If You're in a Car Accident and Not at Fault - Share Dashcam or Not?

Hi all,

Just wondering if you’re in a car accident and you’re not at fault and the person who caused the accident wants your dash cam footage, would you share it?

I would just like to hear some views.

They will try to find a way to blame you or find a technicality/something you did wrong to lessen their exposure (ie. you did x, that makes you 50% responsible).

It's your evidence. Let them tell their story as they think it happened and the evidence will confirm what is true.

Knowledge is power. Never give up power to a stranger unless you have to.

    Only disclose to your insurer.
And post on OzBargain of course

Just tell them if they wanted dashcam footage, they should have bought a dashcam

woulda been interesting if this was framed as an opposite. “I was at fault in an accident but other party is refusing to share their dashcam footage, are they dodgy/hiding their part in the accident?”

    • Haha, yeah wonder what the comments would be for the exact question that you framed?!

    • You don't happen to work for A Current Affair, do you?

You paid good money for a dash cam for your benefit - not someone else's.

Why would you even tell them you have a dashcam? Yes they may notice it but otherwise don't say anything and let them hang themselves.

In my most recent bingle (which I made a forum post about) I used my dashcam as leverage to get a written note of liability from the other party. Told them write me the note or I call the cops and let them decide. It worked.

Don’t tell anyone about it until you have had a chance to review it yourself.

Friend of mine finally got a camera after me urging and urging them to get one and the first accident they had they went off half cocked and were telling the police and anyone else would would listen “I don’t care, I have a dash cam that proves I’m right…”

Police seized the camera as evidence and went over the footage and found the friend was partially at fault.

Dont say or supply anything until you are legally requested to. Keep your mouth shut until you have had the chance to review the footage yourself or with your lawyer.

I have been involved in two crashes this year (one my car was not touched, I was a near miss 3rd party), and had dashcam footage for both. I told the police after they noticed the camera that I may have the footage in both instances and said that I was happy to hand it over to them should they request it from me or an insurance company request it from them. I wouldn't have handed it over to the at-fault party though.

Both occasions the police did request the footage because the at-fault driver was claiming that they were not at fault/the innocent driver did something illegal to cause it. The footage proved otherwise in both instances, but I don't like the idea that the at-fault driver could try and nitpick each frame of the video or in a worst case scenario attempt to doctor the footage without it being known to the police that the footage was mine.

    • Did you vote in the poll in the other discussion 'I am better than 80% of drivers'. :)

      • Hahahaha yeah mate! Of course, I'm in the 99th percentile!

Being fair, neither of the crashes were my fault - I have the footage to prove it ;)

That's Rule 2. Never share your dashcam video unless legally required.

Rule 1 is never tell them you have a dashcam in the first place.

  • Depends whether I die in the accident or not.

I would never share my dash cam footage or offer it.

I would rather they make a false statement to the Police then submit the truth.

Three stoogies who voted to share the dashcam footage. Lol.
