Can I Contest a Speeding Ticket in WA?

Hi, I'm new here but have a question about 2 speeding tickets I got within two days.

The tickets are in the same location (Mitchell Freeway and Erindale Rd).

I was driving two different cars on the different days (one a very small, 13 year old car, and the other a small BMW).

The reason I even contested the tickets, was because they both claimed I was speeding the exact same speed in those different days (the ticket claimed I was going 106 on a 100 zone).

I feel it is statistically very unlikely I was driving two completely different cars, on two different days and speeding exactly at the same speed….It just did not make sense to me, especially since I make a point now to put on the cruise control on the BMW.

Then on top of that, I get the paper work and the summary of the offence to go to court which describes the incident…. quoting here "The vehicle was detected by the device to be traveling at 109 Km/h. Speed alleged 106 Km/h. Speed allowed in this area is 100 Km/h."

Could this be a camera error? set up wrongly?

Is it worth fighting it?

    Unlikely to you, but quite probable when you crunch the numbers…

      I agree. Driver would have been somewhere between 90 and 110. So that's a 1 in 20 chance of doing the same speed. I would love those odds in the lotto.

    I don’t know hey, “statistical unlikelihood” isn’t a very sound argument.

  • It is probably worth taking with a Lawyer experienced in Traffic Law.

    Sounds like you have already started contesting the fines, by opting to take them to court.
    Of course you have the right to contest the fines. And the legal system will make a judgement. And you will need to comply with that judgement, or appeal it to a higher court (if allowed).

    I would suggest this is entirely likely, especially if it is a road you travel frequently. I would imagine that on a familiar stretch of road you likely drive at a speed that is basically identical from one day to the next without even noticing the speedo, certainly within a very small range. Once you accept that you are likely travelling within a very small range, the probably that you are at "exactly" the same speed increases dramatically.

    Of course. Will you be successful? Highly unlikely.

    Guys I need your help,

    The Crown alleges that I murdered 2 people in 2 days with the same axe.

    Given I have a mountain shed full of Axes, I find this quite improbable.

    Could I get the charges dropped?

    • That is crazy talk. Obviously you aren't going to use the Monday axe on a Tuesday…

  • Cameras calibrated every day Detected speed is always higher WA drops 2 to 3kmh on offences. Said camera would be fixed camera.

    Chances of beating the tickets 99.9% unlikely.

  • Dashcam? You can calculate the speed from the video. Even better if you have GPS enabled.

  • You want to contest two speeding tickets because they both say the same speed? And it cannot be coincidence?

    Getting done 2x in two different cars shows you just drive to fast. Driving at 106 (or 109) your speedo is likely to be showing 115 or more.

    Playing the 13yo car card is pretty lame too. Cars have been capable of travelling at 110 in comfort and with ease since the 90s or probably earlier.
