House under Construction with Tap Leakage

Neighbour's house is nearing completion (VIC Melb)
Neighbour while putting up fencing informed me about tap
/pipe leakage at my under construction site, the same info I passed on to the builder.

Builder is claiming that their trades didn't cause the tap leakage (front of the house near meter) and that neighbour's tradies while carrying on the fencing work might have caused the issue and is blaming me that Im at breach of contract cause access to the property by third parties needs to be arranged through the builder (which I didn't cause neighbour never asked me for anything and why would I since I know that I cannot). Im just shocked to see this response.

Q : Do owners need neighbours approval to put up fencing ?
Q : Who is at fault ?

    How does fencing work cause a tap to leak ? That's a bit of a stretch of logic.

      Same way a builder causes a tap to leak? I can understand the builders point someone else was on the site around the same time the tap started leaking and they are coping the blame?

    This is weird, why wouldn't the builder just have someone fix the tap. Would take five mins…

    • Builder's margin is so slim, that fixing a leaking tap is going to put him in the red obviously.

    Are you talking leaking tape or a leaking pipe?

    If a tap, then just buy a new one from bunnings and replace it yourself. Turn the water off first. No point in getting the builder offside for a sub $50 tap.

    Tell him to prove it. Because he is meant to keep the site secure. He might have a camera there to prevent theft.

        Either way, not your problem and builder needs to call his plumber back and sort it out.

        • Same thoughts but I was shocked at their response. Just dont wanna argue with him to just prove my point. He is blaming it on the fencing folks and suggesting that access to the property by third parties needs to be arranged through the builder and hence Im in breach.

          • @urahara: Did the fencer ask you for access, and you said yes? If not, then how are you in breach?

            • @pjetson: Nops they might have sent a notice to me which I missed but how does this even matter for a water meter 2 mtrs away from the fencing.

                It matters if you granted the fencer access in conflict with your contract with the builder.

  • This is why, through your contract, you pay for insurance.

    Your builder can either a) fix it and suck it up or b) claim it and get a third party to do it.

    Either way, it's not your problem. For now. But it will be your problem when the water bill comes - because as far as the water company is concerned, it aint their problem! 🤣
