Does This Count as "Product Does Not Match Description"?

Bought something online, called "Product Pro", and got "Product" instead.

The vendor said no error on their end and refused to do anything about it, as the "Product" was actually listed (as "1st gen") in a drop-down menu and was the item I bought. I would argue there is enough reason to initiate a chargeback under "Product does not match description", for reasons:

  1. Product Pro retails for $1000, and Product retails for $500, the site shows "SAVE $500". iPhone example, I do not think you can advertise "Save whatever" when you compare with other variants?
  2. Product description for Pro is used for both, which has the feature I was after and does not exist for non-pro variant. On the listing page, it is defaulted to "1st gen", I dont even realise you need to change it, since the description already described the thing i wanted. Pretty much apart from the "1st gen", everything shows explicitly "Product Pro".
  3. The term "1st gen" has nothing to do with the "Pro/non-pro" naming scheme. Again I'd say iPhone 16 Pro is not the 2nd gen of iPhone 16
  4. While I would have gotten a sweat deal for "Product Pro", I just paid RRP for "Product", which disgusts me as an Ozb'er.

    Store would help, as would being less vague

    An example is that a site like eBay wouldn't be somewhere you'd want to do a charge-back, as your account will go poof

    I would say…sure, its a case of product does not match description… if it says it has xyz in product description and product does not… makes sense I guess.

    I suppose the next step would be to lodge item does not match claim with whatever avenue you have (Ebay, paypal, credit card etc) if you believe you are in the right.

    • I was just taken aback because I was told I didn't do my due diligence because the deal just seemd too good (almost verbatim), thought it would just be a simple return and refund.

    This might be your undoing if there are multiple items listed in the dropdown selector with the lowest spec variant auto populated.

    • Nah doesnt matter what variant it's always the same descriptions, but I admit I didnt play with the dropdown when I placed the order

        So you didn't use the selector to select the roduct from the multi dropdown menu? And you admit to that?

        Sounds like Ebay and Wish listings that have a $0.99 stylus in with $20 ipad cases, you wanted the ipad case and got the stylus. Caveat emptor?

        • Then the drop down should have a default item selected that forces you to explicitly change it to a valid item.

          • @kiitos: Usually the default item is matched to the price on the page.
            $0.99 on the page and a stylus is selected in the dropdown even though the product heading might be 'High Quality ipad Case'.
            If you select blue ipad case then the price dynamically changes to $20.00.

            With ebay I hardly, if ever, see the description change between the 2 or more items in the listing.

          Even wish/ aliexpress does not say you saved $19 dollars in this case. I would think I am buying the case if the RRP is $20

          • @Exorcist: Basing your argument on 'Save $xx.xx' would be tissue paper thin in a multi product listing too. They may be showing the save based on RRP when released, not at the time of listing/viewing. Is an iphone 15 $1600 or $1350 RRP?

            • @Avocado Pastry: the point is the saving shown is the difference between the actual prices of the stylus and case in your example. And stylus does not say stylus, but “thing for iPad” so you don’t know what you picked.
              Even the vendor said it’s their mistake but still I should’ve contacted them to clarify.

  • So the "Product" is only 6 inches long and the "Product Pro" is 12 inches long? In this case you should get a 50% refund.

  • You purchased off AliExpress and fell for the old bait and switch drop down box. Be more careful in future.

    Edit - looks like it was a random scam Shopify page, same advice as above except replace "AliExpress" with whatever website it was.

    Sounds like op needs to do a pro course on buying from ebay. Pro course shows how to spot a well crafted page that will entice the non pro users to buy a product for more than it is worth and that they have no recourse as the page does not have anything that is illegal or violates the rules.

  • The name of the product compels you. The name of the product compels you. Try throwing holy water over it, it might change to Pro.

  • In my opinion, it is false, deceptive and/or misleading advertising, and worthy of persuing a refund.

  • let me guess, you bought from Ebay, where the Title is "amazing product in several variations", and price is listed as a range (e.g. $10-$50).
    Then in the description they list mostly the specs of the top of the range product. But in the selection drop-down you can select from several types of the product, and this changes the price.
    Its a very scammy thing that ebay allows sellers to do and many of them do it. Its a buyer beware situation, sadly.
