is going to turn really nasty … real soon. Well played Samsung.

    • I actually want to send my trade in phone in and the only response I've received after emailing them was to use the post label… The one that I said in the email I had not received.

It's obvious that a number of people are contacting Samsung, so they have to be aware that many have not received any trade in information and don't know what's going on. It's not rocket surgery to give an update to their CSRs so every caller or email isn't getting told something different.

      • I got a label in the same day after I emailed the samsung trade up inquires email.

Maybe your status has not been updated to delivered.

  • Just received this email for my S7 trade in, I don't know what physical condition doesn't match, may be a very small unnoticeable dent at the corner?

"Thank you for recently placing a Samsung Trade-Up order. After inspecting your original device, our team has determined its physical condition doesn’t match the details entered when you completed your Trade-Up.
As stated in the agreed Samsung Trade-Up terms and conditions, we will be charging your nominated credit card $15. "

    • +2

Will they be returning the phone to you? Because this is starting to sound quite sketchy with all these denied claims…

    • Whoa… it started to sound like they are expecting a brand new phone to be posted back to them? Seems really dodgy that they get the free phone and also money from you.

    • so would you be charged 15$ or 15+500 as device didnt qualify?

      • so would you be charged 15$

I assume only $15 because I did send the trade-up phone back. I will email them to ask them what physical condition doesn't match.

        • Technically thats no different to not sending

        • Well as per other ozbargainers, if you phone has become ineligible for trade up due to condition of the phone, it is same as not sending phone and becoming ineligible and to be charged $500?

They are trading phones as old as $10 trade up value and you cannot expect that old phone to be that perfect.

    • How much was the original trade in value? $15 or was it more and they only deducted $15.

      • +1

On the email it said will only deduct $15 trade up value.

    • +1

I'm in the same boat. Same phone, was denied even though I thought phone was ok. Some small scratches but nothing that loos abnormal for a phone with 2 years use.

April 1, I was told phone was no good and they charged the same day only $15. Nearly 2 weeks later and I haven't heard anything regarding further charges from either Samsung or Asurion.

      • Did you ask them to post the phone back? I emailed them a photo of the phone, box and the return label asked them why what was wrong with the phone.

BTW they have also charged $15.

        • No I didn't. I was happy to lose the phone and be charged $15 as I wouldn't ever use it again anyway.

If they attempt to charge more, I'll take it up with them.

Curious though to see if they would return the failed device.

If they do decide to do further charges - wow what a PR nightmare.

      • I'll be sending my Note 8 soon. It too has a few small scratches etc. but not cracks. They offered $125.

If they quibble and charge me a significant amount I'll be raising a credit card dispute and supplying pics of the condition of the phone when I sent it. If they deduct a nominal amount I'll be okay with it.

Has any one issues with sand dung claiming they never received the phone? My wife just got emails from them saying they have still not received the phone and threatening to charge her for the non-return fee when we have evidence that the engine was lodged at Australia post and the tracking details show that it has been DELIVERED.

    • +3

Wouldn't stress. If you have confirmation it's delivered, just lodge a charge back with your bank if there is any further charges.

    • +1

Just send them the receipt of your delivery as proof.

    • Thanks guys. Yeah we have already emailed Asurian with proof of lodgement and delivery screenshot via AusPost tracking but haven't heard back yet. They gave us until today to send in the device but they have still not responded or confirmed receipt.

Will definitely be getting the bank to kick a fuss with Asurian if they do charge my wife.

Oh and just realised I typed sand dung by mistake.. rather fitting though in this instance.

Got a reply back from Akshit blaming covid delays with auspost but that is absolute rubbish. The email was sent on 13th April. Package was delivered in 8th April.

After hearing all the event, asurion is either rejecting tradeup promise, or not even acknowledging delivery. I decided to closed credit card used for trade up app. Purchased phone from Samsung with different credit card. Waiting for invoice from asurion now. Will update.

    • Hi,

We hope you're enjoying your new phone. We are yet to receive your original device which you agreed to return as part of your Trade-Up order. (If you've recently returned your device please ignore this

If we don't receive your device within 7 days of this email, you may be charged a non-return fee of up to $90.

The details of your Samsung Trade-Up order are:
      Samsung Trade ID
      SA
      Original device Trade-Up value
      $90
      Original device
      APPLE IPHONE 7 128GB

      Will update guys again

      • So there's no mention of the trade-up bonus?

    • I'm waiting to see what they do with me as well.

My bank moved me to a different CC a day after I submitted the trade-up as the card I had will cease to exist soon.

I don't intend on returning the trade-in (S10+) & will happily pay the $275 they quoted it was worth & sell it on Ebay. They have my email & phone number so I'll wait to hear from them….nor going to bother trying to contact them

I know peoples been tells different story about the Non-return. Here is mine this morning.

Sent my S10e back two weeks ago, got the obligatory 7 day and 48 hour reminder emails even though Australia Post tracking showed delivery. Finally today (21 days later), received the "device is not the the same physical condition" email - it had two small (under 2mm) chips on the left hand size, but otherwise works perfectly with no screen issues or any other damage. I considered those two tiny chips to be fair wear-and-tear, but they have dropped the trade-in value from $175 to $5, and are going to charge my card $170. I've responded asking them to charge $175 and to return the phone to me.

People who didn't send their phones back in probably did the right thing.

    • Wow! Do you have a photo of the tiny chips? Were these on the body or the glass?

      • Both on the body, glass was perfect. Didn't bother taking any photos, unfortunately,,but I will if they send the phone back

    • Better keep it as space phone or sell elsewhere. They quote me $285 for my as new note10. I sold it on eBay for $475.

    • Do they send the phone back to us if they feel it does not qualify.. I have couple of minor chips where paint has come off near the S-Pen port of my note 9.

  • +1

A lot of people saying that Asurion are assessing the traded in phones as non compliant. I'm thinking this might actually be the way they recoup the money from the customers. There is nothing in the T&C's about them cancelling the trade in and paying for postage to return the phones.

    • So they are trying to get free phone or cheap phone from the deal.

Just wondering anyone here returned a perfect phone but still get that email?

      • my brother just got the same email, and the phone was perfectly fine.

'determined its physical condition doesn't match the details entered when you completed your Trade-Up.'

        S9 64gb and charging $95

        • I guess we going to see lots of this.

        • Just chat with Samsung online they asked me to call "They can be reached at 1 300-362-603, option #9."

          • @superforever: are you calling to inquire about the phone condition or the return?
