eBay Australia Not a Member of AFCA

I just want to alert shoppers that I wanted to report eBay Australia to the AFCA because they are refusing to issue me a refund (the typical eBay chat troll) but since eBay is not a member of AFCA, I may not make a complaint.
eBay doesn't have a complaint procedure so the only choice is to chat with these chat trolls who know nothing other than picking in their noise while reading non sense and off topic scripts.
So be ware, always and only make transactions with a credit card because you get a shopper protection and avoid wasting your time with ignorant chat trolls.

Typical story goes like this: $0 fvf promotion didn't work. Ebay charged the seller full fees. Ebay live chat didn't want to issue the refund, blah blah.

Previously with PayPal managed payments, ebay would send you an invoice for the fees at the end of the month, but you'd receive the full payment from PayPal almost immediately. Now days with ebay managed payments, they withhold the fees from the payment to the seller.

eBay live chat seems to be somewhat useless with resolving these issues and there's no escalation path.

      • +2

you'd receive the full payment from PayPal almost immediately

I noticed that recently eBay, PayPal and Aliexpress deny or make it nearly impossible to successfully apply for a refund.
Lesson learned, always pay with your credit card.

        • PayPal

PayPal a part of the ACFA so easy to get a refund with that route.

        • +1

I've had no issues getting refunds from eBay and AliExpress and I never pay with credit card. On the whole, I find eBay support agents to helpful. When I got a scammed a few years ago and paid with PayPal, it was an effort to get refunded for my purchase. But with persistence I eventually did receive a full refund.

          • @rogerm22: I should add that in the case I was scammed with PayPal, I bought from some random website, not eBay or AliExpress.

  • +9

Why would eBay be a member of AFCA

    • +1

PayPal is a member and they helped me resolve an issue recently.

      • +3

Paypal is a completely different company so what's that got to do with eBay being a member or not? Also, Paypal is a payments company, of course they will be a member. EBay is an auction site, nothing to do with AFCA.

        • -5

EBay is an auction site, nothing to do with AFCA

Financial transaction business, in fact my bank paid them directly.

          • +4

@billadm: By that definition every business should have to be a member of AFCA because they take payments. You are delusional.

    Australian Financial Complaints Authority (AFCA)

Why would ebay be a member…

    • -2

Ebay acts as a bank for both the buyer and the seller in many cases.
If a merchant loses thousands in an Ebay mistake the poor merchant has one less avenue to pursue.
At least with paypal, I have successfully won a complaint where PayPal just kept dismissing the fact that they had made errors on my PayPal account as a merchant.

      • +1

        Ebay acts as a bank

        Incorrect!
eBay is not a bank, and does not hold a banking license.
They are just a middle man.

    OP,

Can you elaborate more on what the issue is. I have successfully served eBay before (and Paypal when they were owned by eBay) and forced their lawyers (it was Corrs or Allens at the time) to respond and issued a resolution.

I might be able to help guide you but need full story and type it out here so it will be helpful for others in the future.

    • @Bargainitis

      Thanks for asking.
It's a scam transaction and eBay ignorant chat trolls played it along.
      1) The scammer seller (from USA) didn't send me the tracking number so I had to ask for it, first alarm; once I checked the tracking number, it stated "delivered" to an unknown individual so the tracking number was not related to the transaction between eBay (the Australian one charged me) and me; eBay ignorant (a supervisor) chat troll even confirmed that there is NO tracking number and I've to wait for it, I ASSURE YOU THAT YOU'RE IN GOOD HANDS; since I made a transaction but I don't have a tracking number, I requested a refund but it was denied, the ignorant chat troll diverted me to the seller for the refund; the USA scammer seller (eBay's partner) admitted "oh, we are very sorry the package was lost, please deal with eBay for the refund!"

When I committed to buy the item I didn't realise that the delivery schedule was for APRIL then the seller said "item lost" so that means they usually play this scam.
Now, imagine if I kept quite and waited until April, I would have lost all my shopper protections.

Why would eBay be a member of AFCA

It's the Ombudsman which helps Australian shoppers fight against scammer financial institutions (like your bank), and for your notes, eBay makes thousands of financial transactions.

