I purchased a phone from them that broke after 13 months.

They didn't want anything to do with it despite Australian consumer law suggesting that they should provide a remedy.

I also opened a case with Fair trading and they still refused to repair the phone.

    http://transition.accc.gov.au/content/item.phtml?itemId=3229…
    Quote from page 10

For example, it is reasonable to expect that an
expensive television should not develop a serious
fault after 13 months of normal use. In this case,
the consumer could argue the item was not of
merchantable quality and ask for it to be repaired,
even if the manufacturer’s voluntary warranty had
    expired.

I'd rather pay the extra for 2 year warranty for Aus Stock and better customer service from other stores.

looks like everyone agrees with u ;)

    • Did you buy local stock or import direct?

      • This was local stock.

THe sim card reader stopped working.

        • I read a similar story on WP as well. Was that you or somebody else?
          http://forums.whirlpool.net.au/forum-replies.cfm?t=1861838

Also found some unfavourable reviews on…you guessed it, warranty issues
          http://www.productreview.com.au/p/unique-mobiles.html

        • Nah that's someone else.

I posted my problem in ozbargain forums and alot of posts suggested they should repair the phone according Australian consumer law.

Edit - Wow that guy in the whirlpool forums really got screwed over by uniquemobiles

        • Did you say Local stock? im sure all local stock is covered by 2 yr warranty. isnt it? Samsung certainly cover their phone with 2 yr warranty

        • That appears to be the case. 2 yrs warranty for phones
          http://www.samsung.com/au/support/warranty/warrantyInformati…

However as according to Consumer Law, the vendor should provide warranty remedies.

If a seller has to return goods to a manufacturer for assessment or repair, the seller should arrange delivery.
The law allows sellers to recover the cost of the remedy from the goods’ manufacturer or importer,
if the problem was related to a manufacturing fault.

I once had a Logitech mouse replaced by PC Case Gear more than a year after it was purchased (said mouse is covered by 3 years Logitech warranty).

        • This was an LG phone with 12 months warranty.

I did open a case with Fair Trading and they requested Uniquemobiles to fix the phone. However uniquemobiles refused to do so and Fair Trading then said i need to lodge an application with the Consumer, Trader and Tenancy Tribunal. This costs money for the application and time to attend a hearing, so i figured it wasn't really worth my time to go through that procedure.

But i may make a complaint to LG Australia just to highlight that one of their distributors are not in compliance with Australian consumer law.

        • Now you make me confuse, phone has 12 months warranty and its broken after 13 months which mean warranty is expired, and you want UniqueMobiles to fix it?

Did you know that the warranty was 12 months when you bought it? Did they state that it was 12 months?

I don't see how UniqueMobiles should be responsible here.

        • Did you know that the warranty was 12 months when you bought it? Did they state that it was 12 months?

There is something called implied warranty, and the fact that Fair Trading actually requested UQ to fix the mobile phone means the consumer has the right to demand the vendor to fix or replace the product, even if its outside of the warranty period.

Sadly the odds are against PlayerOne because the statutory warranty period was only 12 months and not the 2 years I'd expected, but that doesn't mean he's not entitled to try his luck.

Unique Mobiles are of course, aren't dumb and will do everything they can to squirrel out of replacement/repair requests but they're doing so at the cost of customer loyalty… and potential customers.

Still, negging a deal because of claiming warranty when already out of warranty seems really odd to me. I get it that PlayerOne is disappointed but not UQ fault really.

You're entitled to vote if you have major issues with the retailer. Given the circumstances I think he's entitled to one.

        • Here's the thread i made in forums about it

Many posts there indicating that Aussie consumers are covered by statutory warranty. I think its pretty reasonable to expect a mobile phone to be working 13 months after purchase.

Even Apple has increased their warranty term from 12 months to 24 months to bring it in line with Aussie consumer law.

          What's "reasonable"?
Since January 1, 2011, when a new national Australian Consumer Law came into force, a statutory warranty for a “reasonable” period of time has existed for goods sold in Australia, even if the manufacturer's voluntary warranty (usually set at 12 months) has expired.

          Read more: http://www.smh.com.au/technology/technology-news/apple-keeps…

I think it's important everyone should at least be aware of their rights as consumers.

major issue? out of warranty? really? speechless

        • @fandibong I sort of agree with you. On the surface it sounds stupid to expect warranty support after warranty has expired. It seems that you don't value or don't understand what this statutory warranty is though. Basically in this case it overrides the 12 months warranty because 12 months is not considered a "reasonable" period of time.

