Neighbourly Dispute about Apartment Parking

So, recently had an argument with a neighbour about them parking in our spot. I'm going to try to resolve this in a civilised manner, but I'm wondering about the legality of installing a security camera monitoring out parking spot. This is really aimed at concerns over my car getting keyed.

This is an apartment indoor garage, with some strata cameras and signs warning cctv in operation. Can I set up a camera watching my car without telling strata? For comparison, how would it work having dash-cams continually recording outside my car?

If I explained the whole situation a poll would probably be suitable - bikies are a genuine option. Not joking.

    Sure. I mean recording for your vehicle security is totally the same as monitor car spot usage.

    I feel for ya, but dicks will be dicks. Why not just put some oil stain on the surface of your car spot, take a photo of your neighbours car and then send it to strata say your neighbour is staining the common property? I’m sure your neighbour will argue it is not them.

      There's actually a history of them leaving rubbish in our car spot. Without evidence, what can you do? I just want them to mind their own business and protect myself against any future property damage.

        When i was living in an apartment there was a neighbour who parked his car in my spot. I know which unit because i recognised where it usually parked. I confronted the guy and he explained to me he needed more space for the baby seats etc. I then set boundaries say sure but you have to leave me room to get in and out of my car etc. Amicable solutions.

        But in your case, I dont think they care, and that is your problem. So do something (without damage to their car or property) so that it becomes more hassle for them to park their car in your spot / leave rubbish.

        Without evidence, what can you do?

        Just say you found an address on the box matching his/her unit . You “presume” it is him/her who leave the rubbish. Let strata manager to send letters out.

        Asking strata manager to do something even to file their own nails cost the owners corp $$. That will eventually upset other people.

    • Would the camera need to only view our parking spot? Is it an issue if it captures a wider area? I've asked for the strata by-laws but I doubt it covers things to this detail, and I would rather avoid escalating the matter.

      • Will the camera be mounted on something that is not your property? Will it be powered by an outlet that you are not paying for?

    Some strata will allow a lockable bollard to prevent pthers using it. Check it out.

      You would be surprised of the area, certainty not a bad part of town. All of the other neighbours are lovely.

    Hardwired dash cam. Another option is asking to privately pay for another camera in your spot that will feed into the existing CCTV. This will only work if strata agrees and if there is an available channel.

    Did this with a paranoid schizophrenic neighbour who accused everyone about her 15 year old car having wear and tear.

    Can you fit a nest cam out of reach filming just your spot?

    • Probably not out of reach, but up on a shelf somewhere with a restricted view of my spot should work. I guess it would need cloud storage to stop someone from ripping it down (without being seen).

    Your best and only option is to have a continuous recording dashcam in your car.

        Depending on the bylaws, the parking spot may be wholly owned by the building and exclusive access provided to the owner of the apartment lot.

        In any case, you can't just go mounting things to strata common property like WALLS. Not to mention where you intend on getting power from for the device.

          Depends on what you mean by ‘mount’. Battery/wifi operated zip tie to a post is different to drilling mounts in a wall and running a cable around the place.

          • @Euphemistic: Agree. If OPs account is legit, the other dude has already crossed the line, so horse for courses. OP should set up a camera sans strata blessing. Call it gathering evidence in the absence of strata having suitable CCTV in the car park area

              0% chance strata just allows you to put a recording device on common property like a carpark, even if it's "only pointed at your spot".

              • @coffeeinmyveins: Ditto for the strata allowing other ppl to pinch a parking bay. The camera only needs to be used to get the footage and the footage only used as a back up. OP could just quote time,date etc of the next infringement and not even tell the strata that the info was gathered with a camera. It could come down as quick as it went up.
                IMO if OP does record a criminal act it's bigger than strata anyway.
                Plan B is OP to BS tell a weeny white lie to strata and tell them there have been multiple lurkers in car park casing cars and OP would like CCTV upgraded in the area as a matter of urgency.

                • @Protractor: Unless OP is an owner and on the strata committee, getting them to 'upgrade the CCTV' is not something that will happen in the next few weeks or even months, even if they have the money/inclination to do that.

                • @Protractor: Our strata allowed cameras to be installed after car started getting keyed andv screws in tyres, before that multiple reports of dumped rubbish, illegal parking and dodgy deals being done at the back of the carpark were ignored - I guess it takes an insurance claim risk before they will listen.

    Just take photos of their car in your parking space.
    Then make a written complaint to the strata manager with the photographic evidence. Request that the owners corporation send a breach of bylaws notice to the neighbour.
    You can ask that the notice states if they continue to park in your space, the committee will lodge a dispute with NCAT which can enforce an initial fine of up to $1100 and they can also double that fine should it reoccur.

      • Surely that defeats the purpose? Either the offending parker knows his parking got him the visit, in which case it’s pretty obvious who sent them, or he doesn’t, in which case he has no idea what’s going on.

        Only way I can see the first working is if he’s been parking in everyone’s parks, and the second if OP just wants to run him out of the complex completely.

        • Yeah obvs not actually going to go down that route. It's just frustrating having some roided up freak think they can intimidate you. If it ever eventuated in that, it would simply be to get them to back down. Some people assume they can walk all over you if they act crazy enough.

        I would put the loudest touch sensitive MF alarm on it, then. If it goes off and upsets the neighbours drop them a line telling them why you had to act and who the resident AH is. If he touches it and it goes off he will look like a total dick to the rest of the neighbours anyway. Just set up your secret camera wherever you want. Roids will (profanity) his body up over time. Ponder that when you see him out & about. Also other wannabes like to fell giants so he may become someone else's belt notch eventually.
