    I’m a lawyer, and while I don’t draft wills anymore, my experience with these kits are that they are easy to mess thing up. This can range from incorrect recording of gifts to wills that completely fall over (often due to administrative errors). Wills can be simple documents, but the probate registrars that deal with them are very very picky and sticklers for the rules. Going through the process when there is an invalid (or no) will is a pain in the ass that your next of kin really don’t deserve.

    You should be able to get a basic will done for a few hundred bucks by a competent lawyer, who should also ensure it is prepared, signed and witnessed properly. Do yourself and your beneficiaries a favour.

    With comments about this one priority being done poorly and causing legal issues, is it still better than no will at all?

    I presume with no will, having to go through the court etc, would cost a lot of money and time? How much money and time vs having a will?

    Related: I replied to those, "pay now, die later" places, asking what happened if they go belly-up before I die.

    That's kind of shocking. Is there no gov't oversight on these scam artists?

    If you go to the public trustee in your state they will draw up a FREE will for you, provided you make them the executor. Take the will home, copy word for word, put on a new date a later date, and change the name of the executor to the one of your choice. I really appreciate the public trustee for their free assistance.

        Slip them a purse of coins as you are taken to the platform, so that they do a good job of it.

        It can be a family member, a neighbour, or other member of your community on whom you can rely. You can also appoint a substitute executor (as a backup) - maybe someone younger! You will need to have their agreements.

    Probably one of the riskiest things you can fill out yourself. Save a couple of hundred bucks now, and your estate pays thousands addressing court requisitions on the other end fixing up your errors.

    If I die or my wifey and I die without a will (intestate), could someone successfully contest intestacy rules?

    For instance, let’s say our [only] son is the beneficiary (as per intestacy rules). Could a brother, sister-in-law, parents (i.e., beneficiaries uncle, aunt, grandparents) successfully contest intestacy rules? Or would contesting intestacy rules be super difficult?

      Traditionally you leave people a few thousand each in the will to prove you didn’t forget them, to stop them successfully contesting the will.

    I'd stay away from free DIY wills - too often/easily disputed over minor mistakes eg numbering pages in wrong spot or something equally stupid.

    Still better than nothing I suppose (govnmnt will grab 50% if you don't have a will)

      No, the government will not grab 50% if you die intestate. Each state has its own legislation about intestacy. Generally, there's a table which sets out to whom your assets will go. It's usually your spouse/children, your parents if you don't have a spouse, that sort of thing.

    What happens to money & asstest if there is no written will, and you have spouse/children? Does it not go by default to spouse & kids?

    Public trustee system sounds really tough after seeing the ABC youtube video.

      Pretty much. If you write a will, you can dictate who it goes to though.

      Depends but it usually goes in the order of this:
      1 - Spouse including de-facto gets everything IF no children
      1a - Spouse get a statutory legacy amount and other assets, and children get the rest split evenly
      2 - If no spouse, children get it evenly
      3 - If your child passes away before you do, but they have children (your grand children), they get your child's share
      4 - If no spouse or children then the list will be parents then siblings then nieces and newphews then grandparents then aunts/uncles then cousins
      5 - If you have no one it becomes bona vacantia, even your best friend, to my understanding can't touch your things, because laws in Australia forbids friends in this list

      It's good to have a will so you can directly dictate your assets, especially if you want your friends to have a memory of you

    Where do you guys store your will? I googled it and it says with your solicitor (who has a solicitor?) or bank.

      In WA, you can store your will for free in the Public Trustee's fireproof vault.

      Do NOT get the Public Trustee to draft your will and definitely do NOT make them your executor though. The various Public Trustees around Aus have terrible reputations for being slow & price gougers. I think Four Corners did a program on it.

      I agree with suzta. Store the will but nothing more. At least they won't go out of business and leave you without the original will.

    If you are a union member, often the Unions offer a free will service as well, where Lawyers will draft basic wills for you.

    Beware of this mob - I consider Seniors just a little above legalised scammers!!! How they got to register the word Senior in their name is unbelievable!! It has nothing to do with Seniors!!