Why not get the refund from the seller?

eBay Australia made the transaction and that is the information from my bank.

      • how did you pay for your transaction? was it via credit card?

        • -2

Unfortunately not, I used a debit card because I used to trust eBay!

          • +1

@billadm: You can file a chargeback through your bank anyways

            • -7

              @dm02:

You can file a chargeback through your bank anyways

Thanks, done already but they are scammers too, I complained two times for two different transactions to the AFCA because my bank denied the application.
Again you deal with ignorant trolls who know nothing but only copy & paste scripts.
My bank compensated me 2x $200 only for denying my applications thanks to the AFCA.
So for the trolls here, we need AFCA for serious matters.

              • +4

                @billadm:

I complained two times for two different transactions to the AFCA because my bank denied the application.

I see a repeat pattern forming. So just maybe and I mean maybe, it isn't the bank or sellers who are the issue.

There needs to be an ombudsman outside FairTrading to those large corporations and companies that are dodgy AF. While I assume there will be 100000s of individual cases, companies that are not with an Ombudsman shouldn't get away with dodgy practices.

Samsung, Apple, GumTree, eBay, Sony, Car Dealerships (Mazda etc), FaceBook and Instagram Business, should have an ombudsman. These companies get away with too much not dealing with customer complaints.

    • These companies get away with too much not dealing with customer complaints

That's why only pay with a credit card.

      But there is even more:

More than 800 large companies paid no tax in 2021-22, Australian Taxation Office reveals

      https://www.abc.net.au/news/2023-11-09/831-large-companies-p…

Small enterprises and businesses know how to legally dodge the tax office so the only people who always 100% pay tax are the employees.

    • There needs to be an ombudsman outside FairTrading to those large corporations and companies that are dodgy AF

Why? We only have the OP view they are being wrong. The fact they haven't shared the story and ebay has already said no to a refund, in this case I would be agreeing with ebay.

In all my years, ebay is very happy to dish out refunds as it isn't their money when you complain.

      • +1

It was a blanket statement not necessarily directly to the OPs situation.

I've had my fair share of ghosting from genuine complaints that I believe I was in the right based on research and fairwork does nothing.

For example with HCF (which does have an ombudsman), when i got braces I'm eligible up to $4500 paid towards those braces. I got braces and was paid out $3k and the rest 1.5k will be paid out when I get the retainers.

I confirmed twice before I got the retainers from 2 customer service reps and they said, yes it's 1.5k payout for retainers. Just get the receipt.

I got permanent behind the teeth retainers and got the receipt. Gave it to HCF and they said I only get $200 back. I disputed the retainers was my last installment of the braces (totalling 8k) and nothing in the PDS, my cover state anything about braces and retainers and different retainer item codes giving lower payouts.

I went to the ombudsman, giving evidence, linking my cover and the PDS and funny enough, the next week got an email from HCF paying out the full remaining 1.5k

If it wasn't for the ombudsman, I most likely wouldn't have gotten my benefit even though I tried doing the right thing.

What normal consumer would know about detachable retainers would pay full instead of permanent retainers behind the teeth? Not even the PDS says it, not even online says it and wouldn't the two reps over the phone state different retainers / item codes payout differently? If it wasn't for the ombudsman, it would surely be a hassle to fight for it.

        • Generally these ombudsman’s are funded by industry participants. Can’t see retailers wanting to contribute towards an ombudsman. Gerry Harvey will go nuts

          • @Dollar General: Not saying the small, medium businesses. But more so corporate - global retail brands, they're the problematic ones.

      Ebay isn't a bank

How do you define a corporate organisation that exchanges millions of transactions with financial institutions all around the world?

      • +1

In that logic, Starbucks is a bank with their members rewards program.

Unfortunately there will be corporations that don't have an ombudsman and fairtrading wont help you.

It pretty much comes down to other companies that MAY help you such as PayPal dispute or a charge back from your bank if paid directly by credit card.

If these large companies had an ombudsman, life would be great.

        • -6

In that logic, Starbucks is a bank
