  • Just received the final reminder email today

    "Hi ,
    Our records show that your original device has not been sent to us as part of your recent trade-in.
    This is the final reminder to post your device within the next 24 hours, otherwise we will charge you a late return fee of up to $60, which is non-refundable.
    Remember, we will not process a refund of the Security Charge until we receive and assess your original device."

    And I notice that they actually have not charged me for the $5 security charge and I am not sure how they are going to charge me as I used a one-time debit card in an account with less than $10 for Asurion to authorise the trade-in. As for the phone, I used PayPal to pay Samsung and I don't know if Asurion will try to charge the late return fee of $60 from Paypal.

  • So if anyone received an email from Asurion saying they will charge you a late return fee can argue with them on the Terms and Conditions as the conditions of charging the late return fee are not applicable if the "less than 90 days" part is not satisfied.

    "5.7 If You: (a) fail to post in Your Existing Device to Us within fourteen (14) days after the date on which You receive Your New Samsung Device at your nominated delivery address, You may be charged a Late Return Fee in accordance with clause 7.3(a) below; or…….

    Late Returns: (a) If You return Your Existing Device to Us more than fourteen (14) days but less than ninety (90) days after the date on which You receive Your New Samsung Device, We will:
    (i) accept Your offer to transfer ownership of Your Existing Device to Us (in which case You enter into a contract with Us for the sale of Your Existing Device to Us and ownership of Your Existing Device will transfer to Us); and
    (ii) charge You a Late Return Fee."

    See, 7.3(a) will only be applicable if you return your existing device more than 14 days but less than 90 days. So, if you do not return the device in 90 days, they would not be able to do what they stated in 7.3(a)(i) and (ii) as the condition in 7.3(a) was not satisfied. So, they would have no ground to charge the late return fee.
