Who Else Has Been Scammed by ShopBack, Where to, ACCC? COURT?

Same old story:
I see a great deal on OB, https://www.ozbargain.com.au/node/638136
I then click on it, It tracks on my ShopBack click (as per their website) , I got called away on a meeting, come back 20 min later carry on and order the products $124 worth.
It doesn't track,
2 days later email ShopBack and get a generic response where they say the retailer will NOT pay them as it didn't track and they gave this generic rubbish:

There are quite a few reasons why these orders may not be attributed to ShopBack. This includes:

  1. If a user clicks on a Honey, Cashrewards, or another chrome extension after clicking from ShopBack
  2. If other web pages (including search sites, social media, store sites, promotional/discount sites) or web browsers are opened after clicking through ShopBack
  3. Clicking through to another page from a banner, pop-up, or advertisement on the store’s webpage whilst shopping
  4. Antivirus/Cleanup or Adblocker applications block or disrupt Cashback tracking (Tracking cookies are required to track transaction)
  5. When the order falls under the merchant’s exclusions, including the use of promo codes not listed on ShopBack.

I have proof of click,
I also have proof of not randomly ordering lots of alcohol in the middle of the day.

Who can advise of the best steps forward,
I am happy to take it first thru a governmental agency and then to the small disputes trubuneral ,

Is it even worth going thru the ACCC:

make formal decisions on whether a person or business had breached the law as only the courts can do this
regulate or set the prices for goods or services such as groceries or fuel
provide dispute resolution services between consumers and businesses.

ANYWAY , I AM CONFIDENT I HAVE ENOUGH EVIDENCE SO I WILL TAKE THIS AS FAR AS NEEDED: WHATS YOUR ADVICE?

  • I gave up on both CR and SB. Too much hassles. I always got email said cash back is tracked but then they denied it months later. I cant keep records, filming me purchasing things every single time. But SHOPBACK is the worst for me.

    It's frustrating to see the constant complaints after complaints here. Indicative that nothing's improved on ShopBack's end. Instead of making your complaints here, I'd suggest you to also/instead make your complaints to the ACCC. You will have your problems heard there, and any future problems hopefully won't occur again.

    I'm constantly seeing a lot here, but your complaints wont be actioned properly if it is here.

    • I don't use ShopBack anyway but I thought ACCC doesn't actually resolve any disputes, they just hear you out. Similar to reporting to ACCC's Scamwatch. No real action taken, just cataloguing complaints.

        No, it depends on the matter, how serious it is and they prioritise accordingly. It's not just a body that hears complaints. My friend used to work there. If there are enough complaints, voices raised then they will decide if it should be prioritised, reorder their priorities. They have a system and it is on their site.

        If we keep posting it on here, what's the point when the problems going to keep occurring?

          That's interesting to hear, what would a prioritised item be? An independent investigation of sorts? Do they contact individuals to get more info and put a case together?

          I suppose posting here, while annoying to others, yields the following:-

          1) A place to vent and share grievance. Some people feel better getting things off their chest.
          2) Opportunity to get similar stories and potential solutions/ideas/options from others.
          3) Attract attention of SB rep due to negative publicity which does seem to work.

      • Yeah they don't care much about your individual case but are interested in systemic issues.

        Needs to be like this:

        "It appears it is their staff policy in this store is to say that you must go the manufacturer for support - unless and until you formally raise a complaint or mention consumer law. They are aware of the law and will comply with it, but not without providing that misleading advice first and making it seem firm and final."

      • This is bullshit, they absolutely do act on complaints. Same with Scamwatch.

      OP, this thread could be used in future comments, especially if you provide;
      - A link to where to complain
      - How to make a complaint, ie ABN, how to make a good complaint
      - Your public complaint, so others can see how its done

      They have plausible deniability about the entire process so they can basically do whatever they want and blame anyone they like. They only way to 'win' is to provide their business to someone else more trustworthy e.g. Cashrewards

      I just stopped using cash back sites altogether. Too much headache for a small payout

    • Why not simply stop using them?
