      Good thing that I've arranged to get the one we NEEDED from Kogan for less money AND free shipping.

      Of course the 'unique' charmers have debited my PayPal account.

      Pity that they haven't taken steps to ensure that they could at least match the Kogan deal of a few days ago ($349 shipped) - I'd have thought that might at least limit the fallout.

        Good service? Not enough. At least they should compensate the customers for spending time due to their mistake. A sorry email and immediate refund is definitely not enough.

          I can't imagine it would be a deliberate act….. I assume generating a large number of refunds, coupled with the current online tantrums of those affected, would not be seen as desirable for any retailer

        • Firstly, we were lured due to low price (Claimed as error). Traffic was generated from this moment.

          Secondly, refund was made(Instead of out of stock).

          Consumer will also be unhappy even in the example.

          My view is bait advertising will have the same result (Traffic) but just in different method/scenario.

          Only because it was posted on Ozbargain. They didn't actively promote the product at that price themselves.

        I don't have any references to legislation, but I know the same thing happened with Dell a number of years ago.

        They accidentally advertised 500GB hard drives for $9 each. People were obviously buying tens/hundreds of them at a time. The Dell online store automatically charged peoples credit cards immediately after they submitted the order.

        By accepting payment, Dell had entered into a legal contract to provide the goods. If they had wanted to cancel the orders, it needed to be done BEFORE they accepted payment.

        The end result was that they said because the orders were placed through the home/personal store, they would honour two drives from each order, because any more than two drives is not considered personal use. The rest of the money was refunded. Dell did try to fight it and not sell anything - this wasn't an act of good will.

    Well done to uniquemobiles for correcting the listed price. Do the people who placed an order at the incorrect price expect the company to wear a loss for each purchase? WTF?

        Considering no one on this site shops on loyalty, but price… hence the name 'Ozbargain'- why would they honour the price and make a loss.

        Its alright to be disappointed but alot of people are getting emotional… …hate? lol

          That's probably a too strong word, okay - bad reputation.

          People do shop on price here but if given the choice they will choose the lesser of two evils - for example Kogan VS ShoppingSquare.

          Considering there are so many competitions around here and if the prices are not too much difference than competitors I am sure after this stunt people will more likely buy from others to show some kind of protest.

Seeing most of OzBargainers here are tight-asses, I don't see how they can recuperate the financial loss by relying on us as returning customers. I doubt many of us here are loyal customers as we mainly purchase based on price. Hell there are people here even admitting to buying bargain even if they don't need the items.

    I am sure if they had a pricing error of $479 and someone bought and paid it, they would not have refunded the difference.

  • Pricing mistake or not, they should be honouring the deal rather than refunding, like other mobile phone pricing errors on ozbargain previously. Very poor.

    I think some members here are underestimating the effect of a $100~ pricing error for a small business. Although it depends on the amount sold, with 3000+ clicks on the deal, even a 5% take up rate would mean thousands lost.

    The relevant acts covering consumer protection aren't so obtuse as to require a small business to go out of business trying to cover an advertising error. It also sounds like refunds have begun to be processed within a few business hours of the mistake occurring.

    • I think there is a big difference between an advertising error and agreeing to a contract to supply a good at a given price.

      Companies that are prone to advertising errors (like for example Dell), go to pains to make clear that their initial 'confirmation email' is not in fact an order confirmation, but is subject to a manual check before the actual confirmation is sent. They also go to pains not to charge anyone's credit card before that check has been carried out.

      In my view, once payment for a product has been accepted, a valid contract for the sale of that product at the specified price has been entered into.

    BuuBox, Its great to see few customers out there do understand. I can appreciate how frustrating something like this can be for buyers. If this was a deal we could honour given the circumstances to keep customers satisfied we definitely would have.       I for one understand your position. I can't believe the completely selfish reactions of some of the commenters here.

      It was a simple and honest mistake which, if honoured, would have resulted in a large amount of money lost. Few small businesses would want to absorb that kind of loss.

      And I bet most people complaining about your decision would have done the exact same thing if they were in your shoes.

