        Nope. Read up on the Australian Consumer Law and consumer guarantees, including Acceptable quality and the meaning of ‘durability’.

        The Australian Consumer Law (ACL) creates a basic set of guarantees (or rights) for consumers who acquire goods.1 One of these guarantees is that the goods will be of “acceptable quality”. This guarantee includes that goods will be as durable as a reasonable consumer would regard as acceptable. A good purchased is expected to be durable enough to perform its intended function(s) for a reasonable amount of time.

        Consumer guarantees under the ACL apply for a reasonable time and in addition to any warranties that manufacturers and/or suppliers provide for a good. This means consumer guarantees may continue to apply during the period of those warranties and after those warranties expire.

        If a good fails the guarantee of acceptable quality for a reasonable time then the consumer is entitled to a remedy under the ACL, regardless of what the supplier or manufacturer may have said. Suppliers and manufacturers cannot modify, restrict or exclude consumer guarantees.

        The type of remedy, and who must provide it, will depend on the seriousness of the problem and which consumer guarantee was not met.

        When the problem is minor, the supplier can choose between providing a repair or offering the consumer a replacement or a refund.

        When there is a major failure, the consumer can:
        • reject the goods and choose a refund or a replacement; or
        • ask for compensation for any drop in value of the goods.

        Therefore if this kettle has a major failure within a reasonable time after purchase (as considered by a reasonable consumer, and ultimately determined by a court or tribunal if need be), then the consumer could seek a refund from the supplier and the supplier cannot refuse.

            Having said all that, there are obvious practical considerations. How much effort are you willing to expend pursuing a consumer guarantee matter against an overseas-based online retailer?

            The ACL provides strong consumer protections in theory, but enforcing those rights may be difficult, stressful and/or time-consuming, and could incur indirect costs that far outweigh any remedy over a $60 kettle.

                When an overseas business sells products directly to consumers in Australia, the business must follow the Australian Consumer Law, including the consumer guarantees.

                However, consistent with what I was saying:-

                In practice it can be difficult to get a repair, replacement or refund from an overseas business if there’s a problem with the product or service, and the help Australian consumer protection agencies can provide is limited.
