NSW- At fault car accident - No insurance

I know i may get the flak for this. Have been a safe driver and had been delaying getting my car insurance due to lack of time and abundant tasks at hand…. However i learnt the lesson today. I was involved in 3 car accident in wet slippery road. Guy in front of me was a Red P .

Long story short the Red P in front of me braked hard, i braked hard but skid through and hit his car and his car hit the one at front(he had a tow bar hence tow entered through the grill of the Red P car, so had to call Towing.

I understand i would naturally be at fault however i only have CTP AND NO other insurance. What are my options to cover all our cars without going through big bill from their insurance to me. Can immediately get an insurance that can cover me instantly. I have learnt my lesson but i really don't have the cash to fix all these cars especially if there are write offs. Please help urgently.

            • @Shunto: What is fair is that OP caused an accident and damaged two cars and is liable for two cars.
              I know someone who was middle car and back person paid for the lot.

              I also know someone else that caused a chain reaction that resulted in like four cars, a fence, some poles and a retaining wall being damaged… and their insurance paid for the lot

    It would be worth seeing a financial advisor. Buying insurance is like gambling- many people will spend a lifetime paying for it and never use it, but in that one unlucky situation when you need it then it's worth paying for it. Hope that the damage on the other vehicles isn't too bad, and you're able to come up with a solution. Best of luck.

      Insurance is you taking a bet that an accident will happen, and the insurer betting that you won't have one. But unlike gambling, the insurer is actually buying something real: your risk of having an accident.

    Hope you don't get too stressed about it. There is always a solution, expensive as it may be. They can't take what you don't have.

    Nope, sorry man I think your bad luck just happened. You can’t backdate the cover. When you lodge your claim you mention time and date of incident, when they see you have applied for cover late you won’t be covered. Worst case they might deny and even flag you for insurance fraud which can further complicate your ability to own future insurance.

    Will you require to pay for the damages: Yes, but this won't need to be paid all at once. Insurance companies will 95% of the time send their files over to credit company to do a payment plan which works off your actual finances. You'll provide them some details of your financial situation and you'll pay off the damages over months/years through an amount that works for your finances.

  • You can get them to get a quote for a mechanic and try to just avoid their insurance all together and just settle on cash payment between you 2/3 because keep in mind they will also have to pay their excess and if they're a P-plater it can be $100s if not $1000s so avoiding an insurance claim all together would benefit you and them in some way.
    Quote they get from a local mechanic will be alot cheaper than whatever insurance is going to quote from one of their certified repairers. I know this has worked for small-medium collisions but if the damage is very extensive might be harder to negotiate.

  • dont forget yo may be up for 2 loaner cars, when some idiot cut me off that "thinks he should have insurance" and refused to assist me lifting bike up and was genrally a tool. I claimed every thing i could through my insurance (loaner, helmet, shoes, jeans, gloves (all protective gear had a worst a scatch or similar on it but none the less damage from accident) and the bill would of been pretty large. Not uncommon for 6 month wait on parts. New grill/bumper could take ages, tow hitch would of been damaged even a scratch you are liable for. Which will all come back to you.

    After paying this ~$20k bill you will probably find this insurance task having a little more priority in the future… expensive lesson though.

  • Car repairs can be incredibly expensive. I'm waiting on a car repair from a kangaroo collision. One headlight was hit, but the collision energy rippled through the side of the car and requires two doors to be replaced. Damage is over $8k, from an accident I drove away from without problems. Fortunately insurance picks up the tab and I only pay excess.

    As others have said, I don't understand why compulsory third party property insurance is not a thing in Australia. I pay ~$680 rego every year, of which over $450 is personal insurance. Adding TPP on top would only be about $150.

  • The first lesson to learn is to have a good threaded tyre to give you grip on the road when you brake.

    I had learned this lesson very hard, I brake hard on a wet road and I noticed my wheels are locked but unfortunately my car keep sliding due to the wet road and luckily it remained to within the drive lane and avoid hitting another car. The next day I book for tyres and got them replaced as they have cross 40K run and needed to replace anyway, but was getting it delayed as I was waiting to get it done during my pink slip time.

    Never support people who scam insurance, because of normal people like us have to pay an increase in your insurance charges.

    Ive had some real idiots driving front of me, who slammed their brakes at the last minute and I think to myself how did you not know traffic in front of you had stopped.

    Literally cannot see anything when you have a 4WD in front of you or an SUV for that matter.

      Doesn't matter, as you're supposed to keep a safe distance. Nervous unpredictable drivers can be just as dangerous.

      • I've had a stupid P-plater slam her brakes infront of a Merc I was following. Police saw my dashcam footage and didn't charge me. Saved me big time. Sometimes you get lucky and have police judgement on your side.

  • Since there are enough people slamming the OP for not having insurance, OP I'm sure you've learnt your lesson and I'm glad you and the other drivers are okay. If it helps, someone once hit my mum's car (but left a note). They didn't have insurance and she has a reasonably expensive car, so she got him to cover the excess instead and claimed the repairs through her insurance. Idk if that is a thing that could apply here, but wishing you all the best.

      Not applicable to OP, I’ve come across people are simply too ignorant of these matters. There were 2 blokes in former office that was driving not even roadworthy condition cars only used for commuting to and from station. They had no intention of getting even third party for the cars because 1) cars not roadworthy 2) too cheap to spend a dollar for insurance. One of them said he’d wanted to but the cost to get the car roadworthy was too much 🤦‍♂️

      • My family gifted a young cousin whom just got his license an old Toyota echo. The car is worth about 1.5k and it costed 1.4K to get the road worthy to transfer the car rego.