        Exactly right.. why would you want or expect an operation like this to wear this sort of a loss. It's not a big company like Dell, etc. With the margins on hardware, it would probably take them months to make it back.

    do so many seriously expect a small company to take a large loss for a minor error that does not violate any legislation?

    large companies like dell etc will take the loss to avoid losing reputation. however by buying $9 hard drives we are still exploiting loopholes in their system, and they are letting us get away with it just to keep us happy.

    whatever work you do - even if you're flipping burgers - would you really expect a cost to come out of your own pocket if you forgot to include something, or gave misinformation without malice?

    An apology is all you should expect for an honest mistake. everyone is trying to save a dollar, but it shouldn't be at the expense of others, especially in (other) cases where it was an obvious pricing error.

    Even I feel the pain for uniquemobiles, I think the move is really dumb. They should at lease offer a voucher to those who brought on the wrong price. Doing what they had done is more costly for your comapy in the long run. Especially in such a comptitiive market.

    I can't say for sure but 90% certain that if the payment gateway completed the transaction and a confirmion email is sent, there is a contract and it can be bring in front of ACCC and people (customer of comapny I use to work for) has won case like this.

    Uniquemobiles is betting on most people got there money back and who be border to waste time arguing with them in front of ACCC for a 18 months old phone. That thinking is also true but just a few people decided to take u to ACCC will create so much pain for your company and waste you so much time that you wise you would have hournor the mistake in the first place.

      Just a side note, how difficult is it to add a routine on your web site to check the price,

      in ennglish it would be "selling price<=cost price then inventory=0" I am not a programmer but sure this is not hard to code. Why mistakes like this still happen??

      I am saddened by people who think that the ACCC can somehow be set on retailers like an indiscriminate attack dog. I have worked in retail customer service, and I can tell you that when you're doing the right thing by your customers, most ACCC interactions are simply a two-minute courtesy phone call that they've been contacted but that you're in the clear. The folks at the ACCC aren't fooled easily; a double-edged sword.

      As it happens, I bought a third phone (not this one) from Unique Mobiles just this morning. I chose them over some other retailers offering slightly lower prices because they have provided me with consistantly good service, including responding quickly and thoroughly to a warranty claim in which they were not personally at fault.

      Actually I'd rather them not offer a voucher. A voucher is a arguably a case of bait & switch.

      If they want to be nice, send every cancelled order a small gift item like an 8GB SD card or something like that as apology. Low value, cheap to ship.. generally useful to anyone.

    I purchased one of these last night and promptly bought some accessories on ebay and then went to sleep,i woke up to find the order was cancelled which made me a touch mad but as i had already bought the accessories i figured i'd buy one anyway and thought given the situation Unique Mobiles would perhaps meet me halfway but nope stonewalled at $359.

    So Unique Mobiles your name is now mud whenever anyone in the future asks if your ok to deal with :)

  • Did anyone not receive their refund? I got an email from Unique on Friday saying the refund has been processed. Paypal shows the seller has refunded the full amount but I cannot see it in the "paypal balance". The transaction details says

    PayPal has placed a temporary hold while we're reviewing it. We'll contact you shortly with further information.

    Probably will wait today before giving paypal a call, wont let the paypal bastards sit on my money.

      Got an email from Unique on Friday saying refund has been processed.

      But until now, still nothing shown in my bank account.
      (I paid by debit card through savings account)

      • Ok so curiosity got the better of me. I called up Paypal and the guy said it is because Paypal used their money to pay Unique on Thursday Night. The source of my payment was my Commonwealth Bank account and it takes about 3-4 working days for Paypal to actually get the money from the bank (altough Paypal pays seller instantly and meanwhile they keep your credit card details as backup source).

        So in such cases where a quick refund is provided, Paypal would put the transaction on hold until they receive the money from the bank. He said I should expect to see the money in my Paypal account by Wednesday. Hope it makes sense.

  • What a pain for you guys. Lucky I did missed out as I fell asleep while holding my phone in a process of purchasing it. I woke up the next day with the knowledge of price error.
