No Super for The Last Week of Employment (Federal Government)

Hi People,

Can someone help me out here. I was told that there is no super paid on the last paycycle, is that correct ? Sound a bit strange to me and I was expecting super for the last week I was on leave.

Employer is federal govt - Australia.

This is the email; I received from them:

"As per Company's EA, the superannuation is calculated on FCS method and not OTE method. Super is not payable on the final payday for any superfund. The rules regarding this are available on the CSC website. The rules state: Contributions cease from the payday following the date that the person ceases employment. Your last date with Company was 4/06/2021 and your following payday was on 10/06/2021 and super was not paid for the fortnight."

My payslip is attached here, which might give more context.

    It'll have something to do with annual leave that does not attract superannuation. Looks like you were paid out accrued annual leave which more than offset work so no super, if I'm not mistaken.

      It seems more like a weird EBA thing. I was with State gov't and I got super for my last pay cycle including unused annual leave. The only part they stiffed me on was unused LSL which I knew would happen (bad planning on my part).

        Annual leave attracts super when you take it, but not when it's paid out when your employment ends. That's why you're generally better off using up your leave.

    Also, this is over 3 years ago. Why chase it up now?

    • Sounds like they want to get super paid out for termination pay, even though they didn't work for it.

      • I get that part about super not being paid for the annual leave cashout. My thought was that if I was on leave, it will still be getting super.

    Not if it is termination pay of paid out for any leave… Super is only paid for when you actually do work.

    • I was on leave until the 4th June, and they paid the balance of the leave accrual on that day.

      • Once you resign, leave payouts are treated as termination pay.

    • That's incorrect but you keep doing you.

  • Government is pretty strict on this stuff and rarely stuffs it up in my experience.

    I've seen things that make no sense to me payout wise but whenever I've questioned it it's always been right (in the favour of government/HR unfortunately).
