  I got letters from custom couple of time that they confiscated it. I m 100% sure its less then 1mW. I dont think they bother testing it. and i dont bother contesting it since it only cost a dollar each.

  Its just luck as to whether customs opens it or not, but I've found these things get through more often than not. I wouldn't be risking it for a $100 laser pointer but this thing is so cheap, who cares.
