Cancelling Order for a Car - Any Consequences?

I ordered a car but unfortunately it's a minimum 3 months they can give me the car and no estimate date arrival, but the other dealer can give me in next month time.

I just want to know if I can cancel the order and order on the other dealer? Is there any consequences?

    What did your contract say?

Irrelevant, we all know the court of ozbargain overrules all.

‘It's the vibe of it. It's the Constitution. It's Mabo. It's justice. It's law. It's the vibe and ah, no that's it.’

      Santa Clause:

      • Don’t forget to get comprehensive insurance cover before leaving the dealership. If you are involved in an accident, explain yourself at www.OzBargain.com.au/forum

Whats the bet the other dealer "SAYS" he can deliver, but wouldnt they all come from the one supply unless they are cars that nobody wants and their storage yard has had cars sittin in the weather for months….

Next thread will be ……… but he said …..

    • Its all lies and deceit

Stealerships often work together and share cars.

If 1 stealership can't source the car you want in the timeframe you want it's highly unlikely another one can.

    • Correct!
Unless they have an order cancellation

  • He told me guaranteed i can get it

oh, well if a car salesman guarantees it… then it must be true :)

      • Not a trace, of doubt in my mind
Now I'm a believer, yeah, yeah, yeah, yeah, yeah, yeah

      • "Told me" vs unsighted Contract date and terms

        Hmmmmm.

    • +2

      Guaranteed?

Get it in writing… Make it a condition on the contract of sale. If they balk at making it a condition of sale, they can’t guarantee it and just want you to sign up and then feed you all the bullshit lies to stall you out…

Refund 2x the deposit if they cant get it in a month, write it down as a special clause.

        • yeah right
With hundreds queuing up to buy.
I don't think so big boy

Its my terms or no car. that simple

          • @HeWhoKnows: Depends. If a buyer is desperate and throws a big enough bone. Might not be you and I, but there are always people out there with different priority where a small amount to secure higher priority is acceptable.

Point is to request for it in writing, with consequence for breaching that promise. Will catch out alot of bluff.

    • GTE in writing on the contract or cancel the contract.

I had a delivery date put on the last car I bought an the dealership tried everything to take longer. My response was always that that is okay and as such when do they want me to come in to get the deposit back, which they responses that they would check etc. In the end the color was changed from some white to glacier white and delivered on time.

      @ Mrokire

      He told me

Apologies for posting the incorrect information then /s

How do you tell when a car salesperson is lying?

      Their lips are moving.

      • Upon the first eye contact as you walk in the door.

    • +1

When car salesmen talk just remember that all the words coming from their mouths are lies (except for the specifications of the vehicle).
I can get it next week = Lie
ARB Bullbars are genuine accessories = Lie
You need an electronic rust preventer = Blinking light Box of LIES!
This is the right car for you = Biggest lie

  • What does the contract say?

  • +1

As mentioned above, there is a 3 day cooling off period.

After this, the most that would happen is that you would lose your deposit. The dealership could also come back at you for losses if they have to sell the car at a lower price to someone else; but since they dont have stock anyway; unlikely. Plus there are so many other people wanting cars; they should be able to see it to someone else at no lower price.

    • Also check delivery date on contract and relevant terms. dont think it is reasonable to put down a deposit that might not arrive in 3 months.

  • What does that combined sheets of paper that you put your signature on say?

  • It is fine to cancel. I did the same when my dealer said the car was delayed by another 3 months. I could cancel with no issues. You should be able to get your full deposit back but do read the contract.

    • thank you, what shoud i say?

      • +1

That the delay is unacceptable and you don't want to go ahead with the purchase?

    • +1

Delayed another 3 months is a lot different.

  • +1

Why do people go into these deals, contracts without asking the bloody obvious. Beggars belief.

  • Have you read the contract? Have you bothered to contact the seller? One would presume so, particularly "when" you have also given a deposit, and committed to further payments.
