  • So if I use the free DIY version that would stand up legally? No one could dispute it becuase it wasn't done through a solicitor? I just type it up, get witnesses and it's all legal & legit?

    • Thanks for the questions.As long as everything is clear legible and the Will has been correctly witnessed it is totally valid under Australian law.You can confirm this at the Law Society of New South Wales website and other legal advise sites.
      No one could dispute it because it wasn’t done through a solicitor!
      I've never seen a Will containing the words "Prepared by…"
      All this we have confirmed before offering.

    The freebie is a simple will which you will need to be careful with if you want to divide your estate or some give specific items - like your OzB account name - to a specific person. The free will only provides legalese for simple assignment. If you start getting complicated like Aunt Mabel to get the Dog biscuits left in the cupboard while Uncle Bob is to get those in the Garage, then you may need assistance as this is where disputes may arise and without proper wording it could be misinterpreted.

    And is it all legal and legit?? - Its a legal document as for legit, who knows - the legal profession makes a living purely on defining legitimacy and haggling over a word, you'll never really know until some one bothers to challenge it (or not)… sorry.

    Since we are being legalistic here - my disclaimer - I have no association with Austwills or any legal training … LOL

  • I had a single beneficiary in mind and was thinking of this for a temporary measure until I get the time to see a solicitor :)
