Nature Strip Parking Fine. Should I Go to Court?

Another parking fine discussion.

The spot I parked is a non-restricted parking spot around the school zone, just that my car overshot the spot into the grass. Received fine for "Stopped on a nature strip" from the council. Requested review which failed.

Do you think I have any chance if I go to court? I couldn't find details on what's the cost involved. Appreciate any directions.

    Looks pretty far into the grass if we can't see the diagonal brick line.

    Not worth the hassle and mental stress. Pay it and move on.

    Not a driver but saying "my car overshot the spot" is not a good start - the car did nothing of it's own volition.

    A chance that you'll receive a bigger fine and court costs? Yes. Don't waste the court's time.

    Unless it was a genuine emergency you have no excuse for parking illegally.

    The red one looks to be parked on someone's front lawn and the white one is in a parking spot?

  • The majority crowd view here is that courts will always impose harsher punishment or just brush it off. They seem to be just keyboard justice warriors with no actual experience because in reality, courts are pretty lenient if you are humble and give them a reasonable explanation.

    The picture you showed is pretty harsh and I would definitely "challenge" (ask for leniency) it in court. However, this also depends on the amount of the fine whether its worth taking a day off work for this.

  • The problem lies in the shape of the carpark. Had they made it square the issue would not have arrisen.

      The problem is where the car is parked..partly on the grass, against the Rules.

    • If they had made it square it would be almost big enough for two cars.

      They drove over a couple of feet of grass to leave it there when there was a country mile of space to park in. I have no idea how a person manages this without realising they're doing the wrong thing and not just backing up a few feet.

      • That's because you're assuming they would ADD the green area to make a larger rectangle, instead of REMOVING the diagonal corner, to make a smaller rectangle. If the latter was the case, OP wouldn't be able to try to squeeze in a spot.

        The corner is meant to allow easy exit of the spot without driving over grass, and it looks nice too, not to people to try to pretend the parking area is larger than it actually is.

        Now I'm making guesses, but OP probably parked that way to allow another small car to be parked behind it.

    Nothing wrong asking for a review. You lost, pay the fine, move on.

    What's the court going to do for you, confirm you broke the law? It's that simple.

        Cos i live on a narrow street in Sydney, no one cares if the grass is parked on and it leaves space on the road. Without this people might care if a kid gets hit or a few wing mirrors get clipped by a truck trying to squeeze down the road. Its only grass and its a victimless crime.

        • You might want to look into the urban heat island effect and really how important nature strips, with or without trees, really are to suburban areas.

      • cos most government rules are pretty stupid these days and designed to extort maximum funds (and obedience) from people who have not actually done anything 'wrong'. Of course clowncourt is also part of that system so YMMV in that regard too.

    Overshot is an understatement. Almost half a car's length out on the left side. If you look at the second photo with the white car you would notice the result from cars parking like this.

    Pretty sure, you created a 2nd car space on the grass from the photo. There appears to be enough space for another car on the pavement…

    My guess is, there was another car on the pavement, and you made another space on the grass…you came back, car behind has left, but you got a parking ticket when you returned to your car.

    Sure, but based on what grounds? You need a VALID and LEGAL reason to fight it.

    You yourself say the car didn't 'fit' into the car space and was on the grass.

    YOLO! Take it to court. And make sure you tell the magistrate that it's "nuffin' but ReVeNuE rAiSiNg!!"

  • It's outside of the boundary.

    So it's on Council land.

    The paved area doesn't look like one of those approved parking spots council put in on narrow streets.

    Buckleys, legally if above is correct. You may get a nice reviewer who will let you off due to "Mistaking" the paved area as a legal parking space.