    Hopefully you have learned your lesson, because the ramifications of your decision are going to affect you for a long time. If you cannot afford to pay for all the damage, you will need to ask to be put on a payment plan. It is going to be a pain, but you will get through it. Not much else you can do, so in saying that good luck.

    This is unethical but it's the best option for your situation.

    Liquidate your assets, and hide them somewhere, crypto or illegal gambling sites.

    Declare bankruptcy. You're off the hook.

    edit: I should mention if the other people have insurance the only people who will be at a loss for this will be the insurance companies. (profanity) them all.

    I feel for you! What a crap experience…

    Now you know-

    This is where prioritising comes into play.

    i.e "What is the probability of having an accident?" = LOW
    "What is the potential cost if I DO have an at fault accident, have to pay for potentially multiple cars or get sued? = EXTREMELY HIGH

    This should have been at the top of your to-do list based on cost alone.

    Chalk this up to a very expensive lesson and never skimp or put off insurance again.

    I know you probably know all this but… go through all of your other high risk items on your list you've been putting off and fix it up ASAP.
    If you don't have a list, make one!

    I thought the C in CTP stands for compulsory… How is your car even registered? I know in NSW you cannot register a care without CTP.

  • If the other parties claim insurance against you the bill of repairs will be massive because smash repairs do mark ups. Bumpers and grille repairs are simple but can easily be $15k$-20k each car.

    Look mate I ain't gonna troll you like all these other posts telling you how dumb you are because I'm sure you've figured it out for yourself, but you're probably just after solutions even if they're not very good ones and trust me on this one - your options are very limited. This isn't financial advice by any stretch of the imagination but after weighing up many factors there could be an unorthodox solution: bankruptcy.

    On the off-chance this isn't your first bad financial decision, the amount of damage caused, your total amount of debt currently, how long it would take you to repay everything, your current assets/income, if you're happy to take a hit and lose all of your non-essential / high-value assets, and most importantly, your age and whether you need to apply credit cards or loans in the next 7 years (since you'll be blacklisted), after weighing up the answers to all of these questions and more, if you're eligible it could be a viable solution. Not a great one like I said but sometimes you have to weigh up the bad with the good.

    I had a mate who in our late teens or early 20's wrote a brand new car off, was in a world of debt, and didn't have the greatest job at the time so he claimed bankruptcy, spent the next 7 years sorting out his life financially and was a home-owner paying off a mortgage by the time he was 30… I mean it wasn't great, the guy had to pay for everything up front, couldn't get interest-free or lay-by, and struggled with some rental applications/postpaid phone accounts, but it wiped the slate clean getting him off a mountain of debt straight away, focussing on sorting himself out. Not saying it's for everyone but in his case it was for the best, he was young and went back to uni so the first half of 7 years was like water off a duck's back, he barely noticed it living the student life, and then had a job good enough where it didn't matter.

    Each to their own, hope you work it out but you're not getting off the hook on this one, you're gonna have to face the music whatever that may be…

    • Bankruptcy only stays in your credit file for 5 years not 7. In this case it’s not bad to take as he is not defaulting against the bank so as soon as bankruptcy drops of credit files he can apply for loans again. But he is gonna look at everything, there is an income threshold for the first 2-3 year when you not discharged they can go after it.

    Consider this is a very expensive lesson learned.
    At minimum everyone should have Third Party Car Insurance. If you cannot afford it or feel that you can drive without then please stop driving until that changes.

    Be prepared for an absorbent repair bill. I know someone who got into an accident and was uninsured (Who is now insured) and was at fault, the bill for minor damage came out to $6000+, this also included loss of wage for the affected party for a few weeks in addition to the repairs. Everything appeared to be invoiced as Brand New + a nice markup. Bill came directly from RACV repair centre not a third-party repairer.

    I had to take out a personal loan to pay for the damage to the other car and buy myself something.

    That was the last time I drove uninsured, and it also made me debt-averse.

  • Don't stress OP. There is no need to go bankrupt! They'll just garner your wages for like $50.

    • Can you elaborate? For example if the damages were like $5000 - who will garner wages for like $50? is that 50$ per payment cycle?

      So $50 for the next 100 payment cycles?

        Eventually they'll take the person to court. The court can't force you to sell your assets to pay off the debt so they'll garnish the persons wages.

    Don't understand why people drive without insurance myself. Am I confident that I won't cause an accident myself? Yes.

    Am I confident in the shit drivers we have in Perth to pay attention while driving and merge properly / do shoulder checks? No.

    I've had 6 claims in 3 years all not at fault, inc one where I was rear ended and had my car written off by a drunk driver. My insurance paid out $30k no questions asked within 3 days.

      And I thought I had bad luck with 4 (or 5 if my insurance figures out the last one) not at fault claims between 2015 and 2022 (5th one resulted in my car being T-Boned and written off)

      • Been side swiped 3 times by people not checking blind spots and turning into me.

        Rear ended twice, funnily enough it was an 8k repair bill on the first one and then after it was repaired, no more than a month later I get rear ended and it's written off.

        Last one was a lady pulling out of a side street and pretty much t-boned her.

        Premiums weren't really affected, think it went up by $8. But I did notice on my renewal policy I got mailed said my car that I had been driving around for almost a year "was not covered by insurance if it was in the Control or Care of Mr. Jarryd… (Myself).

        Apparently, having had so many accidents in a year activated their auto-exclusion system, easy enough to get sorted because none of them were at fault they just unticked a box.
