Brothers Red Light Fine - Is It Technically a Fine?

This is the first image. There is no prior image of car behind the line. Brother was waiting across the line on an amber light to turn right (silver car on the right.)

Looks like the Mini Cooper on the left, set off the red light camera?

Yes yes was probably pushing it and should be much less reckless. However in the black and white eyes of the law, is this technically a fine? Did not cross a solid white line on a red?

Thanks for your time, hope you enjoyed another red light thread

EDIT: Specific question (SA)
Should there be a photo of the vehicle, before crossing the solid white line & showing a red light? (irrefutable proof of guilt)

  • Aren't there sensors specific to each lane? So irrespective if the mini was there, it was OP's lane that triggered it.

I could be talking out of my arse here, so happy to be corrected.

  • Fight the charges if you didn't like the outcome. Clearly if your car was stationary post line to turn right and the mini clearly going straight is post line on the red,, well an error occurred.

  • For traffic light offences there are normally two images, one that shows the car on white line crossing while the light is red and the second image shows the car slightly moved ahead. This shows ‘movement’ of the vehicle. Which results in the fine.

In your case, it’s strange the camera is on the opposite side clicking a picture from the front.

Mostly the camera is on the same side of the road, clicking photos from behind.

I would say lodge a dispute and request for the other image then make a decision on what you want to do next.

    • Huh? Are you looking at the image OP posted?

      • May be I got something wrong. What am I missing? Isn’t OP car the silver one on the opposite side turning right?

        • Silver Honda with the redacted licence plate

  • The photo seems to have cut off some of the text? Perhaps the text would let us know which lane was the trigger.

It's not uncommon for multiple cars to trigger 1 camera either.

  • I just read this:

    https://forums.whirlpool.net.au/archive/1384724

Someone states that they red light camera is triggered by someone passing over the pedestrian line so if that's true it would be hard to argue. If the mini did trigger the camera the photos from that might be able to prove that your brother ran over the stop line.

  • Same thing happened to my mother. In the first picture, her car was mostly over the line when the light was still amber.

The appeal was rejected, and she ended up taking it to court. The prosecuter offered the option where she was allowed to plead guilty and have the fine waived after he showed a more accurate video of the lights turning red before crossing the line.

Basically, the sensors are very accurate and you could try to ask for clemency in court if you have a clean driving record.
