Illegally Parked Car Apartment Block

I live in a apartment in NSW and the building has a secured parking lot which belongs to my unit. However someone parked their car few days ago and still not moved their car which mean I am parking my car outside.

I've checked with all other owners in the same building and apparently no one owns this car. What can I do to remove this car?

Any advice would be helpful. Thank you.

Update 11.24 am

Put a note in all the units early today saying car will be towed (I was not even plan to do that) if not moved before 12 pm and the owner is liable for the cost and the car magically disappeared few minutes ago. Wish I did this few days ago.

    Contact apartment strata/management and/or council.

      • cheaper than parking fees. satisfaction = worth it

    • 100% this. We have a set of these at work for moving cars around that have their engine/trans out and I swear they get used more for “off site” moves than at work.

      While they are expensive to buy, there may be some places that will rent them if you can find them. Places like Kennards, etc.

      You can get these for ~$150ea pretty easily if you look around but the better option for cases like this is to just hire them. I've seen them for hire for $30/day.

    Check for cameras and request footage. Post pictures of face everywhere

    No cameras? Sounds like something could happen to the car..

    You will have to get onto the strata/body corporate and get them to start the process of removal (which takes ages as they have to go through the motions of notification etc). If you have visitor spots, you could try and sweet talk them into allocating one of them to you while the process is underway.

    The council won't help as it's private property.

    Check if rego is current (can do this without getting out of your seat).
    Get free PPSR check to see if anything dodgy about ownership/debt etc. Can also do this from your sofa.
    Do a quick check on likely roadworthiness of car. This involves getting off your seat and going to car park. Look inside car, check tyres, paintwork, is it maintained & cleaned or has it been dumped?Does it look stolen?
    If still in doubt, check with body corporate, maybe security service who patrol area, maybe cops?
    I mean, just go through a few logical steps, work it out & don’t bother posting this nonsense on OzBargain

    • So what can you do if registration has lapsed or it's unroadworthy?

    Put a large sign on it saying 'free car' and a sign on the street directing to the free car.

    • Or start stripping it and selling the parts.

    Appropriate all your replies. Its a secured parking lot so not sure how they got in. There are no security cameras and car is clean and doesnt look like it was stolen etc. Strata is useless so far and there are no visitors parking so I am out of luck. I live close to station in inner west so most of the streets have time limited parking spots and its bloody annoying trying to find a parking spot.

      For everyday they do not rectify the issue, make them back pay back a portion of the body corporate fees. I am sure they will then move their ass.

      • I am renting so might check with real estate to see what are my options.

        • Have you left a note on the car as well to say move it? Or next time do not park here?

          Ask for reduced rent, as you are not getting the full use of the apartment.

        • If you are renting then make it their problem. Ask for a rent reduction in the meantime.

      Problem with that its the renter will have to cop the call out fee for the removal I would have thought. But definitely an option especially if its been there if it's been there awhile

      • You reckon a tow truck will just come out and tow any random car from an apartment car park? Sounds like an easy prank

        • You can get those flat bed truck guys to come to remove cars. I've seen then get cars that are parked in front of driveways between 2 cars. Takes awhile, but as long ss they can get their chain to the cars anchor point they can a car onto their truck. Away it goes.

    • Tow truck will not touch it without someone taking legal responsibility of getting it towed. Call them and see what they say.

    The first thing to do in a circumstance like this is check with the police to see if the vehicle is stolen. The police generally won't tell you who owns it, but they'll tell you if its stolen. If it is stolen the owner or the police will arrange removal for free.

    Being a renter, the car space forms part of that arrangement..

    lodge a complaint with your real estate and they will in turn lodge with the body corporate.

    Also as the space is not available per your tenancy agreement, request a rent reduction to cover costs and inconvenience while the space is unusable..

    Put up an airtasker type thing for someone to move the car with those hydraulic jacks?

    I had this situation at our apartment. The good thing is that our carpark has signs warning people not to do this and a towing company number attached to it. We called them after two days of warning the car owner, we provided proof we owned the spot to the tow driver and they came in and picked it up within the hour. Cost to us was nothing - the owner of the car had to pay $700 to get their car back. They’ve never come back to our spot again.

    I've had this happen to me, if your park is in a position to block their car in with yours, simply park in front of them (can negotiate with neighour to also park in front of theirs and move as required when they need to leave). Then leave a note on their car with your number saying they can move your car when they call and speak to you.

    If it was my block we'd just hook it up to my car and skull drag it out onto the street and let the council/police worry about it.

    Are owners corporations powerless to remove illegally parked vehicles from visitor parking spaces?

    On 30 November 2016, the Strata Schemes Management Act 2015 (Strata Act) commenced which allows regulations to be made that confer power on an owners corporation to dispose of goods (including motor vehicles) left on common property.

    Clause 34 of the Strata Schemes Management Regulation 2016 (Strata Regulation) allows an owners corporation to move or remove a motor vehicle left on common property that blocks an exit or entrance or obstructs the use of common property.

    • Does obstruction of common property include parking in an allocated space? Certainly not blocking access if fully parked within someone else’s space. Is an allocated space for a particular unit still common property?