Considering all factors, I certainly think PlayerOne has grounds to complain. If there was no statutory warranty and it simply was a case of a manufacturer's warranty being the only "warranty" that mattered, then I would agree it sounds stupid to expect warranty support when out of warranty. Even by a month.

        • I thought under law the retailer only has to deal with warranty for the first year and anything after that is dealt directly with the manufacturer… That however doesn't negate the statutory warranty in which the manufacturer has to fix any defects after a reasonable time.

  • Shipping cost $18.

  • Good price but Is that for the non-4G version?

    • Yes 9500 in the Octa core 3G only version. The i9505 is the 4G LTE (quad core) version.

  • Can we trust this company - unique mobiles ??
Really need a new phone.. Kogan is selling for 620 something .. Don't mind getting from either but i need to trust someone…….

    • +2

kogans actually alright imho, just have to put up with grey imports.

    • Don't worry they are fine - bought 2 ipad and blackberry from them before. All good. Of course if you can get local stock would be better.

  • Too bad, this offer isn't for the black model, otherwise I might order it.

  • +3

No authorised warranty from Samsung. Too risky to bet 600$!

  • +4

what a poor rep, doesn't respond to "PlayerOne" even though he has posted on ozb!

  • Good price but reading peoples experiences kind of makes it a turn off, I'll keep waiting and stay away from this mob

  • Under $600 already. It's kept pace with the S3 in specials prices I guess. I want one, but I'm in no hurry to get one. $500 and I'll bite. This could take a few months, but I'm fine with that.

For those complaining about UM not being trustable, do tell us which import phone retailer you do trust.

    • I trust Kogan. Have had a few personal experience buying with them and they've been fine. Nothing spectacular, but nothing bad. Just about what I'd expect.

I also think that their reputation is too big for them to get away with doing something ridiculous like what they've done to PlayerOne. So even if they were to try hard to get out of it, they would ultimately realise their reputation is somewhat at stake and would possibly go an extra half mile to try and appease a customer for the sake of their reputation. Gives me a bit of a peace of mind (although I haven't been put in that situation with them yet).

      • I'd also have to give the thumbs up to Kogan. Got the S3 4G when it was at its lowest price. Aus stock arrived in 10 days. Had a fault, after a little too & fro. Replacement on its way from HK now.

        • I got my s3 4g $380 aud from Kogan in a week from the order. Had toll holdings guys delivered it straight away it would have been 6 days. My friend got their phones from eglobal and topbuy no problems. Haven't heard of anyone dealing with UM personally.

Sucks you had to get it replaced Mattese. What fault did it have?

        • eglobal and topbuy have not had good reputations around here. Did your friend have to RMA it? Getting it delivered to you without issues is not nearly all they can be assessed on.

  • Great price no doubt, but I really don't think they deserve customers if they're gonna treat customers like PlayerOne the way they treat them. Not to mention the rep not even responding when clearly having the chance to directly respond on Ozbargain.

  • +2

The rep has made 157 posts since joining Ozbargain in 2010.

The Ozbargain community has supported their business for the past 3 years. At least give some support back to the community that has helped your business.

  • I also got a pain with the phone I bought from them. It reboots time to to. Reading all the negs I can't expect much from them in this situation. The issue I have is not happening always so I am sure they will simply refuse to fix it. I was first upset with unsealed box, now with this damn issue.

Save your time, money and peace of mind, don't buy from them.

    • If you search their past deals, quite a number of them carry Negative votes, for valid reasons.

    • Hi Ozdeals

Our warranty team is definitely here to assist in the even of a warranty claim should you have a fault with your phone. Please feel free to email us and if you are local in Brisbane our warranty guys might ask you to come in and see us as normally these issues can be resolved with software.

      Thanks

  • So far, Kogan is the only company sells grey import phones can be trusted. At least they have an ABN number and based in Australia.

    • Please see our website where you will find our ABN at the bottom of our homepage. Unique Mobiles head office is located in Brisbane and all Australian stock is shipped from our Brisbane Warehouse.

      • Thanks for explaining and yes your company has an ABN and based in Australia.

Are you planning to sell the black i9500 for same price within the next few days?

        • No problems. Sorry we have sold out for this deal however I am trying to work on a deal for the black version though I am struggling to get the same price from Suppliers at the moment. I will keep you posted. Will also try for a deal on the 4G version

        • Eagerly waiting for a black i9505 deal….
