Marley Spoon Referred Me to a Debt Collector!

Hi..
About a year ago, I cancelled my Marley Spoon subscription but they somehow sent me one more order. I am pretty sure I cancelled before the cut-off.
Anyway, I haven’t heard from them until I was messaged by a debt collector a few days ago. I then searched my email and found out i had a few emails from marley spoon in my junk folder regarding the outstanding balance.
Anyway, I feel it was unfair how they are trying to charge me for their error.

What would you do? Pay $60 to make it go away? Or ignore them? What are the chances this would affect my credit score?

Note that I have never received a call or informed of any method to contact the debt collector to resolve it. Just a link to pay up.

EDIT: thanks everyone for the advice. I will pay it just so it goes away.

    If you're comfortable that you cancelled before receiving it and can prove it in any way I'd just send that to the debt collector and say they made a mistake.

    If you actually cancelled after/day of/even day before type business and never followed up properly to confirm it all and sign off on it then just pay for it.

    The cancellation date is pretty key.

      It was 5 days before delivery. Can’t remember what the cut off time was but from memory, I cancelled in time.

        Sounds like you didn't cancel in time and then you didn't follow up with them.

        Unless you can prove otherwise, the debt is legitimate and you should probably just pay up.

        • You don't know what contradicting means, nothing they said contradicts that they believe the cancelled in time.

          If they didn't cancel in time why didn't they charge them at the time of delivery. Smart money is on they cancelled but the company didn't cancel the order and still shipped it out then realised afterwards to chase for payment. Since when do these companies ever ship first and ask for payment later? Never.

    But you're only "pretty sure" that you cancelled before the cut-off, and apparently you didn't contact them at the time when you received the unexpected last box, and you didn't check your junk mail folder for about a year.

    The debt collector sent you a message. What more did you expect?

    Yes, this all sounds like Marley Spoon's errors to me. By all means ignore the debt collector too. After all, what are the chances that it will affect your credit score?

      Delivery was left outside. It was delicious! But it isn’t like they were gonna come take it.

      • You can't assume they wouldn't come and take it, you need to offer them that option, particularly when you're only "pretty sure" that you canceled the order in time.

        You 'think' you cancelled the order, an unexpected last order arrive and you ate it instead of thinking "oh hang on maybe I didn't cancel in time" or check with them, and then you think it's unfair that they expected you to pay for the order.

    Once you decided to keep the order and not contact Marley Spoon to organise for it to be returned it became yours and you need to pay for it.

    Pay the debt collector and move on with your life. It's too late to negotiate your way out of this.

    What's the big issue anyway, you got a product and you used it, you want it for free? you didn't contact them when you got the box "in error", did you? didn't think so.

    It's probably already cost you more time than it's worth to fight this.

    Their system is entirely automated and you 100% did not cancel before the cutoff. Again, you thought you cancelled, you received a box and you just went "oh well, their error" and moved on with your life.

    For the amount of time and effort involved, I'd probably just pay in this circumstance. You did receive the product at least.

    Never mind the debt. You ate the meal and should pay for it.

    Have you checked your credit record? You can do it for free from various sites. The debt collector shouldn't just record a default against you. Key word being "shouldn't", but that doesn't mean it can't happen.

      Credit score is currently 909 and it says i have no negative events. I will just pay up as im in the process of apply for home loan.

    Their error? They didn't put the emails in the junk folder, you or your email client did.

    So they did contact you. You didn't read the messages, but you did know you got an extra box that you think you didn't order/pay for.

    Consider you don't know if you cancelled before the cut off date, you did receive the order and didn't try to contact them and the fact it is only $60. I would pay it to make it go away.

    To 'fight it' will cost more, do you want to risk your credit rating over $60 for a service/product you did receive?

    You needed to give them 6-7 days notice, otherwise they will charge you.

    If you sign up to a service, unfortunately you will have to comply with the terms and conditions.

    Plus you ate the meal too.

  • Whether you cancelled before or not, you ate the meal. Treat it as you would any delivered meal and pay for it. Then your conscience will be clear and you won't have to write posts like this.

  • I don't think they can touch your credit file. All they have is a name and address. They wouldn't even have a date of birth. I'd just ignore it.

    Minimum reporting threshold amount is $150 for your credit file.

    You can safely ignore them but it's probably not worth the hassle, and you did use the product.

    I had a similar thing with Youfoodz. I had an issue with the website cancelling, tried their email support and got stupid responses back and no resolution. To try and resolve I went and removed the payment authority from my Paypal account, payment failed as expected but they still send the product anyway (they take payment a couple of days in advance so I don't know why? but they did)

    I didn't know it was coming and had to bin the food because it sat outside overnight as I was away from home on the delivery day. Pissed me off but I couldn't be stuffed arguing over $100. Even though it wouldn't have affected my credit score I didn't want to deal with a debt collector contacting me, not worth the hassle for such a small amount. I will never buy from them again though because of it.

  • One quick google search and one further click shows that if you cancel after the next order is being processed then you will receive that order and have to pay….. onto of that it says 6-7 days is the cut off yet you cancelled 5 days before. You signed the T&Cs when you agreed to their service and it is pretty straightforward that you owe them $60.

    In this case Marleyspoon has done nothing wrong, you have.

    Defaults under $150 are not reportable on your credit record.

    Just pay it and move on. With inflation rate since then it was a bargain in today's dollers 😉

    Only certain categories of organisations can affect your credit score, e.g. credit providers. Marley Spoon isn't one.
