To celebrate Independence Day in the US, Merrywell are giving Americans a free Liberty Burger all day today. You must show a valid ID card, passport or birth certificate to claim free burger. Everyone else can get the burgers for $10.

      • Despite what many seem to think race and genetic ethnicity are not synonymous. A race is basically a homogeneous group, like American.

        And yes this is arguably in breach of the racial discrimination act as you can't favour one race over another.

          I've take a discrimination case to court, based on nationality - an Australian. I won my case with an out of court settlement. Enough for a nice holiday. The business had to agree to retrain its staff & impliment a non-discriminatory policy towards Australians

          But Australian is not a race, it's a nationality. It's basically anyone born here or who has citizenship of Australia. I could prove my nationality simply with my passport.

          Proving my race or ethnic origin to the satisfaction of a court would be difficult! What can you easily show to prove your race. If you had to prove that tomorrow, how would you? Experts could give their opinion. But other experts may disagree. Courts have been tied up with these issue in Australia.

          But you suggest nationality is race?
          Under the law race does not cover all people from a country - that's nationality. You seem confused between racial discrimination, discrimination based on nationality, and how the RDA operates.

          The RDA covers areas apart from race including national origin, colour, ethnic origin, etc. Those are similar, but separate from race under the Statute, and included in the RDA.

          Good luck taking this promotion under race with the RDA. How can you prove your race was discriminated against & Americans are a race. Discrimination on the basis of nationality is a better case. But I doubt it would fly.

          But, Lawyers giving opinions in my case pointed to lack of precident, so it was likely to fail. So I fought the case myself with legal & Government assistance. It's a long difficult process, covered by different state & federal acts - with different courts. I chose the state court as my case could be more easily proven.

          Racial discrimination occurs under the RDA when someone is treated less fairly than someone else in a similar situation because of their race, colour, descent or national or ethnic origin. Wikipedia

          Americans are very much not an homogenous group. They are not a race, but many.

          American is not even a country, just a land mass of that name, usually referred to by its regions. So Americans are from any country in the American continent.

        • It's complicated & most don't understand the various RDA in Australia.

          Also, some States (eg NSW from memory) allow discrimination based on Nationality. This case would covered under either the Victorian or Federal Acts.

          But OzBargainers make unfounded claims of racism in some deals - strangely far more than in this "All Americans" promotion.

          You seem to have googled homogenous, not homogeneous, and they aren't synonymous.

          The term American means a group of people with the common link aka homogeneous trait being they're from the Americas. "That group isn't a group".

          I'm more than aware a distinction is made in the act between genetic/cultural/racial groups and nationality however I wonder if you can guess why I chose not to make that distinction? Perhaps because of the point I'd just made? No of course not that would have been silly to no wouldn't it….

          Lastly just because many people don't know the many definitions of a word doesn't mean it doesn't have them and it's not perfectly acceptable to use them.
